| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Sections 6-106.2, 6-106.3, and 6-106.4 as follows:
| 6 | | (625 ILCS 5/6-106.2) (from Ch. 95 1/2, par. 6-106.2)
| 7 | | Sec. 6-106.2. Religious organization bus driver. A | 8 | | religious
organization bus driver shall meet the following | 9 | | requirements:
| 10 | | 1. is 21 years of age or older;
| 11 | | 2. has a valid and properly classified driver's
license | 12 | | issued by the
Secretary of State;
| 13 | | 3. has held a valid driver's license, not necessarily | 14 | | of the same
classification, for
3 years prior to the date
| 15 | | of application . A lapse in the renewal of the driver's | 16 | | license of 30 days or less shall not render the applicant | 17 | | ineligible. The Secretary of State may, in his or her | 18 | | discretion, grant a waiver for a lapse in the renewal of | 19 | | the driver's license in excess of 30 days ;
| 20 | | 4. has demonstrated an ability to exercise reasonable
| 21 | | care in the safe
operation of religious
organization buses | 22 | | in accordance with such standards as the Secretary of
State | 23 | | prescribes
including a driving test in a religious |

| 1 | | organization bus; and
| 2 | | 5. has not been convicted of any of the following | 3 | | offenses within 3 years of the
date of application: | 4 | | Sections 11-401 (leaving the scene of a traffic
accident | 5 | | involving death or personal injury), 11-501 (driving under | 6 | | the
influence), 11-503 (reckless driving), 11-504 (drag | 7 | | racing), and 11-506 (street racing) of this Code, or | 8 | | Sections
9-3 (manslaughter or reckless homicide) and 12-5 | 9 | | (reckless conduct arising
from the use of a motor vehicle) | 10 | | of the Criminal Code of 1961 or the Criminal Code of 2012.

| 13 | | Sec. 6-106.3. Senior citizen transportation - driver. A | 14 | | driver of a
vehicle operated solely for the purpose of | 15 | | providing transportation for
the elderly in connection with the | 16 | | activities of any public or private
organization
shall meet the | 17 | | following requirements:
| 18 | | (1) is 21 years of age or older;
| 19 | | (2) has a valid and properly classified driver's | 20 | | license issued by the
Secretary of State;
| 21 | | (3) has had a valid driver's license, not necessarily
| 22 | | of the same classification, for 3 years prior to the date | 23 | | of application . A lapse in the renewal of the driver's | 24 | | license of 30 days or less shall not render the applicant | 25 | | ineligible. The Secretary of State may, in his or her |

| 1 | | discretion, grant a waiver for a lapse in the renewal of | 2 | | the driver's license in excess of 30 days ;
| 3 | | (4) has demonstrated his ability to exercise | 4 | | reasonable care in the safe
operation of a motor vehicle | 5 | | which will be utilized to transport persons
in accordance | 6 | | with such standards as the Secretary of State prescribes
| 7 | | including
a driving test in such motor vehicle; and
| 8 | | (5) has not been convicted of any of the following | 9 | | offenses within
3 years of the date of application:
| 10 | | Sections 11-401 (leaving the scene of a traffic accident | 11 | | involving death
or personal injury), 11-501 (driving under | 12 | | the influence), 11-503 (reckless
driving), 11-504 (drag | 13 | | racing), and 11-506 (street racing) of this Code, or | 14 | | Sections 9-3 (manslaughter
or reckless
homicide) and 12-5 | 15 | | (reckless conduct arising from the use of a motor
vehicle) | 16 | | of the Criminal Code of 1961 or the Criminal Code of 2012.

| 19 | | Sec. 6-106.4. For-profit ridesharing arrangement - driver. | 20 | | No person
may drive a commuter van while it is being used for a | 21 | | for-profit ridesharing
arrangement unless such person:
| 22 | | (1) is 21 years of age or older;
| 23 | | (2) has a valid and properly classified driver's | 24 | | license issued by the
Secretary of State;
| 25 | | (3) has held a valid driver's license, not necessarily

| 1 | | of the same classification,
for 3 years prior to the date | 2 | | of application . A lapse in the renewal of the driver's | 3 | | license of 30 days or less shall not render the applicant | 4 | | ineligible. operation of commuter vans used | 9 | | in for-profit ridesharing arrangements in
accordance with | 10 | | such standards as the Secretary of State may prescribe,
| 11 | | which standards may require a driving test in a commuter | 12 | | van; and
| 13 | | (5) has not been convicted of any of the following | 14 | | offenses within
3 years of the date of
application: | 15 | | Sections 11-401 (leaving the scene of a traffic
accident | 16 | | involving death or personal injury), 11-501 (driving under
| 17 | | the influence), 11-503 (reckless driving), 11-504 (drag | 18 | | racing), and 11-506 (street racing) of this
Code, or
| 19 | | Sections 9-3 (manslaughter or reckless homicide) and 12-5 | 20 | | (reckless conduct
arising from the use of a motor vehicle) | 21 | | of the Criminal Code of 1961 or the Criminal Code of 2012.
