AMENDMENT TO HOUSE BILL 4756

2     AMENDMENT NO. ______. Amend House Bill 4756 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Farmers' Market Technology Improvement Program Act.
 
6     Section 5. Definitions. As used in this Act:
7     "Farmers' market" means a common facility or area that has
8 been approved by the United States Department of Agriculture's
9 Food and Nutrition Service where several farmers or growers
10 gather on a regular, recurring basis to sell a variety of fresh
11 fruits and vegetables and other locally-grown farm products
12 directly to consumers. The term "farmers' market" includes
13 nontraditional fresh food markets.
14     "LINK card" means an electronic benefits transfer card
15 issued by the Department of Human Services for the purpose of
16 enabling a user of the card to obtain SNAP (formerly known as

1 food stamps) benefits or cash.
 
2     Section 10. Farmers' Market Technology Improvement
3 Program.
4     (a) The Department of Human Services and the Department of
5 Agricultural shall implement a Farmers' Market Technology
6 Improvement Program. The purpose of this program is to increase
7 access to fresh fruits and vegetables and other LINK eligible
8 food products, including quality meat and dairy, for all
9 Illinois residents by allowing LINK program participants to
10 redeem their SNAP benefits at farmers' markets. The Department
11 of Human Services and the Department of Agriculture shall
12 solicit federal and State funding for the purpose of
13 implementing this program.
14     (b) The Farmers' Market Technology Improvement Fund is
15 created as a special fund in the State Treasury for the purpose
16 of implementing the Farmers' Market Technology Improvement
17 Program. All monies received pursuant to this Act shall be
18 deposited into the Farmers' Market Technology Improvement
19 Fund. Funding for the program must be used for one or more of
20 the following purposes:
21         (1) The purchase or rental of wireless point of sale
22     terminals capable of processing SNAP benefits disbursed
23     under the LINK program.
24         (2) Monthly or transaction fees associated with LINK
25     card transactions. No fees related to credit or debit

1     transactions will be reimbursed.
2         (3) Outreach to LINK program participants.
 
3     Section 15. The State Finance Act is amended by adding
4 Section 5.755 as follows:
 
5     (30 ILCS 105/5.755 new)
6     Sec. 5.755. The Farmers' Market Technology Improvement
7 Fund.
 
8     Section 99. Effective date. This Act takes effect July 1,
9 2011.".
