AMENDMENT TO SENATE BILL 218

2    AMENDMENT NO. ______. Amend Senate Bill 218 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Abraham Lincoln Presidential Library and Museum Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Agency" means the Abraham Lincoln Presidential Library
8and Museum.
9    "Board" means the Board of the Abraham Lincoln Presidential
10Library and Museum.
11    "Executive Director" means the Executive Director of the
12Abraham Lincoln Presidential Library and Museum.
13    "Library" means the Abraham Lincoln Presidential Library.
14    "Museum" means the Abraham Lincoln Presidential Museum.

1Museum; establishment; Foundation.
2    (a) The Abraham Lincoln Presidential Library and Museum,
3formerly a constituent unit of the Illinois Historic
4Preservation Agency, is created as an independent State agency.
5    (b) The Agency shall be under the supervision and direction
6of the Executive Director of the Abraham Lincoln Presidential
7Library and Museum.
 
8    Section 15. Powers and duties of the Board. The Board
9created under Sections 30 and 31 of the Historic Preservation
10Agency Act shall have the power and duty to:
11    (a) Establish programs for implementation in support of the
12mission and goals of the Abraham Lincoln Presidential Library
13and Museum.
14    (b) Create and execute such seminars, symposia, or other
15conferences as may be necessary or advisable to the Abraham
16Lincoln Presidential Library and Museum.
17    (c) Report annually to the Governor and the General
18Assembly on the status of the Abraham Lincoln Presidential
19Library and Museum and its programs.
20    (d) Hire agents and employees necessary to carry out the
21duties and purposes of the Abraham Lincoln Presidential Library
22and Museum.
23    (e) Accept, hold, maintain, and administer, as trustee,
24property given in trust for educational or historic purposes
25for the benefit of the people of the State of Illinois and

1dispose of any property under the terms of the instrument
2creating the trust.
3    (f) Accept, hold, maintain, and administer donated
4property of historical significance such as books, papers,
5records, and personal property of any kind, including
6electronic and digital property, pursuant to gifting
7instruments, agreements, or deeds of gift and enter into such
8agreements as may be necessary to carry out the Board's duties
9and responsibilities under this Section.
10    (g) Lease concessions at the Library and Museum. All
11leases, for whatever period, shall be made subject to the
12written approval of the Governor. All concession leases
13extending for a period in excess of 10 years shall contain
14provisions for the Abraham Lincoln Presidential Library and
15Museum to participate, on a percentage basis, in the revenues
16generated by any concession operation.
17    (h) Enforce the laws of the State and the rules of the
18Abraham Lincoln Presidential Library and Museum at the Library
19and Museum.
20    (i) Cooperate with private organizations and agencies of
21the State of Illinois by providing areas and the use of staff
22personnel where feasible for the sale of publications on the
23historic and cultural heritage of the State and craft items
24made by Illinois craftsmen. These sales shall not conflict with
25existing concession agreements. The Board is authorized to
26negotiate and approve agreements with the organizations and

1agencies for a portion of the monies received from sales to be
2returned to the Abraham Lincoln Presidential Library and Museum
3for the furtherance of interpretive and restoration programs.
4    (j) Establish local bank or savings and loan association
5accounts, upon the written authorization of the Executive
6Director, to temporarily hold income received at any of its
7properties. The local accounts established under this
8subsection shall be in the name of the Abraham Lincoln
9Presidential Library and Museum and shall be subject to regular
10audits. The balance in a local bank or savings and loan
11association account shall be forwarded to the Abraham Lincoln
12Presidential Library and Museum for deposit with the State
13Treasurer on Monday of each week if the amount to be deposited
14in a fund exceeds $500.
15    No bank or savings and loan association shall receive
16public funds as permitted by this Section, unless it has
17complied with the requirements established under Section 6 of
18the Public Funds Investment Act.
19    (k) Accept offers of gifts, gratuities, or grants from the
20federal government, its agencies, or offices, or from any
21person, firm, or corporation.
22    (l) Subject to the provisions of the Illinois
23Administrative Procedure Act, make reasonable rules as may be
24necessary to discharge the duties of the Abraham Lincoln
25Presidential Library and Museum.
26    (m) Charge and collect admission fees and rental for access

1to and use of the facilities of the Library and Museum.
2    (n) Operate a restaurant, cafe, or other food serving
3facility at the Museum or lease the operation of such a
4facility under reasonable terms and conditions; and provide
5vending services for food, beverages, or other products deemed
6necessary and proper, consistent with the mission and purposes
7of the Library and Museum.
8    (o) Engage in marketing activities designed to promote the
9Library and Museum. In undertaking these activities, the Board
10may take all necessary steps with respect to products and
11services, including, but not limited to, retail sales,
12wholesale sales, direct marketing, mail order sales, telephone
13sales, advertising and promotion, purchase of product and
14materials inventory, design, printing and manufacturing of new
15products, reproductions, and adaptations, copyright and
16trademark licensing and royalty agreements, and payment of
17applicable taxes. In addition, the Board shall have the
18authority to sell advertising in its publications and printed
19materials.
 
