Amends the Illinois Vehicle Code. Provides that if a special license plate is authorized by law to raise funds for a specific cause and the Secretary of State has not received the required number of applications for that special plate within 2 years of the effective date of the Public Act authorizing the special plate, the Secretary's authority to issue the plate is nullified. Provides that revenues from special license plates shall only benefit designated charitable entities, which must be in compliance with specified requirements. Requires a charitable entity to annually provide the Secretary with a letter of compliance issued by the Attorney General's office, requires the name of the charitable entity which is to receive the funds to be provided to the Secretary within specified time limits, and provides that in the case of a failure to comply with these requirements, the special plates shall be discontinued and any undisbursed funds collected from the sale of plates authorized for that organization shall be transferred to the General Revenue Fund. Provides that if fewer than 1,000 sets of any special plate issued by the Secretary are actively registered for 2 consecutive calendar years, the Secretary may discontinue the issuance of that special plate and that discontinued plates shall be recalled and that owners of vehicles which were registered with recalled plates shall not be charged a reclassification or sticker replacement plate fee upon the issuance of new plates. Makes various changes in provisions concerning moneys collected under provisions creating special plates. Repeals provisions creating Lewis and Clark Bicentennial special plates. Effective January 1, 2012.

The Illinois Vehicle Code is amended by changing | 5 | | Sections 3-600, 3-634, 3-635, 3-636, 3-643, 3-644, 3-646, | 6 | | 3-651, 3-652, 3-654, 3-655, 3-657, 3-658, 3-659, 3-660, 3-661, | 7 | | 3-662, 3-665, 3-670, 3-671, 3-672, 3-673, 3-674, 3-675, 3-678, | 8 | | 3-684, 3-685, 3-687, 3-689, and 3-690 and by changing and | 9 | | renumbering Sections 3-689 as added by Public Act 96-1377, | 10 | | 3-689 as added by Public Act 96-1449, and 3-690 as added by | 11 | | Public Act 96-1449 as follows:

| 13 | | Sec. 3-600. Requirements for issuance of special plates.
| 14 | | (a) The Secretary of State shall issue only special plates | 15 | | that have been authorized by the General Assembly. The | 16 | | Secretary of State shall not issue a series of special plates
| 17 | | unless applications, as prescribed by the Secretary, have been | 18 | | received for
10,000 plates of that series; except that the | 19 | | Secretary of State may
prescribe some other required number of | 20 | | applications if that number is
sufficient to pay for the total | 21 | | cost of designing, manufacturing and
issuing the special | 22 | | license plate. Where a special plate is authorized by law to | 23 | | raise funds for a specific civic group, charitable entity, or |

| 1 | | other identified organization, and where the Secretary of State | 2 | | has not received the required number of applications to issue | 3 | | that special plate within 2 years of the effective date of the | 4 | | Public Act authorizing the special plate, the Secretary of | 5 | | State's authority to issue the special plate is nullified.
| 6 | | (b) The Secretary of State, upon issuing a new series of | 7 | | special license
plates, shall notify all law enforcement | 8 | | officials of the design, color and
other special features of | 9 | | the special license plate series.
| 10 | | (c) This Section shall not apply to special license plate | 11 | | categories in
existence on the effective date of this | 12 | | amendatory Act of 1990, or to the
Secretary of State's | 13 | | discretion as established in Section 3-611.
| 14 | | (d) If a law authorizing a special license plate provides | 15 | | that the sponsoring organization is to designate a charitable | 16 | | entity as the recipient of the funds from the sale of that | 17 | | license plate, the designated charitable entity must be in | 18 | | compliance with the registration and reporting requirements of | 19 | | the Charitable Trust Act and the Solicitation for Charity Act. | 20 | | In addition, the charitable entity must annually provide the | 21 | | Secretary of State's office a letter of compliance issued by | 22 | | the Illinois Attorney General's office verifying the entity is | 23 | | in compliance with the Acts. | 24 | | In the case of a law in effect before the effective date of | 25 | | this amendatory Act of the 97th General Assembly, the name of | 26 | | the charitable entity which is to receive the funds shall be |

