Amends the School Code. With respect to the issuance of substitute teacher's certificates, provides that a person who holds a bachelor of arts degree from an institution of higher learning accredited by the North Central Association or other comparable regional accrediting association or has been graduated from a recognized institution of higher learning with a bachelor's degree must also complete a 15-hour substitute authorization program approved by the State Board of Education. Sets forth required components of the program.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The School Code is amended by changing Section | 5 | | 21-9 as follows:
| 6 | | (105 ILCS 5/21-9) (from Ch. 122, par. 21-9)
| 7 | | Sec. 21-9. Substitute certificates and substitute | 8 | | teaching.
| 9 | | (a) A
substitute teacher's certificate
may
be issued for | 10 | | teaching in all grades of the
common schools. Such certificate
| 11 | | may be issued upon
request of the regional superintendent of
| 12 | | schools of any region in which the teacher is to
teach. A | 13 | | substitute teacher's certificate is valid for teaching in the
| 14 | | public schools of
any county. Such certificate may be issued to | 15 | | persons who either (a) hold
a certificate
valid for teaching in | 16 | | the common schools as shown on the face of the
certificate,
(b) | 17 | | have completed a 15-hour substitute authorization program | 18 | | approved by the State Board of Education and either hold a | 19 | | bachelor of arts degree from an institution of higher learning
| 20 | | accredited by the North Central Association or other comparable | 21 | | regional
accrediting association or have been graduated from a | 22 | | recognized institution
of higher learning with a bachelor's | 23 | | degree, or (c) have had 2 years of
teaching experience and meet |

rules and regulations as may be adopted by the State
| 2 | | Board of Education in consultation with the State Teacher | 3 | | Certification
Board. | 4 | | An approved substitute authorization program shall consist | 5 | | of all of the following components: | 6 | | (1) Classroom management. This component includes an | 7 | | understanding of individual and group motivation and | 8 | | behavior to create a learning environment that encourages | 9 | | positive social interaction, active engagement in | 10 | | learning, and self-motivation. | 11 | | (2) Strategies for learning. This component includes | 12 | | understanding and using a variety of learning strategies to | 13 | | encourage students' development of critical thinking, | 14 | | problem solving, and performance skills. | 15 | | (3) Diversity. This component includes understanding | 16 | | how students differ in their approaches to learning and | 17 | | creating learning opportunities that are equitable and are | 18 | | adaptable to diverse learners. | 19 | | (4) Ethics. This component includes fostering | 20 | | relationships with parents, school colleagues, and | 21 | | organizations in the larger community to support students' | 22 | | learning and development and to be aware of the State Board | 23 | | of Education's rules of professional practice and | 24 | | competent performance. | 25 | | The cost of attending a substitute authorization program must | 26 | | be paid by the person attending the program. | 1 | | Education may adopt rules concerning substitute authorization | 2 | | programs. | 3 | | A substitute teacher's Such certificate shall expire on | 4 | | June 30 in the fourth year from date
of issue. Persons who have | 5 | | completed a substitute authorization program are not required | 6 | | to retake the program in order to renew their certificate.
| 7 | | Substitute teacher's certificates are not subject to | 8 | | endorsement as
described in Section 21-1b of this Code.
| 9 | | (b) A teacher holding a substitute teacher's certificate | 10 | | may teach only in
the
place of a certified teacher who is under | 11 | | contract with the employing board and
may teach only when no | 12 | | appropriate fully certified teacher is available to
teach in a
| 13 | | substitute capacity. A teacher holding an early childhood | 14 | | certificate, an
elementary certificate, a high school | 15 | | certificate, or a special
certificate may also substitute teach | 16 | | in grades K-12 but only in the place of a
certified teacher who | 17 | | is under contract with the employing board. A
substitute | 18 | | teacher may teach only for a period not to exceed
90 paid | 19 | | school days or 450 paid school hours in any one school district | 20 | | in any
one
school term.
However,
a teacher holding an early | 21 | | childhood, elementary, high school, or special
certificate may | 22 | | substitute teach for a period not to exceed 120 paid
school | 23 | | days or 600 paid school hours in any one school district in any
| 24 | | one school term.
Where such teaching is partly on a daily and | 25 | | partly on an hourly
basis,
a school day shall be considered as | 26 | | 5 hours.

| 1 | | upon teachers holding substitute certificates shall
not apply | 2 | | in any school district operating under Article 34.
| 3 | | (c) In order to substitute teach in the public schools, a | 4 | | person holding a valid substitute teacher's certificate or a | 5 | | person holding a valid early childhood certificate, a valid | 6 | | elementary certificate, a valid high school certificate, or a | 7 | | valid special certificate shall register as a substitute | 8 | | teacher with the regional superintendent of schools in each | 9 | | educational service region where the person will be employed. A | 10 | | person who registers as a substitute teacher with the regional | 11 | | superintendent of schools is responsible for (1) the payment of | 12 | | fees to register the certificate for its period of validity, | 13 | | (2) authorization of a criminal history records check and | 14 | | checks of the Statewide Sex Offender Database and Statewide | 15 | | Child Murderer and Violent Offender Against Youth Database, as | 16 | | provided in Section 10-21.9 of this Code, (3) payment of the | 17 | | cost of the criminal history records check and checks of the | 18 | | Statewide Sex Offender Database and Statewide Child Murderer | 19 | | and Violent Offender Against Youth Database, and (4) providing | 20 | | evidence of physical fitness and freedom from communicable | 21 | | disease, including tuberculosis, which may consist of a | 22 | | physical examination and a tuberculin skin test as required by | 23 | | Section 24-5 of this Code. | 24 | | The regional superintendent of schools shall maintain a | 25 | | file for each registered substitute teacher in the educational | 26 | | service region that includes a copy of the person's |

| 1 | | certificate, the results from the criminal history records | 2 | | check and checks of the Statewide Sex Offender Database and | 3 | | Statewide Child Murderer and Violent Offender Against Youth | 4 | | Database, a copy of the physical examination, and a copy of the | 5 | | tuberculin skin test. The regional superintendent of schools | 6 | | shall issue a signed and sealed certificate of authorization to | 7 | | the substitute teacher that verifies that the substitute | 8 | | teacher has completed the registration process and criminal | 9 | | history records check and checks of the Statewide Sex Offender | 10 | | Database and Statewide Child Murderer and Violent Offender | 11 | | Against Youth Database and has a physical examination and | 12 | | negative tuberculin test on file with the regional | 13 | | superintendent of schools and is thereby approved to substitute | 14 | | teach in the public schools of the educational service region. | 15 | | This certificate must be presented to all prospective employing | 16 | | school districts in the educational service region, who shall | 17 | | photocopy the certificate and keep a copy of the certificate | 18 | | with employment records for the substitute teacher. | 19 | | Persons wishing to substitute teach in more than one | 20 | | educational service region shall register as a substitute | 21 | | teacher with the appropriate regional superintendent of | 22 | | schools. The registration process shall include all items | 23 | | listed in the first paragraph of this subsection (b), with the | 24 | | exception of the authorization of a criminal history records | 25 | | check and checks of the Statewide Sex Offender Database and | 26 | | Statewide Child Murderer and Violent Offender Against Youth |

| 1 | | Database and the accompanying payment of associated fees. If | 2 | | the substitute teacher has been issued a signed and sealed | 3 | | certificate of authorization from another regional | 4 | | superintendent of schools, the registering entity may | 5 | | photocopy the certificate for its files and verify the | 6 | | substitute teacher's registration status. | 7 | | (Source: P.A. 96-1489, eff. 1-1-11.)
