| AMENDMENT TO SENATE BILL 2476

| AMENDMENT NO. ______. Amend Senate Bill 2476 by replacing | 3 |
| everything after the enacting clause with the following:

| "Section 5. The Illinois Vehicle Code is amended by | 5 |
| changing Section 11-208 and by adding Section 11-1307 as | 6 |
| follows:

| Sec. 11-208. Powers of local authorities.
| 9 |
| (a) The provisions of this Code shall not be deemed to | 10 |
| prevent
local authorities with respect to streets and highways | 11 |
| under their
jurisdiction and within the reasonable exercise of | 12 |
| the police power from:
| 13 |
| 1. Regulating the standing or parking of vehicles, | 14 |
| except as
limited by Sections Section 11-1306 and 11-1307 | 15 |
| of this Act;
| 16 |
| 2. Regulating traffic by means of police officers or |
|
|

| traffic control
signals;
| 2 |
| 3. Regulating or prohibiting processions or | 3 |
| assemblages on the highways;
| 4 |
| 4. Designating particular highways as one-way highways | 5 |
| and requiring that
all vehicles thereon be moved in one | 6 |
| specific direction;
| 7 |
| 5. Regulating the speed of vehicles in public parks | 8 |
| subject to the
limitations set forth in Section 11-604;
| 9 |
| 6. Designating any highway as a through highway, as | 10 |
| authorized in Section
11-302, and requiring that all | 11 |
| vehicles stop before entering or crossing
the same or | 12 |
| designating any intersection as a stop intersection or a | 13 |
| yield
right-of-way intersection and requiring all vehicles | 14 |
| to stop or yield the
right-of-way at one or more entrances | 15 |
| to such intersections;
| 16 |
| 7. Restricting the use of highways as authorized in | 17 |
| Chapter 15;
| 18 |
| 8. Regulating the operation of bicycles and requiring | 19 |
| the
registration and licensing of same, including the | 20 |
| requirement of a
registration fee;
| 21 |
| 9. Regulating or prohibiting the turning of vehicles or | 22 |
| specified
types of vehicles at intersections;
| 23 |
| 10. Altering the speed limits as authorized in Section | 24 |
| 11-604;
| 25 |
| 11. Prohibiting U-turns;
| 26 |
| 12. Prohibiting pedestrian crossings at other than |
|

| designated and marked
crosswalks or at intersections;
| 2 |
| 13. Prohibiting parking during snow removal operation;
| 3 |
| 14. Imposing fines in accordance with Section | 4 |
| 11-1301.3 as penalties
for use of any parking place | 5 |
| reserved for persons with disabilities, as defined
by | 6 |
| Section 1-159.1, or disabled veterans by any person using a | 7 |
| motor
vehicle not bearing registration plates specified in | 8 |
| Section 11-1301.1
or a special decal or device as defined | 9 |
| in Section 11-1301.2
as evidence that the vehicle is | 10 |
| operated by or for a person
with disabilities or disabled | 11 |
| veteran;
| 12 |
| 15. Adopting such other traffic regulations as are | 13 |
| specifically
authorized by this Code; or
| 14 |
| 16. Enforcing the provisions of subsection (f) of | 15 |
| Section 3-413 of this
Code or a similar local ordinance.
| 16 |
| (b) No ordinance or regulation enacted under subsections 1, | 17 |
| 4, 5, 6, 7,
9, 10, 11 or 13 of paragraph (a) shall be effective | 18 |
| until signs giving
reasonable notice of such local traffic | 19 |
| regulations are posted.
| 20 |
| (c) The provisions of this Code shall not prevent any
| 21 |
| municipality having a population of 500,000 or more inhabitants | 22 |
| from
prohibiting any person from driving or operating any motor | 23 |
| vehicle upon
the roadways of such municipality with headlamps | 24 |
| on high beam or bright.
| 25 |
| (d) The provisions of this Code shall not be deemed to | 26 |
| prevent local
authorities within the reasonable exercise of |
|

