AMENDMENT TO SENATE BILL 2879

2     AMENDMENT NO. ______. Amend Senate Bill 2879 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 1-148.3a-5 and 11-1414.1 as follows:
 
6     (625 ILCS 5/1-148.3a-5)
7     (This Section may contain text from a Public Act with a
8 delayed effective date)
9     Sec. 1-148.3a-5. Multifunction school activity bus. A
10 multifunction school-activity bus (MFSAB) means a school bus
11 manufactured for the purpose of transporting 11 to 15 persons,
12 including the driver, whose purposes do not include
13 transporting students to and from home or school bus stops.
14 However, non-public schools may use a multifunction school
15 activity bus to transport non-public school students between
16 non-public schools for curriculum-related school activity. A

1 MFSAB is prohibited from meeting the special requirements for
2 school buses in Sections 12-801, 12-803, and 12-805 and
3 subsection (a) of Section 12-802 of this Code.

7     Sec. 11-1414.1. School transportation of students.
8     (a) Every student enrolled in grade 12 or below in any
9 entity listed in subsection (a) of Section 1-182 of this Code
10 must be transported in a school bus or a vehicle described in
11 subdivision (1)or (2)of subsection (b) of Section 1-182 of this
12 Code for any curriculum-related school activity. However,
13 non-public schools may use a multifunction school activity bus,
14 as defined in Section 1-148.3a-5 of this Code, to transport
15 non-public school students between non-public schools for
16 curriculum-related school activity. "Curriculum-related school
17 activity" as used in this subsection (a) includes
18 transportation from home to school or from school to home,
19 tripper or shuttle service between school attendance centers,
20 transportation to a vocational or career center or other
21 trade-skill development site or a regional safe school or other
22 school-sponsored alternative learning program, or a trip that
23 is directly related to the regular curriculum of a student for
24 which he or she earns credit.
25     (b) Every student enrolled in grade 12 or below in any

1 entity listed in subsection (a) of Section 1-182 of this Code
2 who is transported in a vehicle that is being operated by or
3 for a public or private primary or secondary school, including
4 any primary or secondary school operated by a religious
5 institution, for an interscholastic, interscholastic-athletic,
6 or school-sponsored, noncurriculum-related activity that (i)
7 does not require student participation as part of the
8 educational services of the entity and (ii) is not associated
9 with the students' regular class-for-credit schedule shall
10 transport students only in a school bus or vehicle described in
11 subsection (b) of Section 1-182 of this Code. This subsection
12 (b) does not apply to any second division vehicle used by an
13 entity listed in subsection (a) of Section 1-182 of this Code
14 for a parade, homecoming, or a similar noncurriculum-related
15 school activity.

17     Section 99. Effective date. This Act takes effect July 1,
18 2010.".
