AMENDMENT TO SENATE BILL 1980

AMENDMENT NO. ______. Amend Senate Bill 1980 by replacing everything after the enacting clause with the following:

"Section 5. The Counties Code is amended by adding Section 5-1131 as follows:

(55 ILCS 5/5-1131 new)

Sec. 5-1131. Fire sprinklers. A county board shall not adopt a code provision or ordinance that prohibits a person or entity from installing or equipping fire sprinklers in a single family detached residence or any residential building that contains not more than 2 dwelling units unless that code provision or ordinance is considered by the county board in a vote separate from any other code provision or ordinance. A county board shall not adopt a code provision or ordinance that requires a person or entity to install or equip fire sprinklers in a single family detached residence or any residential building that contains not more than 2 dwelling units unless that code provision or ordinance is considered by the county board in a vote separate from any other code provision or ordinance. This Section does not apply to any code provision or ordinance that requires fire sprinklers in a residence that was adopted before December 31, 2008.

Section 10. The Illinois Municipal Code is amended by adding Section 1-2-13 as follows:

(65 ILCS 5/1-2-13 new)

Sec. 1-2-13. Fire sprinklers. The corporate authorities of a municipality shall not adopt a code provision or ordinance that prohibits a person or entity from installing or equipping fire sprinklers in a single family detached residence or any residential building that contains not more than 2 dwelling units unless that code provision or ordinance is considered by the corporate authorities of a municipality in a vote separate from any other code provision or ordinance. The corporate authorities of a municipality shall not adopt a code provision or ordinance that requires a person or entity to install or equip fire sprinklers in a single family detached residence or any residential building that contains not more than 2 dwelling units unless that code provision or ordinance is considered by the corporate authorities of a municipality in a vote separate from any other code provision or ordinance. This Section does not apply to any code provision or ordinance that requires fire sprinklers in a residence that was adopted before December 31, 2008.

Section 99. Effective date. This Act takes effect upon becoming law.".
