SYNOPSIS AS INTRODUCED:

20 ILCS 415/17a-1 new

    Amends the Personnel Code. Authorizes the appointment, without competitive examination, interview, or other pre-employment testing, of a person who has served as an employee in a trainee position with an agency for a period of at least one year and who has a severe disabling condition that impairs his or her ability to successfully complete examinations, interviews, or other pre-employment testing, provided that a counselor of the Division of Rehabilitation Services in the Department of Human Services has certified to the agency that the person is capable of performing the primary functions of the position. Specifies that appointments of such persons shall be without regard to eligible lists and without regard to the provisions of the Code requiring the appointment of the person standing among the 3 highest on the appropriate eligible list to fill a vacancy or from the highest category ranking group if the list is by rankings instead of numerical rankings. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Personnel Code is amended by changing
5Sections 8b.5 and adding Section 17a-1 as follows:
 
6    (20 ILCS 415/8b.5)  (from Ch. 127, par. 63b108b.5)
7    Sec. 8b.5. Appointments. For the appointment of the person
8standing among the 3 highest on the appropriate eligible list
9to fill a vacancy, or from the highest ranking group if the
10list is by rankings instead of numerical ratings, except as
11otherwise provided in Sections 4b, and 17a, and 17a-1 of this
12Act.
13    The Director may approve the appointment of a person from
14the next lower ranking group when the highest ranking group
15contains less than 3 eligibles.

2pre-employment testing may, without competitive examination,
3interview, or other pre-employment testing, be appointed by the
4agency to an open position within the agency, provided that a
5counselor of the Division of Rehabilitation Services in the
6Department of Human Services has certified to the agency that
7the person is capable of performing the primary functions of
8the position. Such a person will attain certified status upon
9satisfactorily completing his or her probationary period.
10Appointments of such persons shall be without regard to
11eligible lists and without regard to the provisions of the Code
12requiring the appointment of the person standing among the 3
13highest on the appropriate eligible list to fill a vacancy or
14from the highest category ranking group if the list is by
15rankings instead of numerical rankings.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.
