Amends the State Finance Act. Creates the Veterans' Prosthesis Fund as a special fund in the State treasury. Provides that moneys in the Fund shall be used by the Department of Veterans' Affairs for the purpose of making grants to Illinois veterans to update and replace the veteran's existing prosthesis. Amends the Illinois Income Tax Act to create a tax checkoff for the Veterans' Prosthesis Fund. Effective immediately.

AN ACT concerning revenue.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Sections 5.809 and 6z-93 as follows:

Sec. 5.809. The Veterans' Prosthesis Fund.

Sec. 6z-93. The Veterans' Prosthesis Fund; creation. The Veterans' Prosthesis Fund is created as a special fund in the State treasury. Moneys in the Fund shall be used by the Department of Veterans' Affairs for the purpose of making grants to Illinois veterans to update and replace the veteran's existing prosthesis. The Department shall adopt rules concerning eligibility for the grants. The Fund may receive moneys from the veterans' prosthesis income tax checkoff created in Section 507AAA of the Illinois Income Tax Act, as well as public and private donations. All federal funds made available to the State for the purpose of aiding veterans in updating or replacing prostheses shall be deposited into the Veterans' Prosthesis Fund.

Section 10. The Illinois Income Tax Act is amended by adding Section 507AAA as follows:

Sec. 507AAA. Veterans' prosthesis checkoff. For taxable years ending on or after December 31, 2012, the Department shall print, on its standard individual income tax form, a provision indicating that, if the taxpayer wishes to contribute to the Veterans' Prosthesis Fund, as authorized by this amendatory Act of the 97th General Assembly, then he or she may do so by stating the amount of the contribution (not less than $1) on the return and indicating that the contribution will reduce the taxpayer's refund or increase the amount of payment to accompany the return. The taxpayer's failure to remit any amount of the increased payment reduces the contribution accordingly. This Section does not apply to any amended return.

Section 99. Effective date. This Act takes effect upon becoming law.
