| 2 | | AMENDMENT NO. ___. Amend Senate Resolution 25 on page 1, by | 3 | | replacing lines 2 through 4 with the following:
| 4 | | "BE IT RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH | 5 | | GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the Rules of | 6 | | the Senate of the 97th General Assembly are amended by changing | 7 | | Rule 10-2 as follows:
| 8 | | (Senate Rule 10-2) | 9 | | 10-2. Appointment Messages. | 10 | | (a) Every nomination subject to the advice and consent of | 11 | | the Senate
shall be submitted to the Senate by an Appointment | 12 | | Message from
the appointing officer or appointing authority in | 13 | | accordance
with this Rule, using the Appointment Message form | 14 | | provided
in this Rule, containing all of the required | 15 | | information, and
accompanied by a cover letter signed by the |

or on behalf of the appointing authority. | 2 | | (b) All Appointment Messages shall be drafted by the
| 3 | | Legislative Reference Bureau, according to the form provided
in | 4 | | this Rule. | 5 | | (c) Appointment Messages submitted shall be assigned a
| 6 | | sequential number by the Secretary of the Senate, indicating
| 7 | | the order in which they were received and read into the Senate
| 8 | | record by the Secretary of the Senate at the direction of the
| 9 | | Senate President. An Appointment Message is received by the
| 10 | | Senate when it is read into the Senate record and assigned a
| 11 | | sequential number. | 12 | | (d) An Appointment Message that does not conform to the
| 13 | | requirements of this Rule shall, at the direction of the Senate
| 14 | | President, (i) be ruled non-compliant and of no legal effect | 15 | | and (ii) returned by the Secretary of the Senate to the
| 16 | | appointing officer or authority that filed it. | 17 | | (e) The appointing officer or authority may file in
| 18 | | accordance with this Rule an Appointment Message that
| 19 | | supersedes a previously filed Appointment Message. A
| 20 | | superseding Appointment Message shall identify by sequential | 21 | | number the
Appointment Message that it supersedes. The filing | 22 | | of a
superseding Appointment Message shall automatically table |

Appointment Message that it supersedes, and that superseded | 2 | | Appointment Message shall
have no further legal effect. | 3 | | (f) Nothing in this Rule shall be construed to prohibit an | 4 | | appointing officer or authority from withdrawing in writing an | 5 | | Appointment Message that was previously submitted to or | 6 | | received by the Senate. An Appointment Message that has been | 7 | | withdrawn shall have no further legal effect. | 8 | | (g) An Appointment Message (i) shall be a | 9 | | committee-sponsored
legislative measure that is unamendable | 10 | | and (ii) shall be
controlled by the Chairperson of the | 11 | | Executive Appointments
Committee, who for purposes of these | 12 | | Senate Rules shall be
deemed the principal sponsor. In the | 13 | | absence of the
Chairperson, the Vice-Chairperson of the | 14 | | Executive
Appointments Committee shall be deemed the principal | 15 | | sponsor.
Messages may not have individual cosponsors. | 16 | | (h) Any Appointment Message pending when the Senate
| 17 | | adjourns sine die (i) shall carry over into the next General | 18 | | Assembly and (ii) shall be considered to have been received by | 19 | | the Senate when originally read into the Senate record as | 20 | | provided for in subsection (c) of this Rule. An Appointment | 21 | | Message carrying over into the next General Assembly shall | 22 | | retain the sequential number assigned when originally read into | 23 | | the Senate record as provided for in subsection (c) of this |

| 1 | | Rule. | 2 | | (i) Notwithstanding the requirements contained in this | 3 | | Rule, any Appointment Message submitted to the 96th General | 4 | | Assembly and not acted upon by the 96th General Assembly is | 5 | | deemed to be carried over to the 97th General Assembly. The | 6 | | Senate may take action on any Appointment Message carried over | 7 | | from the Senate of the 96th General Assembly. Nothing in this | 8 | | Rule shall be construed to prohibit an appointing officer or | 9 | | authority from withdrawing in writing an Appointment Message | 10 | | that was previously submitted to or received by the Senate of | 11 | | the 96th General Assembly and carried over into the Senate of | 12 | | the 97th General Assembly.