| 1 | | provided to the Secretary of State within one year after the | 2 | | effective date of this amendatory Act of the 97th General | 3 | | Assembly. In the case of a law that takes effect on or after | 4 | | the effective date of this amendatory Act of the 97th General | 5 | | Assembly, the name of the charitable entity which is to receive | 6 | | the funds shall be provided to the Secretary of State within | 7 | | one year after the law takes effect. If the organization fails | 8 | | to designate an appropriate charitable entity within the | 9 | | one-year period, or if the designated charitable entity fails | 10 | | to annually provide the Secretary of State a letter of | 11 | | compliance issued by the Illinois Attorney General's office, | 12 | | any funds collected from the sale of plates authorized for that | 13 | | organization and not previously disbursed shall be transferred | 14 | | to the General Revenue Fund, and the special plates shall be | 15 | | discontinued. | 16 | | (e) If fewer than 1,000 sets of any special license plate | 17 | | authorized by law and issued by the Secretary of State are | 18 | | actively registered for 2 consecutive calendar years, the | 19 | | Secretary of State may discontinue the issuance of that special | 20 | | license plate. | 21 | | (f) Where special license plates have been discontinued | 22 | | pursuant to subsection (d) or (e) of this Section, all | 23 | | previously issued plates of that type shall be recalled. | 4 | | Sec. 3-634. Illinois Fire Fighters' License Plate.
| 5 | | (a) The Secretary, upon receipt of an application made in | 6 | | the form
prescribed by the Secretary of State, may issue | 7 | | special registration plates
designated to be Illinois Fire | 8 | | Fighters' Memorial license plates. The special
plates issued | 9 | | under
this Section shall be affixed only to passenger vehicles | 10 | | of the first division,
motor vehicles of the second
division | 11 | | weighing not more than 8,000 pounds,
recreational vehicles as | 12 | | defined in Section 1-169 of this Code,
and subject to the
| 13 | | staggered registration system. Plates issued under this | 14 | | Section shall
expire according to the multi-year
procedure | 15 | | established by Section 3-414.1 of this Code.
| 16 | | (b) The design and color of the plates shall be wholly | 17 | | within the discretion
of the Secretary of State. The Secretary | 18 | | of State may, in his or her
discretion, allow the plates to be | 19 | | issued as vanity plates or personalized in
accordance with | 20 | | Section 3-405.1 of this Code. The plates are not required to
| 21 | | designate "Land of Lincoln", as prescribed in subsection (b) of | 22 | | Section 3-412
of this Code. The Secretary of State shall | 23 | | prescribe stickers or decals as
provided under Section 3-412.
| 24 | | (c) An applicant shall be charged a $27 fee for original | 25 | | issuance in
addition to the applicable registration fee. Of

| 1 | | this additional fee, $15 shall be deposited into the Secretary | 2 | | of State
Special License Plate Fund and $12 shall be
deposited | 3 | | into the Illinois Fire Fighters' Memorial Fund.
For each | 4 | | registration renewal period, a $17 fee, in addition to the
| 5 | | appropriate registration fee, shall be charged.
Of this fee, $2 | 6 | | shall be deposited into the Secretary of State Special License
| 7 | | Plate Fund and $15 shall be deposited into
the Illinois Fire | 8 | | Fighters' Memorial Fund.
| 9 | | (d) In addition to the purpose specified in Section | 10 | | 2-119(n), moneys in
the Illinois Fire Fighters' Memorial Fund | 11 | | shall, except as otherwise provided in subsection (e) and | 12 | | subject to appropriation by
the General Assembly and | 13 | | distribution approval by the Secretary, be used exclusively for | 14 | | the following purposes: | 15 | | (1) maintaining
the Illinois Fire Fighters' Memorial;
| 16 | | (2) holding an annual memorial
commemoration and Medal | 17 | | of Honor ceremony and related activities; and | 18 | | (3) providing scholarships, for graduate study, | 19 | | undergraduate study, or both, to children and spouses of | 20 | | fire fighters
killed in the line of duty. | 21 | | (e) No more than 10% of the annual proceeds of the Illinois | 22 | | Fire Fighters' Memorial Fund may, subject to appropriation by | 23 | | the General Assembly and distribution approval by the | 24 | | Secretary, be used for exhibits for and the maintenance of the | 25 | | Illinois Fire Fighter Museum.

| 2 | | Sec. 3-635. Master Mason plates.
| 3 | | (a) The Secretary, upon receipt of all applicable fees and | 4 | | applications
made in the form prescribed by the Secretary, may | 5 | | issue special registration
plates designated as Master Mason | 6 | | license plates.
| 7 | | The special plates issued under this Section shall be | 8 | | affixed only to
passenger vehicles of the first division or | 9 | | motor vehicles of the second
division weighing not more than | 10 | | 8,000 pounds.
| 11 | | Plates issued under this Section shall expire according to | 12 | | the multi-year
procedure established by Section 3-414.1 of this | 13 | | Code.
| 14 | | (b) The design and color of the special plates shall be | 15 | | wholly within the
discretion of the Secretary. Appropriate | 16 | | documentation, as determined by the
Secretary, shall accompany | 17 | | each application.
| 18 | | (c) An applicant for the special plate shall be charged a | 19 | | $25 fee for
original issuance in addition to the appropriate | 20 | | registration fee. Of this
fee, $10 shall be deposited into the | 21 | | Master Mason Fund and $15 shall be
deposited into the Secretary | 22 | | of State Special License Plate Fund, to be used by
the | 23 | | Secretary to help defray the administrative processing costs.

appropriate registration fee, shall be charged. |

treasury. All money in the Master Mason Fund shall be | 6 | | paid, subject to
appropriation
by the General Assembly
and | 7 | | distribution approval by the Secretary, as grants to The | 8 | | Illinois Masonic
Foundation for the Prevention of Drug and | 9 | | Alcohol Abuse Among Children, Inc.,
a not-for-profit | 10 | | corporation, for the purpose of providing Model Student
| 11 | | Assistance Programs in public and private schools in Illinois.

| 14 | | Sec. 3-636. Knights of Columbus plates.

