| 2 | | AMENDMENT NO. ______. Amend House Bill 2865 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Property Tax Code is amended by changing | 5 | | Section 9-200 and adding 15-190 as follows:
| 6 | | (35 ILCS 200/9-200)
| 7 | | Sec. 9-200. Previously exempt property. | 8 | | (a) Generally. Property that is purchased,
granted, taken | 9 | | or otherwise transferred from a use exempt from taxation under
| 10 | | this Code to a use not so exempt shall be subject to taxation | 11 | | from the date of
change of use, purchase or conveyance. In | 12 | | those cases the county collector may
issue a tax bill to the | 13 | | person holding title to the property for that part of
the year | 14 | | during which it was not exempt, and may accept payment of the | 15 | | bill as
full and final settlement of tax liability for that | 16 | | year. |

| 1 | | (b) Drainage district. State highways, streets, and alleys | 2 | | located within a drainage district under the Illinois Drainage | 3 | | Code previously exempt from taxation under this Code shall be | 4 | | subject to taxation from the effective date of this amendatory | 5 | | Act of the 98th General Assembly by the drainage district in | 6 | | which they are located.

public highways, streets and alleys, which, in their
| 23 | | opinion, will be benefited, taken or damaged by the proposed |

| 1 | | work. Whenever
another district or a municipal corporation | 2 | | exercising drainage powers has
been made a party to the | 3 | | proceedings to organize the district, then the
commissioners | 4 | | shall also include such other district or municipal
corporation | 5 | | in their assessment roll.

| 7 | | Section 15. The Rivers, Lakes, and Streams Act is amended | 8 | | by adding Section 40 as follows: | 9 | | (615 ILCS 5/40 new) | 10 | | Sec. 40. Department requirements. Notwithstanding any | 11 | | other provision of law, the Department shall require the | 12 | | following: | 13 | | (a) with respect to the Department's permit process for | 14 | | levee improvements, the Department shall provide notice of | 15 | | submissions and a detailed timeline for review the submitter | 16 | | within 90 days; | 17 | | (b) with respect to Department standards for construction | 18 | | in rural areas, the Department shall permit a water surface | 19 | | profile increase of 0.5 feet; | 20 | | (c) with respect to Department standards for construction | 21 | | in urban areas, the Department shall permit a water surface | 22 | | profile increase of 0.1 feet; and | 23 | | (d) with respect to mitigation analysis, a mitigation | 24 | | analysis shall only be performed if a water surface profile |

| 1 | | increase of 0.5 feet in rural areas, or of 0.1 in urban areas, | 2 | | exceeds an induced head study.
| 3 | | Section 99. Effective date. This Act takes effect upon | 4 | | becoming law.".
