AMENDMENT TO HOUSE RESOLUTION 57

2    AMENDMENT NO. ___. Amend House Resolution 57 by replacing
3everything after the heading with the following:
 
4    "WHEREAS, The Illinois Department of Corrections
5(Department) has approximately 47,000 inmates at its 27
6correctional centers; and
 
7    WHEREAS, In 2011, the Department of Healthcare and Family
8Services awarded a 10-year, $1.36 billion contract to Wexford
9Health Sources, Inc. (Vendor) to "provide comprehensive
10medical and mental health services to offenders [in the custody
11of the Department]... in order to maintain their health status,
12establish innovative and cost effective medical and
13administrative programs, improve the quality of care, provide
14acceptable, cost effective levels of staffing, [and]
15positively impact purchasing of pharmaceutical and/or medical
16supplies"; and

1    WHEREAS, Pursuant to the solicitation for the contract
2awarded to the Vendor, the Vendor is required to provide
3services at targeted performance levels (including compliance
4with staffing schedules, administrative directives, and
5treatment protocols) with any failure to meet the target levels
6of performance subjecting the Vendor to payment adjustments;
7and
 
8    WHEREAS, Also pursuant to the solicitation, the Department
9is required to "[c]onduct audits to confirm the validity of the
10performance guarantee results reported and enforce penalties
11as appropriate"; and
 
12    WHEREAS, At the time the solicitation was issued, the
13Department identified approximately 250 pending inmate
14healthcare lawsuits in which the State, its employees, or
15agents were named parties; and
 
16    WHEREAS, The National Commission on Correctional Health
17Care (NCCHC) has been accrediting correctional facilities
18since 1983 with their mission of improving the quality of
19healthcare that is delivered to patients in correctional
20facilities, according to national accepted, peer-reviewed, and
21evidence based standards; and

1    WHEREAS, The accreditation is an external review that
2assesses the sites compliance with 2008 Standards for Health
3Services; and
 
4    WHEREAS, The basis of all standards is to ensure inmates
5have access to the medical care needed to meet their health
6needs; this is the principle on which all NCCHC standards are
7based and is the basic principle established by the U.S.
8Supreme Court in the 1976 landmark case Estelle v. Gamble; and
 
9    WHEREAS, This process could determine the current level of
10the Department's medical practices, as the auditing process
11will be conducted by a national, independent organization that
12will audit the Department's practices against national
13correctional medicine best practices; therefore, be it
 
14    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
15NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
16the Illinois Department of Corrections is directed to select a
17sample of facilities to be surveyed, audited, and accredited by
18the NCCHC over the next 3 years; and be it further
 
19    RESOLVED, That the accreditation process is to include:
20        (1) an onsite visit;
21        (2) interviews with staff and inmates; and
22        (3) an extensive review of policies, practices, and

1    documentation; and be it further
 
2    RESOLVED, That the areas examined in the standards are to
3include:
4        (1) governance and administration;
5        (2) safety;
6        (3) personnel and training;
7        (4) health care services and support;
8        (5) inmate care and treatment;
9        (6) health promotion;
10        (7) special needs and services;
11        (8) health records; and
12        (9) medical-legal issues; and be it further
 
13    RESOLVED, That the facilities surveyed are to include
14Robinson, Southwestern, Graham, Pinckneyville, Illinois River,
15Logan, Dixon, and Stateville Correctional Centers; and be it
16further
 
17    RESOLVED, That the Department commence this accreditation
18as soon as possible and report any findings, recommendations,
19and results upon completion to the Illinois General Assembly;
20and be it further
 
21    RESOLVED, That any changes to policy or practices driven by
22either the survey or audit process at any of the above-listed

1facilities be implemented throughout Department facilities
2statewide.".
