| Amends the Metropolitan Water Reclamation District Act. Provides for the election of Metropolitan Water Reclamation District commissioners from the same subdistricts as members of the Cook County Board of Review. Phases in the election from the subdistricts at the 2012, 2014, and 2016 general elections. Authorizes cumulative voting for commissioners. Changes the terms of commissioners from 6 years to a combination of 4-year and 2-year terms. Effective immediately.

| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Metropolitan Water Reclamation District Act | 5 | | is amended by
changing Section 3 as follows:
| 6 | | (70 ILCS 2605/3)

| 7 | | Sec. 3. The corporate authority of the Sanitary District of | 8 | | Chicago shall
consist of 9 commissioners
nine trustees .
| 9 | | Commissioners shall be elected at the general election from the | 10 | | same
geographical subdistricts from which members of the Cook | 11 | | County Board of Review
are elected. No political party shall | 12 | | limit its nominations to less than 2
candidates for | 13 | | commissioner in any subdistrict. In electing commissioners,
| 14 | | including those for nomination, each
elector may cast 3 votes | 15 | | for one candidate or distribute them equally among no
more than | 16 | | 3 candidates. The candidates highest in votes shall be declared
| 17 | | elected.
| 18 | | Three commissioners shall be elected from the first | 19 | | subdistrict in 2012 for
terms of 4 years and in 2016 for terms | 20 | | of 2
years.
| 21 | | Three commissioners shall be elected from the second | 22 | | subdistrict in 2014 for
terms of 4 years.
| 23 | | Three commissioners shall be elected from the third |

| 1 | | subdistrict in 2016 for
terms of 2 years.
| 2 | | Beginning with the election of commissioners in 2018, | 3 | | commissioners from the
first subdistrict shall be elected for | 4 | | 4-year terms, 4-year terms, and 2-year
terms; commissioners | 5 | | from the second subdistrict shall be elected for 4-year
terms, | 6 | | 2-year terms, and 4-year terms; and commissioners from the | 7 | | third
subdistrict shall be elected for 2-year terms, 4-year | 8 | | terms, and 4-year
terms.
Such trustees shall be
elected for | 9 | | staggered
terms at the election provided by the general | 10 | | election law. Three trustees
shall be elected at each such | 11 | | election to succeed the 3 trustees whose terms
expire in such | 12 | | year.
| 13 | | The commissioners
Such
trustees shall take office on the | 14 | | first Tuesday
after the first Monday
in the month following the | 15 | | month of their election and shall hold their
offices for six | 16 | | years and until their successors shall be elected and
| 17 | | qualified.
In all elections for trustees each elector may vote | 18 | | for as many candidates
as there are trustees to be elected, but | 19 | | no elector may give to such candidates
more than one vote, it | 20 | | being the intent and purpose of this Act to prohibit
cumulative | 21 | | voting in the selection of members of the board of the sanitary
| 22 | | district.
| 23 | | The election of the commissioners
trustees shall be in | 24 | | accordance with
the provisions of
the general election law.
| 25 | | By reason of the importance and character of the services | 26 | | performed by
the sanitary district, there is a great need and |

| 1 | | it is in the public interest
that those
such services be | 2 | | performed in as near a non-partisan character as
possible.
| 3 | | When a vacancy exists in the office of commissioner
| 4 | | trustees of any
sanitary district
organized under the | 5 | | provisions hereof , the vacancy shall be filled by
appointment
| 6 | | by the Governor . If 28 or fewer months remain in the term of | 7 | | the vacant
office, the appointment shall be for the remainder | 8 | | of the term. If more than
28 months remain in the term of the | 9 | | vacant office, the appointment shall be
until the next general
| 10 | | regular election at which
a commissioner shall be
trustees of | 11 | | the
Sanitary District of Chicago are elected for the remainder | 12 | | of the term ,
and thereafter until a successor
shall be elected | 13 | | and qualified.
| 14 | | The
Such sanitary district shall from the time of the first | 15 | | election held by
it under this Act be construed in all courts | 16 | | to be
a body corporate and politic, and by the name and style | 17 | | of the sanitary
district of...., and by such name and style may | 18 | | sue and be sued, contract
and be contracted with, acquire and | 19 | | hold real estate and personal property
necessary for corporate | 20 | | purposes,
and adopt a common seal and alter the same at | 21 | | pleasure.
| 22 | | The board of commissioners
trustees shall have the power to | 23 | | change
the name of the Sanitary
District of Chicago by | 24 | | ordinance and public notice without impairing the
legal status | 25 | | of acts theretofore performed by said district. Thereafter
any | 26 | | and all references to the Sanitary District of Chicago in this |

| 1 | | Act or
otherwise shall mean and include the name under which | 2 | | such sanitary district
is then operating. No rights, duties or | 3 | | privilege of such a sanitary district,
or those of any person, | 4 | | existing before the change of name shall be affected
by a | 5 | | change, in the name of a sanitary district. All proceedings | 6 | | pending
in any court in favor of or against such sanitary | 7 | | district may continue
to final consummation under the name in | 8 | | which they were commenced.

| 10 | | Section 99. Effective date. This Act takes effect upon | 11 | | becoming law.
