AN ACT concerning criminal law, which may be referred to as
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
The Criminal Code of 1961 is amended by adding
Section 12-21.6-1 as follows:
(720 ILCS 5/12-21.6-1 new)
Failure to report disappearance of a
child; failure to report death of a child.
(a) A parent, legal guardian, or other person having
physical custody or control of a child, who is 13 years of age
or younger, commits failure to report the disappearance of a
child when he or she fails to notify the appropriate law
enforcement agency in a timely manner, no later than 24 hours,
of the child's disappearance; and
(1) knows that the child is missing; or
(2) reasonably should know that the child is missing.
Failure to report the disappearance of a
child is a Class 4 felony.
(b) A parent, legal guardian, or other person having
physical custody or control of a child, 17 years of age or
younger, commits failure to report the death of a child when he
or she discovers the death of a child and knows or reasonably
