AMENDMENT TO HOUSE BILL 77

AMENDMENT NO. ______. Amend House Bill 77 by replacing everything after the enacting clause with the following:

"Section 5. The Personnel Code is amended by adding Section 8g as follows:

(20 ILCS 415/8g new)

Sec. 8g. State Employee Commuter Vehicle Registration.

(a) As used in this Section, unless the context otherwise requires:

"Commuter vehicle" means any automobile, truck, or motorcycle leased or owned in whole or part by a State employee and used by that employee to commute to or from employment with a State agency.

"State agency" means any entity included in the definition of "State agencies" in Section 1-7 of the Illinois State Auditing Act.

"State employee" means a person employed by a State agency whose relationship with that agency constitutes an employer-employee relationship under the usual common law rules, and who is not an independent contractor.

(b) Each current State employee who has been employed by a State agency for more than one year must, within 60 days after the date of his or her one-year service anniversary with that agency or within 60 days after the effective date of this Act, whichever is later, be able to furnish, upon demand by the head of personnel at the facility where the State employee is employed, evidence that he or she has registered his or her commuter vehicle with the State.

Section 99. Effective date. This Act takes effect upon becoming law.".
