SYNOPSIS AS INTRODUCED:

770 ILCS 60/6

from Ch. 82, par. 6

Amends the Mechanics Lien Act. Provides that, to obtain a lien under the Act, the work shall be done or the material furnished: within 3 years from the commencement of the work or the commencement of furnishing the material in the case of work done or material furnished as to owner-occupied residential property; and within 5 years from the commencement of the work or the commencement of furnishing the material in the case of work done or material furnished as to any other type of property. Effective immediately.

A BILL FOR

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Mechanics Lien Act is amended by changing Section 6 as follows:

Sec. 6. In no event shall it be necessary to fix or stipulate in any contract a time for the completion or a time for payment in order to obtain a lien under this act, provided, that the work is done or material furnished: within three years from the commencement of said work or the commencement of furnishing said material in the case of work done or material furnished as to owner-occupied residential property; and within 5 years from the commencement of said work or the commencement of furnishing said material in the case of work done or material furnished as to any other type of property.

Section 99. Effective date. This Act takes effect upon becoming law.
