AMENDMENT TO HOUSE BILL 5658

2    AMENDMENT NO. ______. Amend House Bill 5658 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5For-Profit Community Corrections Prohibition Act.
 
6    Section 5. Purpose. The purpose of this Act is to provide
7effective community-based supervision and rehabilitative
8services to persons under the supervision of the Parole
9Division of the Department of Corrections and the Aftercare
10Division of the Department of Juvenile Justice.
 
11    Section 10. Definitions. As used in this Act:
12    "For-profit prison company" means a for-profit corporation
13or business entity not organized or operating as a
14not-for-profit entity that owns, manages, or operates
15correctional facilities or community correctional supervision

1services.
2    "Community correctional supervision" means re-entry
3services and community surveillance for persons under the
4supervision of the Parole Division of the Department of
5Corrections and the Aftercare Division of the Department of
6Juvenile Justice.
 
7    Section 15. Certain contracts prohibited. On or after the
8effective date of this Act, the State shall not contract with a
9for-profit prison company for community correctional
10supervision of persons in the custody of the Department of
11Corrections or the Department of Juvenile Justice. Nothing in
12this Act shall be construed to allow privatization prohibited
13under the Private Correctional Facility Moratorium Act.
 
14    Section 20. Exemptions. Nothing in this Act shall be
15construed to apply to:
16    (1) State work release centers or juvenile residential
17facilities that provide separate care or special treatment
18operated in whole or part by non-profit private contractors; or
19    (2) contracts for ancillary services, including medical
20services, educational services, electronic monitoring
21services, repair and maintenance contracts, or other services
22not directly related to the ownership, management, or operation
23of security services in a correctional facility or for
24community correctional supervision.".
