1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
524-5 as follows:
 
6    (105 ILCS 5/24-5)  (from Ch. 122, par. 24-5)
7    Sec. 24-5. Physical fitness and professional growth.
8    (a) In this Section, "employee" means any employee of a
9school district, a student teacher, an employee of a contractor
10that provides services to students or in schools, or any other
11individual subject to the requirements of Section 10-21.9 or
1234-18.5 of this Code.
13    (b) School boards shall require of new employees evidence
14of physical fitness to perform duties assigned and freedom from
15communicable disease, including tuberculosis. Such evidence
16shall consist of a physical examination and a tuberculin skin
17test and, if appropriate, an x-ray, made by a physician
18licensed in Illinois or any other state to practice medicine
19and surgery in all its branches, an advanced practice nurse who
20has a written collaborative agreement with a collaborating
21physician that authorizes the advanced practice nurse to
22perform health examinations, or a physician assistant who has
23been delegated the authority to perform health examinations by

1his or her supervising physician not more than 90 days
2preceding time of presentation to the board, and the cost of
3such examination shall rest with the employee. A new or
4existing employee may be subject to additional health
5examinations, including screening for tuberculosis, as
6required by rules adopted by the Department of Public Health or
7by order of a local public health official. The board may from
8time to time require an examination of any employee by a
9physician licensed in Illinois to practice medicine and surgery
10in all its branches, an advanced practice nurse who has a
11written collaborative agreement with a collaborating physician
12that authorizes the advanced practice nurse to perform health
13examinations, or a physician assistant who has been delegated
14the authority to perform health examinations by his or her
15supervising physician and shall pay the expenses thereof from
16school funds.
17    (c) School boards may require teachers in their employ to
18furnish from time to time evidence of continued professional
19growth.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
