1    AN ACT concerning liquor.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Liquor Control Act of 1934 is amended by
5changing Section 6-31 as follows:
 
6    (235 ILCS 5/6-31)
7    Sec. 6-31. Product sampling.
8    (a) Retailer, distributor, importing distributor,
9manufacturer and nonresident dealer licensees may conduct
10product sampling for consumption at a licensed retail location.
11Up to 3 separate samples, consisting of no more than (i) 1/4
12ounce of distilled spirits, (ii) 1.5 ounces one ounce of wine,
13or (iii) 4 2 ounces of beer may be served to a consumer in one
14day. The retailer, distributor, importing distributor,
15manufacturer, or non-resident dealer must verify that the
16consumer being served the sample is at least 21 years of age.
17The licensee or an agent of the licensee conducting the product
18sampling must document the total number of consumers being
19served the sample and the number of samples served to each
20consumer to ensure that no more than 3 separate samples are
21served to a consumer in one day.
22    (b) Notwithstanding the provisions of subsection (a), an
23on-premises retail licensee may offer for sale and serve more

1than one drink per person for sampling purposes without
2violating paragraph (1) of subsection (b) of Section 6-28 or
3paragraph (6) of subsection (c) of Section 6-28 of this Act,
4provided the total quantity of the sampling package, regardless
5of the number of containers in which the alcoholic liquor is
6being served, does not exceed 1.5 ounces 1 ounce of distilled
7spirits, 6 4 ounces of wine, or 16 ounces of beer. In any
8event, all provisions of Section 6-28 shall apply to an
9on-premises retail licensee that conducts product sampling.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
