| 1 | | AN ACT concerning safety.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The State Finance Act is amended by adding | 5 | | Section 5.786 as follows: | 6 | | (30 ILCS 105/5.786 new) | 7 | | Sec. 5.786. The Premise Alert Program Fund. | 8 | | Section 10. The Illinois Premise Alert Program (PAP) Act is | 9 | | amended by changing Sections 10 and 15 as follows: | 10 | | (430 ILCS 132/10)
| 11 | | Sec. 10. Definitions. As used in this Act: | 12 | | "Disability" means an individual's physical or mental | 13 | | impairment that
substantially limits one or more of the major | 14 | | life activities; a record of such impairment; or when the | 15 | | individual is regarded as having such an impairment. | 16 | | "Disability" includes, but is not limited to, a medical | 17 | | impairment that requires the use of pressurized oxygen. | 18 | | "Special needs individuals" means those individuals who | 19 | | have or are at increased risk for a chronic physical, | 20 | | developmental, behavioral, or emotional condition and who also | 21 | | require health and related services of a type or amount beyond |

| 1 | | that required by individuals generally. "Special needs | 2 | | individual" includes, but is not limited to, an individual with | 3 | | a medical impairment that requires the use of pressurized | 4 | | oxygen. | 5 | | "Public safety agency" means a functional division of a | 6 | | public agency that provides firefighting, police, medical, or | 7 | | other emergency services. | 8 | | "Computer aided dispatch" or "CAD" means a database | 9 | | maintained by the public safety agency or public safety | 10 | | answering point used in conjunction with 9-1-1 caller data. | 11 | | "Premise Alert Program" or "PAP" means a computer aided | 12 | | dispatch database of individuals with special needs maintained | 13 | | by public safety agencies.

| 16 | | Sec. 15. Reporting of Special Needs Individuals.
| 17 | | (a) Public safety agencies and suppliers of oxygen | 18 | | containers used for medical purposes shall make reasonable | 19 | | efforts to publicize the Premise Alert Program (PAP) database. | 20 | | Means of publicizing the database include, but are not limited | 21 | | to, pamphlets and websites. | 22 | | (b) Families, caregivers, or the individuals with | 23 | | disabilities or special needs may contact their local law | 24 | | enforcement agency or fire department or fire protection | 25 | | district. |

| 1 | | (c) Public safety workers are to be cognizant cognitive of | 2 | | special needs individuals they may come across when they | 3 | | respond to calls. If workers are able to identify individuals | 4 | | who have special needs, they shall try to ascertain as | 5 | | specifically as possible what that special need might be. The | 6 | | public safety worker should attempt to verify the special need | 7 | | as provided in item (2) of subsection (d). | 8 | | (d) The disabled individual's name, date of birth, phone | 9 | | number, and
residential address or place of employment , and a | 10 | | description of whether oxygen canisters are kept at that | 11 | | location for medical purposes should also be obtained
for | 12 | | possible entry into the PAP database. | 13 | | (1) Whenever possible, it is preferable that written | 14 | | permission is
obtained from a parent, guardian, family | 15 | | member, or caregiver
of the individual themselves prior to | 16 | | being entered into the
PAP database. | 17 | | (2) No individual may be entered into a PAP
database | 18 | | unless the special need has been verified.
Acceptable means | 19 | | of verifying a special need for purposes
of this program | 20 | | shall include statements by: | 21 | | (A) the individual, | 22 | | (B) family members, | 23 | | (C) friends, | 24 | | (D) caregivers, or | 25 | | (E) medical personnel familiar with the | 26 | | individual. |

| 1 | | (e) For public safety agencies that share the same CAD | 2 | | database, information collected by one agency serviced by the | 3 | | CAD database is to be disseminated to all agencies utilizing | 4 | | that database. | 5 | | (f) Information received at an incorrect public safety | 6 | | agency shall be accepted and forwarded to the correct agency as | 7 | | soon as possible.
| 8 | | (g) All information entered into the PAP database must be | 9 | | updated every 2 years or when such information changes.

| 11 | | Section 99. Effective date. This Act takes effect upon | 12 | | becoming law.
