Amends the School Code and the Illinois Vehicle Code. Provides that a multi-function school activity bus (MFSAB) may be used to transport students for any curriculum-related activity except for transportation on regular bus routes from home to school or from school to home. Provides that a MFSAB authorized to transport students under the new provisions must be operated by a holder of a school bus driver permit and is subject to certain provisions concerning contractual student transfer arrangements, contracts requiring school bus driver permits, liability insurance, and safety testing. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5.. The School Code is amended by changing Section | 5 | | 29-6.3 as follows:
| 6 | | (105 ILCS 5/29-6.3)
| 7 | | Sec. 29-6.3. Transportation to and from specified | 8 | | interscholastic or school-sponsored
activities. | 9 | | (a) Any school district transporting students in grade | 10 | | 12 or below for an interscholastic, interscholastic athletic, | 11 | | or school-sponsored, noncurriculum-related activity that (i) | 12 | | does not require student participation as part of the | 13 | | educational services of the district and (ii) is not associated | 14 | | with the students' regular class-for-credit schedule or | 15 | | required 5 clock hours of instruction shall transport the | 16 | | students only in a school bus, a vehicle manufactured to | 17 | | transport not more than 10 persons, including the driver, or a | 18 | | multifunction school-activity bus manufactured to transport | 19 | | not more than 15 persons, including the driver. | 20 | | (a-5) A student may be transported in a multi-function | 21 | | school activity bus (MFSAB) as defined in Section 1-148.3a-5 of | 22 | | this Code for any curriculum-related activity except for | 23 | | transportation on regular bus routes from home to school or |

| 1 | | from school to home, subject to the following conditions: | 2 | | (i) A MFSAB may not be used to transport students under | 3 | | this Section unless the driver holds a valid school bus | 4 | | driver permit. | 5 | | (ii) The use of a MFSAB under this Section is subject | 6 | | to the requirements of Sections 6-106.11, 6-106.12, | 7 | | 12-707.01, 13-101, and 13-109 of this Code. | 8 | | (b) Any school district furnishing transportation for | 9 | | students under the authority of this Section shall insure | 10 | | against any loss or liability of the district resulting from | 11 | | the maintenance, operation, or use of the vehicle. | 12 | | (c) Vehicles used to transport students under this Section | 13 | | may claim a depreciation allowance of 20% over 5 years as | 14 | | provided in Section 29-5 of this Code.

| 20 | | (a) Every student enrolled in grade 12 or below in any | 21 | | entity listed in subsection (a) of Section 1-182 of this Code | 22 | | must be transported in a school bus or a vehicle described in | 23 | | subdivision (1) or (2) of subsection (b) of Section 1-182 of | 24 | | this Code for any curriculum-related school activity , except a |

| 20 | | (b) Every student enrolled in grade 12 or below in any | 21 | | entity listed in subsection (a) of Section 1-182 of this Code | 22 | | who is transported in a vehicle that is being operated by or | 23 | | for a public or private primary or secondary school, including | 24 | | any primary or secondary school operated by a religious | 25 | | institution, for an interscholastic, interscholastic-athletic, | 26 | | or school-sponsored, noncurriculum-related activity that (i) |

| 1 | | does not require student participation as part of the | 2 | | educational services of the entity and (ii) is not associated | 3 | | with the students' regular class-for-credit schedule shall | 4 | | transport students only in a school bus or vehicle described in | 5 | | subsection (b) of Section 1-182 of this Code. This subsection | 6 | | (b) does not apply to any second division vehicle used by an | 7 | | entity listed in subsection (a) of Section 1-182 of this Code | 8 | | for a parade, homecoming, or a similar noncurriculum-related | 9 | | school activity.
