AMENDMENT TO HOUSE BILL 3826

2    AMENDMENT NO. ______. Amend House Bill 3826 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
514-6.02 as follows:
 
6    (105 ILCS 5/14-6.02)  (from Ch. 122, par. 14-6.02)
7    Sec. 14-6.02. Service animals. Service animals such as
8guide dogs, signal dogs or any other animal individually
9trained to perform tasks for the benefit of a student with a
10disability shall be permitted to accompany that student at all
11school functions, whether in or outside the classroom. For the
12purposes of this Section, "service animal" has the same meaning
13as in Section 1 of the Service Animal Access Act.

7Service Animal Guide Dog Access Act.

10    Sec. 1. When a blind, hearing impaired or physically
11handicapped person with a physical, mental, or intellectual
12disability requiring the use of a service animal or a person
13who is subject to epilepsy or other seizure disorders is
14accompanied by a service animal a dog which serves as a guide,
15leader, seizure-alert, or seizure-response dog for such person
16or when a trainer of a service animal guide, leader,
17seizure-alert, or seizure-response dog is accompanied by a
18service animal guide, leader, seizure-alert, or
19seizure-response dog or a dog that is being trained to be a
20guide, leader, seizure-alert, or seizure-response dog, neither
21the person nor the service animal dog shall be denied the right
22of entry and use of facilities of any public place of
23accommodation as defined in Section 5-101 of the "Illinois

1Human Rights Act", if such dog is wearing a harness and such
2person presents credentials for inspection issued by a school
3for training guide, leader, seizure-alert, or seizure-response
4dogs.
5    For the purposes of this Section, "service animal" means a
6dog or miniature horse trained or being trained as a hearing
7animal, a guide animal, an assistance animal, a seizure alert
8animal, a mobility animal, a psychiatric service animal, an
9autism service animal, or an animal trained for any other
10physical, mental, or intellectual disability. "Service animal"
11includes a miniature horse that a public place of accommodation
12shall make reasonable accommodation so long as the public place
13of accommodation takes into consideration: (1) the type, size
14and weight of the miniature horse and whether the facility can
15accommodate its features; (2) whether the handler has
16sufficient control of the miniature horse; (3) whether the
17miniature horse is housebroken; and (4) whether the miniature
18horse's presence in the facility compromises legitimate safety
19requirements necessary for operation.
20    Any violation of this Act is a Class C misdemeanor.

22    Section 99. Effective date. This Act takes effect upon
