AMENDMENT TO HOUSE BILL 3961

2    AMENDMENT NO. ______. Amend House Bill 3961 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. If and only if Senate Bill 2202 of the 98th
5General Assembly, as amended by House Amendment No. 1, becomes
6law, then "An Act concerning higher education" (Senate Bill
72202 of the 98th General Assembly) is amended by changing
8Section 15 as follows:
 
9    (S.B. 2202 98th G.A., Sec. 15)
10    Sec. 15. Prohibitions on smoking.
11    (a) Beginning on July 1, 2015, smoking is prohibited on
12each campus of a State-supported institution of higher
13education. The prohibition set forth in this subsection (a)
14shall not apply to any instance in which an individual is
15traveling through or parked on a campus in a vehicle that is
16not owned by a State-supported institution of higher education.

1    (b) An individual or campus subject to the smoking
2prohibitions of this Act may not discriminate or retaliate in
3any manner against a person for making a complaint of a
4violation of this Act or furnishing information concerning a
5violation to a person, campus, or governing authority.
6    (c) The prohibitions on smoking in this Act must be
7communicated to all students and employees of State-supported
8institutions of higher education on or before May 1, 2015 and
9to each guest of a State-supported institution of higher
10education upon request.
11    (d) Each State-supported institution of higher education
12shall create and post on its Internet website a smoke-free
13campus map indicating the locations where smoking is prohibited
14under this Act.

16    Section 99. Effective date. This Act takes effect upon
17becoming law or on the date Senate Bill 2202 of the 98th
18General Assembly takes effect, whichever is later.".
