AMENDMENT TO HOUSE BILL 1216

2    AMENDMENT NO. ______. Amend House Bill 1216 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
511E-190 as follows:
 
6    (105 ILCS 5/11E-190 new)
7    (Section scheduled to be repealed on January 31, 2013)
8    Sec. 11E-190. School District Realignment and
9Consolidation Commission.
10    (a) The School District Realignment and Consolidation
11Commission is established. The Commission shall consist of the
12following voting members:
13        (1) members appointed by the State Board of Education;
14        (2) a representative appointed by the Speaker of the
15    House of Representatives;
16        (3) a representative appointed by the Minority Leader

1    of the House of Representatives;
2        (4) a representative appointed by the President of the
3    Senate;
4        (5) a representative appointed by the Minority Leader
5    of the Senate;
6        (6) a representative of a statewide professional
7    teachers' organization appointed by the head of that
8    organization;
9        (7) a representative of a different statewide
10    professional teachers' organization appointed by the head
11    of that organization;
12        (8) a representative of a statewide organization that
13    represents school boards appointed by the head of that
14    organization;
15        (9) a representative of a statewide organization
16    representing principals appointed by the head of that
17    organization;
18        (10) a representative of City of Chicago School
19    District 299 appointed by the general superintendent of
20    schools;
21        (11) a representative of an association representing
22    school business officials appointed by the head of that
23    association;
24        (12) a representative of an association representing
25    school administrators appointed by the head of that
26    association;

1        (13) a representative from an organization
2    representing large unit school districts appointed by the
3    head of that organization;
4        (14) a representative from the Chicago Board of
5    Education appointed by the Chicago Board of Education; and
6        (15) a representative from an organization
7    representing administrators of special education appointed
8    by the head of that organization.
9    Members shall serve without compensation, but shall be
10reimbursed for their reasonable and necessary expenses from
11funds appropriated for that purpose. Members shall be
12reimbursed for their travel expenses from appropriations to the
13State Board of Education available for that purpose and subject
14to the rules of the appropriate travel control board.
15    The Commission shall meet initially at the call of the
16Governor as soon as possible after the effective date of this
17amendatory Act of the 97th General Assembly, shall select one
18member as chairperson at its initial meeting, shall thereafter
19meet at the call of the chairperson, and shall hold public
20hearings.
21    The State Board of Education shall provide assistance and
22necessary staff support services to the Commission.
23    (b) The purpose of the Commission is to make
24recommendations to the Governor and General Assembly on the
25number of school districts in this State, the optimal amount of
26enrollment for a school district, and where consolidation and

1realignment would be beneficial. The Commission's
2recommendations must focus on all of the following areas:
3        (1) Reducing the money spent on duplication of efforts.
4        (2) Improving the education of students by having less
5    obstacles between qualified teachers and their students.
6        (3) Lowering the property tax burden.
7        (4) Providing recommendations as to what the net cost
8    savings of realignment is to this State.
9        (5) Providing input to school districts on
10    reorganization.
11    (c) On or before July 1, 2012, the Commission must vote on
12its recommendations and file a report with the Governor and the
13General Assembly. If the Commission adopts the report by a
14three-fifths vote, then the General Assembly must, within 14
15days after the report is filed by the Commission, vote on
16whether to accept the report by the adoption of a resolution by
17a record vote of a majority of the members elected in each
18house. If the General Assembly is not in session on the day
19that the report is filed, then the General Assembly must vote
20on whether to accept the report within 14 days after the
21General Assembly convenes for the first time after the report
22is filed. The Commission is dissolved on the day after the
23report is filed with both the Governor and the General
24Assembly.
25    (d) This Section is repealed on January 31, 2013.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
