AMENDMENT TO HOUSE BILL 3816

2    AMENDMENT NO. ______. Amend House Bill 3816, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Gubernatorial Boards and Commissions Act is
6amended by adding Section 25 as follows:
 
7    (15 ILCS 50/25 new)
8    Sec. 25. Dissolution of inactive boards and commissions.
9    (a) Within 30 days after the effective date of this
10amendatory Act of the 97th General Assembly, each statutorily
11created board or commission not subject to subsection (g) shall
12report to the Secretary of State on that board's or
13commission's last meeting prior to the effective date of this
14amendatory Act of the 97th General Assembly, and the report
15shall include the date, time, and location of the meeting.
16    (b) Within 60 days after the effective date of this

1amendatory Act of the 97th General Assembly, the Secretary of
2State shall submit a report to the Governor, the Secretary of
3the Senate, and the Clerk of the House of Representatives,
4listing all statutorily created boards and commissions that
5have not met in the 2 years immediately preceding the effective
6date of this amendatory Act of the 97th General Assembly. If a
7board or commission not subject to subsection (g) does not
8report to the Secretary of State pursuant to this subsection,
9then it shall be deemed to be inactive and subject to the
10provisions of subsections (d) and (e).
11    (c) Within 14 days after the 30-day period set forth in
12subsection (a), the Secretary of State shall provide, to each
13board or commission that has not met in the 2 years immediately
14preceding the effective date of this amendatory Act of the 97th
15General Assembly or that does not report to the Secretary of
16State in accordance with subsection (a), written notice of the
17board's or commission's right to request that the Governor
18prevent the dissolution of the board or commission by filing a
19written statement in accordance with subsection (e).
20    (d) Unless the Governor acts pursuant to subsection (e), if
21a board or commission has not met at least once during the 2
22years prior to the effective date of this amendatory Act of the
2397th General Assembly and is reported as inactive pursuant to
24subsection (a), then the board or commission is dissolved at
25the end of the 60-day period set forth in subsection (e).
26    (e) Within 75 days after the Governor's receipt of the

1report submitted by the Secretary of State under subsection
2(b), the Governor may prevent the dissolution of any inactive
3board or commission by filing a written statement with the
4Secretary of State and the Senate that authorizes the continued
5existence of the board or commission and provides a rationale
6for why the board or commission needs to exist.
7    (f) Within 14 days after the 60-day period set forth in
8subsection (e), the Governor shall publish a list of all boards
9and commissions dissolved under subsection (d). The
10Legislative Reference Bureau shall prepare for introduction no
11later than in the annual session of the General Assembly next
12occurring after the list is published by the Governor a
13revisory bill effecting such changes in the statutes as may be
14necessary to conform the statutes to the changes in law made by
15the dissolution of the boards and commissions included in the
16list published by the Governor. The failure of the General
17Assembly to enact such a bill does not affect the validity of
18the dissolution of any board or commission under this Section.
19    (g) Any board or commission created after July 1, 2010 is
20exempt from this Section.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
