SYNOPSIS AS INTRODUCED:
 
70 ILCS 2605/4.22  from Ch. 42, par. 323.22
70 ILCS 2605/4.23  from Ch. 42, par. 323.23
70 ILCS 2605/4.25  from Ch. 42, par. 323.25

    Amends provisions of the Metropolitan Water Reclamation District Act concerning political contributions. Provides that during an officer's or employee's compensated time, other than vacation, personal, or compensatory time off, the officer or employee shall not solicit, give, or receive any assessment, subscription, or contribution from any member of the classified civil service for any political purpose. Provides that during an employee's compensated time, other than vacation, personal, or compensatory time off, an employee in the classified service shall not take any part in the management or affairs of any political party or in any political campaign, except under specified circumstances. Defines "compensated time" and "compensatory time off". Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Metropolitan Water Reclamation District Act
5is amended by changing Sections 4.22, 4.23, and 4.25 as
6follows:
 
7    (70 ILCS 2605/4.22)  (from Ch. 42, par. 323.22)
8    Sec. 4.22. Solicitation of political contributions by an
9officer or employee.
10    (a) During an officer's or employee's compensated time,
11other than vacation, personal, or compensatory time off, the No
12officer or employee shall not solicit, orally or by letter, or
13give or receive, or be in any manner concerned in soliciting,
14or giving, or receiving any assessment, subscription, or
15contribution from any member of the classified civil service
16for any party or political purpose whatever.
17    (b) For the purposes of this Section, "compensated time"
18means any time worked by or credited to an employee that counts
19toward any minimum work time requirement imposed as a condition
20of employment with the sanitary district, but does not include
21any designated holidays or any period when the employee is on a
22leave of absence.
23    For the purposes of this Section, "compensatory time off"

1means authorized time off earned by or awarded to an employee
2to compensate in whole or in part for time worked in excess of
3the minimum work time required of that employee as a condition
4of employment with the sanitary district.

7    Sec. 4.23. Soliciting political contributions from an
8officer or employee.
9    (a) No person shall solicit, orally or by letter, or be in
10any manner concerned in soliciting any assessment,
11contribution, or payment for any party or any political purpose
12whatever from any officer or employee in the classified civil
13service during the officer's or employee's compensated time
14other than vacation, personal, or compensatory time off.
15    (b) For the purposes of this Section, "compensated time"
16means any time worked by or credited to an employee that counts
17toward any minimum work time requirement imposed as a condition
18of employment with the sanitary district, but does not include
19any designated holidays or any period when the employee is on a
20leave of absence.
21    For the purposes of this Section, "compensatory time off"
22means authorized time off earned by or awarded to an employee
23to compensate in whole or in part for time worked in excess of
24the minimum work time required of that employee as a condition
25of employment with the sanitary district.

3    Sec. 4.25. Political contributions and campaigns.
4    (a) During an officer's or employee's compensated time,
5other than vacation, personal, or compensatory time off, an No
6officer or employee in the service of the sanitary district
7shall not, directly or indirectly, give or hand over to any
8officer or employee in the said classified civil service, or to
9any senator, or representative, or alderman, councilman, or
10trustee, any money or other valuable thing on account of or to
11be applied to the promotion of any party or political object
12whatever.
13    (b) During an employee's compensated time, other than
14vacation, personal, or compensatory time off, an No employee in
15the classified service shall not take any part in the
16management or affairs of any political party or in any
17political campaign, except to exercise his or her right as a
18citizen privately to express his or her opinion, and to cast
19his or her vote, provided, however, that an employee shall have
20the right to hold any public office, either by appointment or
21election, that is not incompatible with his or her duties as an
22employee of the District, and provided further that the such
23employee does not campaign or otherwise engage in political
24activity during his or her compensated time other than
25vacation, personal, or compensatory time off working hours.

1    (c) This Section shall not be deemed to authorize conduct
2prohibited by the Federal Hatch Act by employees subject to
3that said Act.
4    (d) For the purposes of this Section, "compensated time"
5means any time worked by or credited to an employee that counts
6toward any minimum work time requirement imposed as a condition
7of employment with the sanitary district, but does not include
8any designated holidays or any period when the employee is on a
9leave of absence.
10    For the purposes of this Section, "compensatory time off"
11means authorized time off earned by or awarded to an employee
12to compensate in whole or in part for time worked in excess of
13the minimum work time required of that employee as a condition
14of employment with the sanitary district.

16    Section 99. Effective date. This Act takes effect upon
17becoming law.
