| 1 | | AMENDMENT TO HOUSE RESOLUTION 57
| 2 | | AMENDMENT NO. ___. Amend House Resolution 57 by replacing | 3 | | everything after the heading with the following:
| 4 | | "WHEREAS, The Illinois Department of Corrections | 5 | | (Department) has approximately 47,000 inmates at its 27 | 6 | | correctional centers; and
| 7 | | WHEREAS, In 2011, the Department of Healthcare and Family | 8 | | Services awarded a 10-year, $1.36 billion contract to Wexford | 9 | | Health Sources, Inc. (Vendor) to "provide comprehensive | 10 | | medical and mental health services to offenders [in the custody | 11 | | of the Department]... in order to maintain their health status, | 12 | | establish innovative and cost effective medical and | 13 | | administrative programs, improve the quality of care, provide | 14 | | acceptable, cost effective levels of staffing, [and] | 15 | | positively impact purchasing of pharmaceutical and/or medical | 16 | | supplies"; and

| 1 | | WHEREAS, Pursuant to the solicitation for the contract | 2 | | awarded to the Vendor, the Vendor is required to provide | 3 | | services at targeted performance levels (including compliance | 4 | | with staffing schedules, administrative directives, and | 5 | | treatment protocols) with any failure to meet the target levels | 6 | | of performance subjecting the Vendor to payment adjustments; | 7 | | and
| 8 | | WHEREAS, Also pursuant to the solicitation, the Department | 9 | | is required to "[c]onduct audits to confirm the validity of the | 10 | | performance guarantee results reported and enforce penalties | 11 | | as appropriate"; and | 12 | | WHEREAS, At the time the solicitation was issued, the | 13 | | Department identified approximately 250 pending inmate | 14 | | healthcare lawsuits in which the State, its employees, or | 15 | | agents were named parties; and
| 16 | | WHEREAS, The National Commission on Correctional Health | 17 | | Care (NCCHC) has been accrediting correctional facilities | 18 | | since 1983 with their mission of improving the quality of | 19 | | healthcare that is delivered to patients in correctional | 20 | | facilities, according to national accepted, peer-reviewed, and | 21 | | evidence based standards; and

| 1 | | WHEREAS, The accreditation is an external review that | 2 | | assesses the sites compliance with 2008 Standards for Health | 3 | | Services; and
| 4 | | WHEREAS, The basis of all standards is to ensure inmates | 5 | | have access to the medical care needed to meet their health | 6 | | needs; this is the principle on which all NCCHC standards are | 7 | | based and is the basic principle established by the U.S. | 8 | | Supreme Court in the 1976 landmark case Estelle v. Gamble ; and
| 9 | | WHEREAS, This process could determine the current level of | 10 | | the Department's medical practices, as the auditing process | 11 | | will be conducted by a national, independent organization that | 12 | | will audit the Department's practices against national | 13 | | correctional medicine best practices; therefore, be it
| 14 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE | 15 | | NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | 16 | | the Illinois Department of Corrections is directed to select a | 17 | | sample of facilities to be surveyed, audited, and accredited by | 18 | | the NCCHC over the next 3 years; and be it further
| 19 | | RESOLVED, That the accreditation process is to include: | 20 | | (1) an onsite visit; | 21 | | (2) interviews with staff and inmates; and | 22 | | (3) an extensive review of policies, practices, and |

| 1 | | documentation; and be it further | 2 | | RESOLVED, That the areas examined in the standards are to | 3 | | include: | 4 | | (1) governance and administration; | 5 | | (2) safety; | 6 | | (3) personnel and training; | 7 | | (4) health care services and support; | 8 | | (5) inmate care and treatment; | 9 | | (6) health promotion; | 10 | | (7) special needs and services; | 11 | | (8) health records; and | 12 | | (9) medical-legal issues; and be it further | 13 | | RESOLVED, That the facilities surveyed are to include | 14 | | Robinson, Southwestern, Graham, Pinckneyville, Illinois River, | 15 | | Logan, Dixon, and Stateville Correctional Centers; and be it | 16 | | further | 17 | | RESOLVED, That the Department commence this accreditation | 18 | | as soon as possible and report any findings, recommendations, | 19 | | and results upon completion to the Illinois General Assembly; | 20 | | and be it further | 21 | | RESOLVED, That any changes to policy or practices driven by | 22 | | either the survey or audit process at any of the above-listed |
