SYNOPSIS AS INTRODUCED:
 
405 ILCS 30/4.6a new

    Amends the Community Services Act. Provides that whenever a State mental health facility or a State developmental disabilities facility operated by the Department of Human Services is scheduled to have or has a reduction in the number of individuals receiving care in an amount equal to or greater than 10% of the facility's prior highest population during the preceding 12-month period, the Department shall file a report with the General Assembly specifying certain information, including the anticipated new venues for care by venue category, in the aggregate, for the individuals no longer receiving care in the facility and the estimated corresponding changes in appropriation level necessary for the facility reducing population. Contains provisions concerning reporting requirements and the transfer of funds. Effective July 1, 2011.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Community Services Act is amended by adding
5Section 4.6a as follows:
 
6    (405 ILCS 30/4.6a new)
7    Sec. 4.6a. Reduction in patient population in State mental
8health or developmental disabilities facility.
9    Whenever a State mental health facility or a State
10developmental disabilities facility operated by the Department
11of Human Services is scheduled to have or has a reduction in
12the number of individuals receiving care in an amount equal to
13or greater than 10% of the facility's prior highest population
14during the preceding 12-month period, the Department of Human
15Services shall file a report with the General Assembly
16specifying the:
17        (1) Total change in resident population for the
18    facility.
19        (2) Anticipated new venues for care by venue category,
20    in the aggregate, for the individuals no longer receiving
21    care in the facility.
22        (3) Estimated corresponding changes in appropriation
23    level necessary for the facility reducing population as

1    well as additional appropriation authority required for
2    other facilities or community care alternatives which are
3    expected to experience an increase in the number of
4    individuals served.
5    The report required under this Section shall be given to
6the General Assembly within 30 days of when a decision is made
7to decrease the population of a facility by 10% or more, or in
8cases where population changes are due to unplanned caseload
9changes, within 30 days of the actual change in population by
1010% or more.
11    Based on information contained in the reports required
12under this Section, the Department shall transfer funds from
13the facility realizing a reduction in the number of individuals
14served to the appropriate line item providing appropriation
15authority for the new venues of care, provided that the new
16venue of care is a Department of Human Services funded provider
17or facility.
 
18    Section 99. Effective date. This Act takes effect July 1,
192011.