| their police power from
prohibiting, on private property, the | 2 |
| unauthorized use of parking spaces
reserved for persons with | 3 |
| disabilities.
| 4 |
| (e) No unit of local government, including a home rule | 5 |
| unit, may enact or
enforce an ordinance that applies only to | 6 |
| motorcycles if the principal purpose
for that ordinance is to | 7 |
| restrict the access of motorcycles to any highway or
portion of | 8 |
| a highway for which federal or State funds have been used for | 9 |
| the
planning, design, construction, or maintenance of that | 10 |
| highway. No unit of
local government, including a home rule | 11 |
| unit, may enact an ordinance requiring
motorcycle users to wear | 12 |
| protective headgear. Nothing in this subsection
(e) shall | 13 |
| affect the authority of a unit of local government to regulate
| 14 |
| motorcycles for traffic control purposes or in accordance with | 15 |
| Section 12-602
of this Code. No unit of local government, | 16 |
| including a home rule unit, may
regulate motorcycles in a | 17 |
| manner inconsistent with this Code. This subsection
(e) is a | 18 |
| limitation under subsection (i) of Section 6 of Article VII of | 19 |
| the
Illinois Constitution on the concurrent exercise by home | 20 |
| rule units of powers
and functions exercised by the State.
| 21 |
| (f) A municipality or county designated in Section 11-208.6 | 22 |
| may enact an ordinance providing for an
automated traffic law | 23 |
| enforcement system to enforce violations of this Code or
a | 24 |
| similar provision of a local ordinance and imposing liability | 25 |
| on a registered owner of a vehicle used in such a violation.
| 26 |
| (g) A municipality or county, as provided in Section |

| 11-1201.1, may enact an ordinance providing for an automated | 2 |
| traffic law enforcement system to enforce violations of Section | 3 |
| 11-1201 of this Code or a similar provision of a local | 4 |
| ordinance and imposing liability on a registered owner of a | 5 |
| vehicle used in such a violation.

| (625 ILCS 5/11-1307 new) | 8 |
| Sec. 11-1307. Centralized parking meter systems. | 9 |
| (a) As used in this Section: | 10 |
| "Centralized parking meter system" means a system of | 11 |
| regulating the standing or parking of vehicles that includes 3 | 12 |
| or more parking meter zones, and a single parking meter. | 13 |
| "Parking meter" means a traffic control device which, upon | 14 |
| being activated by deposit of currency of the United States, or | 15 |
| by electronic or other form of payment, in the amount indicated | 16 |
| thereon or otherwise, either: (1) displays a signal showing | 17 |
| that parking is allowed from the time of such activation until | 18 |
| the expiration of the time fixed for parking in the parking | 19 |
| meter zone in which it is located, and upon expiration of such | 20 |
| time indicates by sign or signal that the lawful parking period | 21 |
| has expired, or (2) issues a ticket or other token, or | 22 |
| activates a display device, on which is printed or otherwise | 23 |
| indicated the lawful parking period in the parking meter zone | 24 |
| in which the parking meter is located, such ticket, other | 25 |
| token, or display device, to be displayed in a publicly visible |

| location on the dashboard or inner windshield of a vehicle | 2 |
| parked in the parking meter zone, or such ticket to be affixed | 3 |
| on the front lamp of a motorcycle or motor scooter parked in | 4 |
| the parking meter zone. | 5 |
| "Parking meter zone" means a certain designated and | 6 |
| marked-off section of the public way within the marked | 7 |
| boundaries where a vehicle may be temporarily parked and | 8 |
| allowed to remain for such period of time as the parking meter | 9 |
| attached thereto, or the ticket or other token issued by the | 10 |
| parking meter, may indicate. | 11 |
| (b) If for any reason the parking meter serving a space or, | 12 |
| in a centralized parking meter system, serving a parking meter | 13 |
| zone is malfunctioning due to the accumulation of ice or snow | 14 |
| and it has been reported to the local authorities as | 15 |
| malfunctioning prior to a violation for the standing or parking | 16 |
| of vehicles being issued, it shall be a valid affirmative | 17 |
| defense to such violation until such time as the parking meter | 18 |
| is brought back into service. ".
