| 2 | | AMENDMENT NO. ______. Amend Senate Bill 3336 by replacing | 3 | | everything after the enacting clause with the following:

The Illinois Vehicle Code is amended by | 5 | | changing the heading of Article XV of Chapter 11 and Sections | 6 | | 11-1502, 11-1504, 11-1505, 11-1505.1, 11-1507, 11-1510, | 7 | | 11-1511, 11-1514, and 11-1517 and by adding Section 1-131.5 as | 8 | | follows: | 9 | | (625 ILCS 5/1-131.5 new) | 10 | | Sec. 1-131.5. In-line speed skates. Roller skates (1) that | 11 | | are equipped with wheels arranged in a straight line and (2) on | 12 | | which the top of the boot affixed to the frame holding the | 13 | | wheels does not extend more than one inch above the wearer's | 14 | | ankle joint.

Traffic laws apply to persons riding
bicycles | 4 | | or using in-line speed skates . Every person riding a bicycle or | 5 | | using in-line speed skates upon a highway shall be
granted all | 6 | | of the rights and shall be subject to all of
the duties | 7 | | applicable to the driver of a vehicle by this
Code, except as | 8 | | to special regulations in this Article XV
and except as to | 9 | | those provisions of this Code which by their
nature can have no | 10 | | application.

roadway except under | 4 | | the following situations:
| 5 | | 1. When overtaking and passing another bicycle, | 6 | | motorized pedal
cycle , skater, or vehicle proceeding in
the | 7 | | same direction; or
| 8 | | 2. When preparing for a left turn at an intersection or | 9 | | into
a private road or driveway; or
| 10 | | 3. When reasonably necessary to avoid conditions | 11 | | including,
but not limited to, fixed or moving objects, | 12 | | parked or moving vehicles,
bicycles, motorized pedal | 13 | | cycles, pedestrians,
animals, surface hazards, or | 14 | | substandard width lanes that make it unsafe
to continue | 15 | | along the right-hand curb or edge. For purposes of this | 16 | | subsection,
a "substandard width lane" means a lane that is | 17 | | too narrow for a bicycle ,
or motorized pedal cycle , or | 18 | | in-line speed skater
and a vehicle to travel safely side by | 19 | | side within the lane ; or .
| 20 | | 4. When approaching a place where a right turn is | 21 | | authorized.
| 22 | | (b) Any person operating a bicycle or motorized pedal cycle | 23 | | or using in-line speed skates upon a one-way
highway with two | 24 | | or
more marked traffic lanes may ride or skate as near the | 25 | | left-hand curb or edge of
such roadway as practicable.

Persons riding bicycles or motorized pedal | 3 | | cycles or using in-line speed skates upon
a roadway shall not | 4 | | ride or skate more than 2 abreast, except on paths or parts of
| 5 | | roadways set aside for their exclusive use. Persons riding or | 6 | | skating 2 abreast shall
not impede the normal and reasonable | 7 | | movement of traffic and, on a laned
roadway, shall ride or | 8 | | skate within a single lane subject to the provisions of
Section | 9 | | 11-1505.

| 12 | | Sec. 11-1507. Lamps and other equipment on bicycles. | 13 | | (a) Every bicycle
when in use at nighttime shall be | 14 | | equipped with a
lamp on the front which shall emit a white | 15 | | light visible from a distance
of at least 500 feet to the front | 16 | | and with a red reflector on the rear
of a type approved by the | 17 | | Department which shall be visible from all
distances from 100 | 18 | | feet to 600 feet to the rear when directly in front
of lawful | 19 | | lower beams of headlamps on a motor vehicle. A lamp emitting
a | 20 | | red light visible from a distance of 500 feet to the rear may | 21 | | be used
in addition to the red reflector.
| 22 | | (b) A bicycle shall not be equipped with nor shall any | 23 | | person use
upon a bicycle any siren. This subsection (b) does | 24 | | not apply to a bicycle that is a police vehicle or fire |

| 1 | | department vehicle.
| 2 | | (c) Every bicycle shall be equipped with a brake which will
| 3 | | adequately control movement of and stop and hold such bicycle.
| 4 | | (d) No person shall sell a new bicycle or pedal for use on | 5 | | a bicycle
that is not equipped with a reflex reflector | 6 | | conforming to
specifications prescribed by the Department, on | 7 | | each pedal, visible from
the front and rear of the bicycle | 8 | | during darkness from a distance of 200
feet.
| 9 | | (e) No person shall sell or offer for sale a new bicycle | 10 | | that is not
equipped with side reflectors. Such reflectors | 11 | | shall be visible from
each side of the bicycle from a distance | 12 | | of 500 feet and shall be essentially
colorless or red to
the | 13 | | rear of the center of the bicycle and essentially colorless or | 14 | | amber
to the front of the
center of the bicycle provided. The | 15 | | requirements of this paragraph may
be met by reflective | 16 | | materials which shall be at least 3/16 of an inch
wide on each | 17 | | side of each tire or rim to indicate as clearly as possible
the | 18 | | continuous circular shape and size of the tires or rims of such
| 19 | | bicycle and which reflective materials may be of the same color | 20 | | on both
the front and rear tire or rim. Such reflectors shall | 21 | | conform to
specifications prescribed by the Department.
| 22 | | (f) No person shall sell or offer for sale a new bicycle | 23 | | that is not
equipped with an essentially colorless front-facing | 24 | | reflector.
| 25 | | (g) A person using in-line speed skates on a highway shall | 26 | | have installed on his or her person a white light visible from |

