Civil Administrative Code of Illinois is amended by | 6 | | changing Section 405-335 as follows: | 7 | | (20 ILCS 405/405-335) | 8 | | Sec. 405-335. Illinois Transparency and Accountability | 9 | | Portal (ITAP).
| 10 | | (a) The Department, within 12 months after January 1, 2010 | 11 | | the effective date of this amendatory Act of the 96th General | 12 | | Assembly , shall establish and maintain a website, known as the | 13 | | Illinois Transparency and Accountability Portal (ITAP), with a | 14 | | full-time webmaster tasked with compiling and updating the ITAP | 15 | | database with information received from all State agencies as | 16 | | defined in this Section. Subject to appropriation, the |

| 1 | | full-time webmaster must also compile and update the ITAP | 2 | | database with information received from all counties, | 3 | | townships, and municipalities. | 4 | | (a-5) As soon as practical after this amendatory Act of the | 5 | | 98th General Assembly, the Department must compile and update | 6 | | the ITAP database with information received under subsection | 7 | | (c-5) of this Section. | 8 | | (b) For purposes of this Section: | 9 | | "State agency" means the offices of the constitutional | 10 | | officers identified in Article V of the Illinois Constitution, | 11 | | executive agencies, and departments, boards, commissions, and | 12 | | Authorities under the Governor. | 13 | | "Contracts" means payment obligations with vendors on file | 14 | | with the Office of the Comptroller to purchase goods and | 15 | | services exceeding $10,000 in value (or, in the case of | 16 | | professional or artistic services, exceeding $5,000 in value). | 17 | | "Appropriation" means line-item detail of spending | 18 | | approved by the General Assembly and Governor, categorized by | 19 | | object of expenditure. | 20 | | "Individual consultants" means temporary workers eligible | 21 | | to receive State benefits paid on a State payroll. | 22 | | "Recipients" means State agencies receiving | 23 | | appropriations. | 24 | | (c) The ITAP shall provide direct access to each of the | 25 | | following: | 26 | | (1) A database of all current State employees and |

| 1 | | individual consultants, except sworn law enforcement | 2 | | officers, sorted separately by: | 3 | | (i) Name. | 4 | | (ii) Employing State agency. | 5 | | (iii) Employing State division. | 6 | | (iv) Employment position title. | 7 | | (v) Current pay rate and year-to-date pay. | 8 | | (2) A database of all current State expenditures, | 9 | | sorted separately by agency, category, recipient, and | 10 | | Representative District. | 11 | | (3) A database of all development assistance | 12 | | reportable pursuant to the Corporate Accountability for | 13 | | Tax Expenditures Act, sorted separately by tax credit | 14 | | category, taxpayer, and Representative District. | 15 | | (4) A database of all revocations and suspensions of | 16 | | State occupation and use tax certificates of registration | 17 | | and all revocations and suspensions of State professional | 18 | | licenses, sorted separately by name, geographic location, | 19 | | and certificate of registration number or license number, | 20 | | as applicable. Professional license revocations and | 21 | | suspensions shall be posted only if resulting from a | 22 | | failure to pay taxes, license fees, or child support. | 23 | | (5) A database of all current State contracts, sorted | 24 | | separately by contractor name, awarding officer or agency, | 25 | | contract value, and goods or services provided. | 26 | | (6) A database of all employees hired after the |

| 1 | | effective date of this amendatory Act of 2010, sorted | 2 | | searchably by each of the following at the time of | 3 | | employment: | 4 | | (i) Name. | 5 | | (ii) Employing State agency. | 6 | | (iii) Employing State division. | 7 | | (iv) Employment position title. | 8 | | (v) Current pay rate and year-to-date pay. | 9 | | (vi) County of employment location. | 10 | | (vii) Rutan status. | 11 | | (viii) Status of position as subject to collective | 12 | | bargaining, subject to merit compensation, or exempt | 13 | | under Section 4d of the Personnel Code. | 14 | | (ix) Employment status as probationary, trainee, | 15 | | intern, certified, or exempt from certification. | 16 | | (x) Status as a military veteran. | 17 | | (7) (Blank). A searchable database of all current | 18 | | county, township, and municipal employees sorted | 19 | | separately by: | 20 | | (i) Employing unit of local government. | 21 | | (ii) Employment position title. | 22 | | (iii) Current pay rate and year-to-date pay. | 23 | | (8) (Blank). A searchable database of all county, | 24 | | township, and municipal employees hired on or after the | 25 | | effective date of this amendatory Act of the 97th General | 26 | | Assembly, sorted separately by each of the following at the |

| 1 | | time of employment: | 2 | | (i) Employing unit of local government. | 3 | | (ii) Employment position title. | 4 | | (iii) Current pay rate and year-to-date pay. | 5 | | (c-5) The ITAP shall provide direct access to each of the | 6 | | following for each county, township, and municipality: | 7 | | (1) a database of all current employees of the unit of | 8 | | local government, except sworn law enforcement officers, | 9 | | sorted separately by: | 10 | | (i) Name. | 11 | | (ii) Employing unit of local government. | 12 | | (iii) Employment position title. | 13 | | (iv) Current pay rate and year-to-date pay. | 14 | | (2) All financial reports and audits required to be | 15 | | filed by the unit of local government with a State agency | 16 | | or another unit of local government, including, but not | 17 | | limited to, reports and audits required to be filed with | 18 | | the Comptroller under Section 8-8-3 of the Illinois | 19 | | Municipal Code. | 20 | | (3) All Tax Increment Financing Reports required to be | 21 | | filed with the Comptroller under Section 8-8-3.5 of the | 22 | | Illinois Municipal Code. | 23 | | (4) The account of the municipal treasurer required | 24 | | under Section 3.1-35-65 of the Illinois Municipal Code. | 25 | | (5) The report of the police and firefighter pension | 26 | | board that is required to be issued to a municipality under |

| 1 | | Section 3-143 or 4-134 of the Illinois Pension Code. | 2 | | (6) The report filed by the Illinois Municipal | 3 | | Retirement Fund under Section 7-192 of the Illinois Pension | 4 | | Code and each Governmental Accounting Standards Board | 5 | | Pension Disclosure that the Fund provides to a unit of | 6 | | local government. | 7 | | (d) The ITAP shall include all information required to be | 8 | | published by subsections subsection (c) and (c-5) of this | 9 | | Section that is available to the Department in a format the | 10 | | Department can compile and publish on the ITAP. The Department | 11 | | shall update the ITAP as additional information becomes | 12 | | available in a format that can be compiled and published on the | 13 | | ITAP by the Department. | 14 | | (e) Each State agency, county, township, and municipality | 15 | | shall cooperate with the Department in furnishing the | 16 | | information necessary for the implementation of this Section | 17 | | within a timeframe specified by the Department. The Department, | 18 | | however, may not require that any report, accounting, or other | 19 | | filing that is filed pursuant to a statute or other law be | 20 | | submitted at a different time or in a different manner or | 21 | | format than was used by the State agency or unit of local | 22 | | government in creating the document. | 23 | | (f) Each county, township, or municipality submitting | 24 | | information to be displayed on the Illinois Transparency and | 25 | | Accountability Portal (ITAP) is responsible for the accuracy of | 26 | | the information provided. |

| 3 | | Section 99. Effective date. This Act takes effect upon | 4 | | becoming law.".
