AMENDMENT TO HOUSE BILL 4866

2     AMENDMENT NO. ______. Amend House Bill 4866 as follows:
 
3 on page 6, line 17, immediately after "10," by inserting
4 "14.2,"; and
 
5 on page 10, immediately below line 24, by inserting the
6 following:
 
7     "(410 ILCS 615/14.2)  (from Ch. 56 1/2, par. 55-14.2)
8     Sec. 14.2. For the purpose of carrying out the provisions
9 of this Act and the rules and regulations promulgated
10 thereunder, the Department through its authorized inspectors
11 or agents is empowered:
12         (a) To enter on any business day during the usual hours
13     of business, any place or conveyance within the State where
14     eggs are produced, candled, incubated, stored, packed,
15     delivered for shipment, loaded, shipped, transported or

1     sold. ;
2         (b) To enter on any business day during the usual hours
3     of business, with or without the presence of the owner,
4     manager, or other responsible person, any restaurant
5     kitchen or the kitchen and food storage area of any other
6     public eating place including but not limited to hotels,
7     boarding houses, hospitals, nursing homes, government
8     institutions, or any other business facility or place in
9     which eggs or egg products are stored, prepared, or offered
10     as food for use by its patrons, residents, inmates, or
11     patients. ;
12         (c) To enter on any business day during the usual hours
13     of business the cooking or food preparation area of any
14     bakery where eggs and egg products are used in the
15     manufacture of bakery products, with or without the
16     presence of the owner or persons employed as bakers, or to
17     enter at any time while those bakery products are being
18     prepared.
19         (d) To sample any eggs or egg products for analysis or
20     testing. Sample eggs or egg products shall be furnished at
21     no cost to the Department.
22         (e) To inspect all invoices, eggs and egg products, and
23     the cases and containers for eggs or egg products and the
24     equipment found in the places or conveyances described in
25     paragraph (a) and to seize and hold as evidence an
26     advertisement, sign, placard, invoice, case or container

1     of eggs or egg products, or all or any part of any pack,
2     load, lot, consignment, or shipment of eggs or egg products
3     packed, stored, delivered for shipment, loaded, shipped,
4     transported, or sold in violation of any provision of this
5     Act. Possession of a commodity described in this Section by
6     any person engaged in the sale of that commodity is prima
7     facie evidence that the commodity is for sale.
8         (f) To seize and hold any case or container of eggs or
9     egg products from any person or business who is not
10     licensed under Section 8 of this Act and is required to be
11     licensed.
12     Possession of a commodity described in this Section by any
13 person engaged in the sale of that commodity is prima facie
14 evidence that the commodity is for sale.
