AMENDMENT TO SENATE BILL 3146

AMENDMENT NO. ______. Amend Senate Bill 3146, AS AMENDED, with reference to page and line numbers of House Amendment No. 2, on page 3, immediately below line 16, by inserting the following:

"Section 2. The State Finance Act is amended by changing Section 6z-77 as follows:

(30 ILCS 105/6z-77)

Sec. 6z-77. The Capital Projects Fund. The Capital Projects Fund is created as a special fund in the State Treasury. The State Comptroller and State Treasurer shall transfer from the Capital Projects Fund to the General Revenue Fund $61,294,550 on October 1, 2009, $122,589,100 on January 1, 2010, and $61,294,550 on April 1, 2010. Beginning on July 1, 2010, and on July 1 and January 1 of each year thereafter, the State Comptroller and State Treasurer shall transfer the sum of $122,589,100 from the Capital Projects Fund to the General Revenue Fund. Subject to appropriation, the Capital Projects Fund may be used only for capital projects and the payment of debt service on bonds issued for capital projects. If moneys have been deposited into the Fund pursuant to Section 7.6, 12, or 13 of the Riverboat Gambling Act that are not necessary for the purposes of the Fund, as determined jointly by the State Treasurer and State Comptroller, then, on at least an annual basis, the State Comptroller shall order and the State Treasurer shall transfer that excess amount from the Fund to the Education Assistance Fund. All interest earned on moneys in the Fund shall be deposited into the Fund. The Fund shall not be subject to administrative charges or chargebacks, such as but not limited to those authorized under Section 8h.

"(b-5) Organization licensees, not including the Illinois State Fair or the DuQuoin State Fair, shall provide stake races and early closer races for Illinois conceived and foaled horses so that purses distributed for such races shall be no less than 17% of total purses distributed for harness racing in that calendar year in addition to any stakes payments and starting fees contributed by horse owners."; and

on page 137, line 23, by replacing "with equine research program" with "for equine research and education"; and

on page 138, line 14, by replacing "month" with "quarter"; and

on page 144, line 10, by replacing "or" with "or"; and

on page 144, by replacing lines 14 through 16 with the following: "live horse racing meets in the current year. The licensee's tax credit may not exceed the amount certified by the Board in 2010."; and

on page 149, line 25, by replacing "license" with "licensee is"; and

on page 150, line 5, by deleting "and"; and

on page 150, by replacing lines 16 through 20 with the following: "for programs to care for and transition injured and retired thoroughbred horses that race at the race track, or for horse ownership promotion, in accordance"; and

on page 151, line 12, after "research", by inserting "and education"; and

on page 151, line 16, by replacing "the R.A.C.E. program" with "programs"; and

on page 151, by replacing lines 20 through 22 with the following: "$100,000 shall be paid to Illinois universities for equine research and education."; and

on page 173, by replacing lines 8 through 13 with the following: "is reached."; and

on page 175, by replacing lines 4 through 7 with the following: "be deposited into the Capital Projects Fund."; and

on page 176, by deleting lines 5 through 16; and

on page 176, line 17, by replacing "(g)" with "(f)"; and
