SYNOPSIS AS INTRODUCED:
 
New Act
25 ILCS 135/8 new

    Creates the Office of the Repealer Act. Establishes the Office of the Repealer within the Office of the Governor. Requires the Governor, with the advice and consent of the Senate, to appoint an individual to serve as the State Repealer. Sets forth the duties of the State Repealer. Amends the Legislative Reference Bureau Act. Directs the Legislative Reference Bureau to cooperate with the Office of the Repealer to the extent necessary to complete the duties assigned to the Office of the Repealer. Effective January 1, 2013.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Office
5of the Repealer Act.
 
6    Section 5. Office of the Repealer.
7    (a) As soon as practical after the effective date of this
8Section, a new office called the Office of the Repealer shall
9be created within the Office of the Governor. The Governor
10shall, with the advice and consent of the Senate, appoint an
11individual to serve as the State Repealer. The Office of the
12Governor shall, from the funds appropriated to it, commit and
13make available to the Office of the Repealer the resources and
14personnel required to carry out the duties of the State
15Repealer at the discretion of the State Repealer.
16    (b) The State Repealer is charged to with performing all of
17the following duties:
18        (1) Investigating the system of governance of the State
19    of Illinois, including its laws, regulations, and other
20    governing instruments to determine instances in which
21    those laws, regulations, or other governing instruments
22    are unreasonable, unduly burdensome, duplicative, onerous,
23    or in conflict.

1        (2) Creating, at the earliest possible date, a system
2    for receiving public comments suggesting various laws,
3    regulations, and other governing instruments to be
4    considered for possible repeal by the Office of the
5    Repealer. This system shall include a public online portal
6    for receiving these comments.
7        (3) Determining that a State law, regulation, or other
8    governing instrument is unreasonable, unduly burdensome,
9    duplicative, or onerous, or conflicts with another law,
10    regulation, or governing instrument, and, upon making that
11    determination, recommending to the originating body either
12    the repeal or modification of the law, regulation, or other
13    governing instrument. The recommendation shall set forth
14    with specificity the justification for the requested
15    repeal or modification.
16        (4) Implementing a tracking system to follow the action
17    taken by any originating body on any recommendation made by
18    the State Repealer in order to prepare regular reports to
19    the Governor regarding the progress of repeal or
20    modification.
21        (5) Receiving and considering suggestions from judges,
22    justices, public officials, lawyers, and the public
23    generally regarding defects and anachronisms in the law.
24        (6) Recommending, from time to time, changes in the law
25    the State Repealer deems necessary to modify or eliminate
26    antiquated and inequitable rules of law and to bring the

1    law of this State, civil and criminal, into harmony with
2    modern conditions.
3        (7) Reporting its proceedings annually to the General
4    Assembly on or before February first, and, if it deems
5    advisable, to accompany its report with proposed bills to
6    carry out any of its recommendations.
7        (8) Working in conjunction with all legislative
8    commissions to formulate changes needed to current
9    statutes for the betterment of State statutes and the State
10    of Illinois.
 
11    Section 10. The Legislative Reference Bureau Act is amended
12by adding Section 8 as follows:
 
13    (25 ILCS 135/8 new)
14    Sec. 8. Cooperation with Office of the Repealer. The
15Legislative Reference Bureau shall cooperate with the Office of
16the Repealer to the extent necessary to complete the duties
17assigned to the Office of the Repealer under the Office of the
18Repealer Act.
 
19    Section 99. Effective date. This Act takes effect January
201, 2013.
