AMENDMENT TO SENATE BILL 2187

AMENDMENT NO. ______. Amend Senate Bill 2187 by replacing everything after the enacting clause with the following:

"Section 5. The Counties Code is amended by adding Section 5-1131 as follows:

(55 ILCS 5/5-1131 new)

Sec. 5-1131. Longwall coal mining. Notwithstanding any provision of law to the contrary, no person or entity may conduct or engage in longwall coal mining in Bond County or Madison County before (i) the completion of an environmental impact study and (ii) the county board enacts an ordinance approving the use of longwall coal mining. For the purposes of this Section, "longwall coal mining" means mining done under hydraulic roof supports or shields that are advanced as the seam is cut, in which a cutting head moves back and forth across a panel of coal, where the cut coal falls onto a flexible conveyor for removal and the roof in the mined out areas falls as the supports or shields advance.".