for charitable | 22 | | purposes sponsored by the Knights of Columbus.

issued under this Section shall expire according | 8 | | to the multi-year procedure

the Secretary, except that the following phrases | 12 | | shall be on the plates: (i)
"Mammograms Save Lives" and (ii) | 13 | | "The Susan G. Komen Foundation". The
Secretary may allow the | 14 | | plates to be issued as vanity plates or personalized
under | 15 | | Section 3-405.1 of the Code. The Secretary shall prescribe | 16 | | stickers or
decals as provided under Section 3-412 of this | 17 | | Code.

original issuance in addition to the appropriate | 20 | | registration fee. Of this

| 18 | | maintaining a memorial statue, holding an annual memorial | 19 | | commemoration, and
giving scholarships to children of police | 20 | | officers killed in the line of
duty.

issued under this Section shall | 6 | | expire according to the multi-year procedure

the Secretary, except that the phrase "Be An | 10 | | Organ Donor" shall be on the
plates, and the design of the | 11 | | plates shall incorporate a reference to the
Chicago Bears
| 12 | | organization and Walter Payton. The
Secretary may allow the | 13 | | plates to be issued as vanity plates or personalized
under | 14 | | Section 3-405.1 of the Code. The Secretary shall prescribe | 15 | | stickers or
decals as provided under Section 3-412 of this | 16 | | Code.
| 17 | | (c) An applicant for the special plate shall be charged a | 18 | | $25 fee for
original issuance in addition to the appropriate | 19 | | registration fee. Of this
additional fee, $10 shall be | 20 | | deposited into the Organ Donor Awareness Fund and
$15 shall be
| 21 | | deposited into the Secretary of State Special License Plate | 22 | | Fund, to be used by

treasury. Subject to
appropriation by the | 5 | | General Assembly
and approval by the Secretary, 50% of the | 6 | | moneys in the Organ Donor Awareness
Fund shall be paid as | 7 | | grants to the Gift of Hope Organ and Tissue Donor Network | 8 | | Regional Organ Bank of Illinois , and the
remaining 50% of
the | 9 | | moneys in that fund shall be paid as grants to Mid-America | 10 | | Transplant
Services , or pursuant to any alternative | 11 | | distribution ratio mutually agreed upon by these 2 | 12 | | organizations .

Marine Corps license plates. | 16 | | (a) In addition to any other special license plate, the | 17 | | Secretary, upon
receipt of all applicable fees and applications | 18 | | made in the form prescribed by
the Secretary of State, may | 19 | | issue special registration plates designated as
U.S. Marine | 20 | | Corps license plates to residents of Illinois who meet | 21 | | eligibility
requirements prescribed by the Secretary of State. | 22 | | The special plate issued
under this Section shall be affixed | 23 | | only to passenger vehicles of the first
division, motorcycles, | 24 | | motor vehicles of the second
division weighing not more than | 25 | | 8,000 pounds, and recreational vehicles as
defined by Section |

| 1 | | 1-169 of this Code. Plates issued under this Section shall
| 2 | | expire according to the staggered multi-year procedure | 3 | | established by Section
3-414.1 of this Code.
| 4 | | (b) The design, color, and format of the plates shall be | 5 | | wholly
within the discretion of the Secretary of State, except | 6 | | that the U.S. Marine
Corps emblem shall appear on the plates. | 7 | | The Secretary may, in his or
her discretion, allow the plates | 8 | | to be issued as vanity or personalized plates
in accordance | 9 | | with Section 3-405.1 of this Code. The plates are not required
| 10 | | to designate "Land Of Lincoln", as prescribed in subsection (b) | 11 | | of Section
3-412 of this Code. The Secretary shall prescribe | 12 | | the eligibility requirements
and, in his or her discretion, | 13 | | shall approve and prescribe stickers or decals
as provided | 14 | | under Section 3-412.
| 15 | | (c) An applicant shall be charged a $20 fee for original | 16 | | issuance in
addition to the applicable registration fee. Of | 17 | | this additional fee, $15
shall be deposited into the Secretary | 18 | | of State Special License Plate Fund
and $5 shall be deposited | 19 | | into the Marine Corps Scholarship Fund. For each
registration | 20 | | renewal period, a $20 fee, in addition to the appropriate
| 21 | | registration fee, shall be charged. Of this additional fee, $2 | 22 | | shall be
deposited into the Secretary of State Special License | 23 | | Plate Fund and $18
shall be deposited into the Marine Corps | 24 | | Scholarship Fund.
| 25 | | (d) The Marine Corps Scholarship Fund is created as a | 26 | | special fund in
the State treasury. All moneys in the Marine |

| 1 | | Corps Scholarship Fund shall,
subject to appropriation by the | 2 | | General Assembly and distribution approval by the Secretary,
be | 3 | | used by the Marine Corps Scholarship Foundation, Inc., a | 4 | | recognized
charitable organization that meets the requirements | 5 | | of Title 26,
Section 501(c)(3) of the United States Code, to | 6 | | provide grants for
scholarships for higher education. The | 7 | | scholarship recipients must be the
children of current or | 8 | | former members of the United States Marine Corps
