SYNOPSIS AS INTRODUCED:

625 ILCS 5/11-203.5 new

    Amends the Illinois Vehicle Code. Adds a provision allowing the Secretary of State to certify individuals as Motorcycle Road Guards. Provides that Motorcycle Road Guards are empowered to stop and direct traffic for the purpose of protecting and facilitating a motorcycle group ride. Provides minimum qualifications for certification as a Motorcycle Road Guard. Empowers the Secretary of State to adopt additional requirements and regulations for the implementation and enforcement of this Section. Amends the provision on obedience to traffic control officers to include Motorcycle Road Guards as an authority that vehicular traffic must obey. Effective July 1, 2013.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-203 and by adding Section 11-203.5 as follows:
 
6    (625 ILCS 5/11-203)  (from Ch. 95 1/2, par. 11-203)
7    Sec. 11-203. Obedience to police officers. No person shall
8wilfully fail or refuse to comply with any lawful order or
9direction of any police officer, fireman, motorcycle road
10guard, or school crossing guard invested by law with authority
11to direct, control, or regulate traffic. Any person convicted
12of violating this Section is guilty of a petty offense and
13shall be subject to a mandatory fine of $150.

16    Sec. 11-203.5. Motorcycle road guards.
17    (a) A person may act as a motorcycle road guard if the
18person:
19        (1) holds a motorcycle road guard certificate issued by
20    the Secretary of State;
21        (2) meets the safety and equipment standards for
22    operating as a motorcycle road guard set by the Secretary

1    of State;
2        (3) is escorting a motorcycle group ride;
3        (4) has notified the county and municipality, home rule
4    or otherwise, through which the motorcycle group is
5    proceeding; and
6        (5) has obtained consent to act as a motorcycle road
7    guard from local law enforcement in the county and
8    municipality through which the motorcycle group is
9    proceeding.
10    (b) A person acting as a motorcycle road guard under
11subsection (a) of this Section may stop and hold vehicles in
12place until it is safe for the vehicles to proceed, and may
13direct operators of motor vehicles, including motorcycles
14within a motorcycle group ride, contrary to the indications of
15any traffic-control device, including stop signs or
16traffic-control signals.
17    (c) Certification. The Secretary of State shall:
18        (1) establish qualifications and requirements for a
19    person to obtain a motorcycle road guard certificate under
20    this Section, which shall include:
21            (A) a minimum 18 years of age;
22            (B) possession of a valid driver's license with
23        motorcycle classification;
24            (C) successful completion of a motorcycle road
25        guard certification course; and
26            (D) any other qualifications the Secretary deems

1        appropriate;
2        (2) develop and offer, whether by Secretary of State
3    employees or authorized third parties, a motorcycle road
4    guard certification course; and
5        (3) establish safety and equipment standards for a
6    person who operates under a motorcycle road guard
7    certificate, including but not limited to specifying
8    requirements for a reflective safety vest.
9    (d) The Secretary of State shall assess a fee for each
10applicant for a motorcycle road guard certificate, calculated
11to cover the cost of establishing and administering the
12program.
13    (e) The Secretary of State may adopt rules to carry out the
14provisions of this Section.
 
15    Section 99. Effective date. This Act takes effect July 1,
162013.
