AMENDMENT TO HOUSE BILL 3034

2    AMENDMENT NO. ______. Amend House Bill 3034 on page 1, by
3inserting the following after line 3:
 
4    "Section 5. The Illinois Roofing Industry Licensing Act is
5amended by changing Section 5 and by adding Section 5.1 as
6follows:
 
7    (225 ILCS 335/5)  (from Ch. 111, par. 7505)
8    (Section scheduled to be repealed on January 1, 2016)
9    Sec. 5. Display of license number; advertising.
10    (a) Each State licensed roofing contractor shall affix the
11roofing contractor license number and the licensee's name, as
12it appears on the license, to all of his or her contracts and
13bids. In addition, the official issuing building permits shall
14affix the roofing contractor license number to each application
15for a building permit and on each building permit issued and
16recorded.

1    (a-5) A person who knowingly, in the course of applying for
2a building permit with a unit of local government, provides the
3roofing license number of a roofing contractor whom he or she
4does not intend to have perform the work on the roofing portion
5of the project commits identity theft under paragraph (8) of
6subsection (a) of Section 16G-15 of the Criminal Code of 1961.
7    (b) (Blank). In addition, every roofing contractor shall
8affix the roofing contractor license number and the licensee's
9name, as it appears on the license, on all commercial vehicles
10used as part of his or her business as a roofing contractor.
11    (c) Every holder of a license shall display it in a
12conspicuous place in his or her principal office, place of
13business, or place of employment.
14    (d) No person licensed under this Act may advertise
15services regulated by this Act unless that person includes in
16the advertisement the roofing contractor license number and the
17licensee's name, as it appears on the license. Nothing
18contained in this subsection requires the publisher of
19advertising for roofing contractor services to investigate or
20verify the accuracy of the license number provided by the
21licensee.
22    (e) A person who advertises services regulated by this Act
23who knowingly (i) fails to display the license number and the
24licensee's name, as it appears on the license, in any manner
25required by this Section, (ii) fails to provide a publisher
26with the correct license number as required by subsection (d),

1or (iii) provides a publisher with a false license number or a
2license number of another person, or a person who knowingly
3allows his or her license number to be displayed or used by
4another person to circumvent any provisions of this Section, is
5guilty of a Class A misdemeanor with a fine of $1,000, and, in
6addition, is subject to the administrative enforcement
7provisions of this Act. Each day that an advertisement runs or
8each day that a person knowingly allows his or her license to
9be displayed or used in violation of this Section constitutes a
10separate offense.

13    Sec. 5.1. Commercial vehicles. Any entity offering
14services regulated by the Roofing Industry Licensing Act shall
15affix the roofing contractor license number and the licensee's
16name, as it appears on the license, on all commercial vehicles
17used in offering such services. An entity in violation of this
18Section shall be subject to a $250 civil penalty. This Section
19may be enforced by local code enforcement officials employed by
20units of local government as it relates to roofing work being
21performed within the boundaries of their jurisdiction. For
22purposes of this Section, "code enforcement official" means an
23officer or other designated authority charged with the
24administration, interpretation, and enforcement of codes on
25behalf of a municipality of county. If the alleged violation

1has been corrected prior to or on the date of the hearing
2scheduled to adjudicate the alleged violation, it shall be
3dismissed."; and
 
4on page 1, line 4 by replacing "5" with "10"; and
 
5on page 5, line 13 by inserting "interior or" after "other";
6and
 
7on page 5, line 15 by inserting "(Public Act 96-1332). A Public
8Adjuster means any person who acts on behalf of the insured in
9preparing and adjusting a claim for loss or damage covered by
10an insurance contract" after "Law"; and
 
11on page 10, line 19 by inserting "the earlier of" after "prior
12to";and
 
13on page 10, line 21 by inserting "or the thirtieth business day
14after receipt of a properly executed proof of loss by the
15insurer from the insured" after "insurer"; and
 
16on page 11, line 7 by replacing "Responsibility" with
17"Regulation".
