SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Prepaid Cellular Telephone Sales Act. Provides that any person selling prepaid cellular telephones to the public must request to see an identification card in order to record the personal information of each person purchasing a prepaid cellular telephone. Provides that the records obtained from each sale shall be maintained for at least one year by the retailer and shall be shared with each appropriate wireless telephone carrier on which the phone may be used. Prohibits any person not complying with provisions requiring record keeping from selling any prepaid cellular telephone. Provides that any person violating any of the provisions of this Act is guilty of a petty offense and on conviction thereof shall for the first offense be punished by a fine of not less than $100 nor more than $150 and for each subsequent offense by a fine of not less than $200 nor more than $250.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Prepaid Cellular Telephone Sales Act.
 
6    Section 5. Record requirements. Any person selling prepaid
7cellular telephones to the public must request to see an
8identification card in order to record the personal information
9of each person purchasing a prepaid cellular telephone. The
10records obtained from each sale shall be maintained for at
11least one year by the retailer and shall be shared with each
12appropriate wireless telephone carrier on which the phone may
13be used.
 
14    Section 10. Sale prohibition. Any person not complying with
15the provisions of Section 5 shall be prohibited from selling
16any prepaid cellular telephones.
 
17    Section 15. Penalty. Any person violating any of the
18provisions of this Act is guilty of a petty offense and on
19conviction thereof shall for the first offense be punished by a
20fine of not less than $100 nor more than $150 and for each
21subsequent offense by a fine of not less than $200 nor more