| 1 | | a distance of at least 500 feet to the front and with a red | 2 | | reflector on the rear of a type approved by the Department | 3 | | which is visible from all distances from 100 feet to 600 feet | 4 | | to the rear when directly in front of lawful lower beams of | 5 | | headlamps on a motor vehicle. A lamp emitting
a red light | 6 | | visible from a distance of 500 feet to the rear may be used

| 10 | | Sec. 11-1510. Left Turns. | 11 | | (a) A person riding a bicycle or moped intending to turn | 12 | | left shall follow a course described in
Section 11-801 or in | 13 | | paragraph (b) of this Section.
| 14 | | (b) A person riding a bicycle or moped intending to turn
| 15 | | left shall approach the
turn as close as practicable to the | 16 | | right curb or edge of the roadway.
After proceeding across the | 17 | | intersecting roadway to the far corner of the
curb or | 18 | | intersection of the roadway edges, the bicyclist or moped | 19 | | driver shall stop, as much as practicable out of the way of
| 20 | | traffic. After stopping the person shall yield to any traffic | 21 | | proceeding
in either direction along the roadway such person | 22 | | had been using. After
yielding, the bicycle or moped driver
| 23 | | shall comply with any official
traffic control device or police | 24 | | officer regulating traffic on the highway
along which he | 25 | | intends to proceed, and the bicyclist or moped
driver may |

| 1 | | proceed in the new direction.
| 2 | | (c) Notwithstanding the foregoing provisions, the | 3 | | Department
and local authorities in their respective | 4 | | jurisdictions may cause official
traffic-control devices to be | 5 | | placed and thereby require and direct that
a specific course be | 6 | | traveled by turning bicycles and moped,
and when such devices | 7 | | are so placed, no person shall turn a bicycle or
moped other | 8 | | than as directed and required by such devices.
| 9 | | (d) A person using in-line speed skates and intending to | 10 | | turn left must comply with the requirements of Section 11-1001 | 11 | | and 11-1002 of this Code. | 12 | | (Source: P.A. 96-554, eff. 1-1-10.)

| 14 | | Sec. 11-1511. Turn and stop signals. (a) Except as provided | 15 | | in this Section,
a person riding a bicycle or using in-line | 16 | | speed skates shall comply with Section 11-804.
| 17 | | (b) A signal of intention to turn right or left when | 18 | | required shall be
given during not less than the last 100 feet | 19 | | traveled by the bicycle or skater before
turning, and shall be | 20 | | given while the bicycle or skater is stopped waiting to turn.
A | 21 | | signal by hand and arm need not be given continuously if the | 22 | | hand is needed
in the control or operation of the bicycle.

| 1 | | Sec. 11-1514. Bicycle or in-line speed skate racing. (a) | 2 | | Bicycle or in-line speed skate racing on a highway shall
not be | 3 | | unlawful when a racing event has been approved by State or | 4 | | local
authorities on any highway under their respective | 5 | | jurisdictions. Approval
of bicycle or in-line speed skate | 6 | | highway racing events shall be granted only under conditions
| 7 | | which assure reasonable safety for all race participants, | 8 | | spectators and
other highways users, and which prevent | 9 | | unreasonable interference with traffic
flow which would | 10 | | seriously inconvenience other highway users.
| 11 | | (b) By agreement with the approving authority, | 12 | | participants in an approved
bicycle or in-line speed skate | 13 | | highway racing event may be exempted from compliance with any | 14 | | traffic
laws otherwise applicable thereto, provided that | 15 | | traffic control is adequate
to assure the safety of all highway | 16 | | users.

| 18 | | (625 ILCS 5/11-1517 new) | 19 | | Sec. 11-1517. Electronic communication devices-bicyclists. | 20 | | (a) As used in this Section: | 21 | | "Electronic communication device" means an electronic | 22 | | device, including but not limited to a wireless telephone, | 23 | | personal digital assistant, or a portable or mobile computer | 24 | | while being used for the purpose of composing, reading, or | 25 | | sending an electronic message, but does not include a global |

| 1 | | positioning system or navigation system. | 2 | | "Electronic message" means a self-contained piece of | 3 | | digital communication that is designed or intended to be | 4 | | transmitted between physical devices. "Electronic message" | 5 | | includes, but is not limited to electronic mail, a text | 6 | | message, an instant message, or a command or request to access | 7 | | an Internet site. | 8 | | (b) A person may not ride a bicycle or use in-line speed | 9 | | skates on a roadway, sidewalk, or bicycle path while using an | 10 | | electronic communication device to compose, send, or read an | 11 | | electronic message. | 12 | | (c) This Section does not apply to: | 13 | | (1) a law enforcement officer while performing his or | 14 | | her official duties; | 15 | | (2) a bicyclist or in-line speed skater using an | 16 | | electronic communication device for the sole purpose of | 17 | | reporting an emergency situation and continued | 18 | | communication with emergency personnel during the | 19 | | emergency situation; | 20 | | (3) a bicyclist or in-line speed skater using an | 21 | | electronic communication device in hands-free or | 22 | | voice-activated mode; or | 23 | | (4) a bicyclist or in-line speed skater using an | 24 | | electronic communication device while stopped on the | 25 | | shoulder of a roadway. ".