20    Section 20. Administration of the Abraham Lincoln
21Presidential Library and Museum. The Board shall appoint an
22Executive Director of the Abraham Lincoln Presidential Library
23and Museum. The Executive Director shall serve at the pleasure
24of the Board. The Executive Director shall, subject to
25applicable provisions of law, execute and discharge the powers

1and duties of the Abraham Lincoln Presidential Library and
2Museum. The Executive Director shall appoint: (a) a Library
3Facilities Operations Director; and (b) a Director of the
4Library. The Executive Director shall appoint those other
5employees of the Abraham Lincoln Presidential Library and
6Museum and the Illinois State Historical Library as he or she
7deems appropriate and shall fix the compensation of the Library
8Facilities Operations Director, the Director of the Library,
9and other employees. The Executive Director may establish and
10collect admission and registration fees, may operate a gift
11shop, and may publish and sell educational and informational
12materials.
 
13    Section 25. Gifts to the Illinois State Historical Library.
14Those programs, collections, and functions heretofore
15administered by the Illinois State Historical Library or the
16Historical Preservation Agency's Historical Library Division
17shall be administered by the Abraham Lincoln Presidential
18Library and Museum. All gifts made specifically to the Illinois
19State Historical Library or the Historical Preservation
20Agency's Historical Library Division shall remain at all times
21within the Abraham Lincoln Presidential Library and Museum.
 
22    Section 30. Director of the Abraham Lincoln Presidential
23Library; historical collections. The Director of the Library
24may and is hereby required to make all necessary rules,

1regulations, and bylaws not inconsistent with law to carry into
2effect the purposes of this Section in accordance with the
3State Historical Library Act and to procure from time to time
4as may be possible and practicable, at reasonable cost, all
5books, pamphlets, manuscripts, monographs, writings, and other
6material of historical interest and useful to the historian
7bearing upon the political, physical, religious, or social
8history of the State of Illinois from the earliest known period
9of time. The Director of the Library may exchange any books,
10pamphlets, manuscripts, records, or other material which the
11Library may acquire that are of no historical interest or for
12any reason are of no value to it, with any other library,
13school, or historical society. The Director of the Library
14shall distribute volumes of the series known as the Illinois
15Historical Collections now in print, and to be printed, to all
16who may apply for same and who pay to the Library for such
17volumes an amount fixed by the Director sufficient to cover the
18expenses of printing and distribution of each volume received
19by such applicants. However, the Director of the Library shall
20have authority to furnish not to exceed 25 of each of the
21volumes of the Illinois Historical Collections, free of charge,
22to each of the authors and editors of the collections or parts
23thereof; to furnish, as in his or her discretion he or she
24deems necessary or desirable, a reasonable number of each of
25the volumes of the Collections without charge to archives,
26libraries, and similar institutions from which material has

1been drawn or assistance has been given in the preparation of
2such Collections, and to the officials thereof; and to furnish,
3as in his or her discretion he or she deems necessary or
4desirable, a reasonable number of each of the volumes of the
5Collections without charge to the University of Illinois
6Library and to instructors and officials of that University,
7and to public libraries in the State of Illinois. The Director
8of the Library may also make exchanges of Historical
9Collections with any other library, school, or historical
10society, and to distribute volumes of collections for review
11purposes.
 
12    Section 35. Separation from Historic Preservation Agency.
13On the effective date of this Act, all of the powers, duties,
14assets, liabilities, employees, contracts, property, including
15any items formerly contained in the Illinois State Historical
16Library now presently held in the Abraham Lincoln Presidential
17Library and Museum, records, pending business, and unexpended
18appropriations of the Historic Preservation Agency related to
19the administration and enforcement of Sections 17, 32, and 33
20of the Historic Preservation Agency Act (now repealed) are
21transferred to the Abraham Lincoln Presidential Library and
22Museum created under this Act.
23    The status and rights of the transferred employees, and the
24rights of the State of Illinois and its agencies, under the
25Personnel Code and applicable collective bargaining agreements

1or under any pension, retirement, or annuity plan are not
2affected (except as provided in Sections 14-110 and 18-127 of
3the Illinois Pension Code) by that transfer or by any other
4provision of this Act.
 
5    Section 40. The Executive Reorganization Implementation
6Act is amended by changing Section 3.1 as follows:
 
7    (15 ILCS 15/3.1)  (from Ch. 127, par. 1803.1)
8    Sec. 3.1. "Agency directly responsible to the Governor" or
9"agency" means any office, officer, division, or part thereof,
10and any other office, nonelective officer, department,
11division, bureau, board, or commission in the executive branch
12of State government, except that it does not apply to any
13agency whose primary function is service to the General
14Assembly or the Judicial Branch of State government, or to any
15agency administered by the Attorney General, Secretary of
16State, State Comptroller or State Treasurer. In addition the
17term does not apply to the following agencies created by law
18with the primary responsibility of exercising regulatory or
19adjudicatory functions independently of the Governor:
20    (1) the State Board of Elections;
21    (2) the State Board of Education;
22    (3) the Illinois Commerce Commission;
23    (4) the Illinois Workers' Compensation Commission;
24    (5) the Civil Service Commission;

1    (6) the Fair Employment Practices Commission;
2    (7) the Pollution Control Board;
3    (8) the Department of State Police Merit Board;
4    (9) the Illinois Racing Board;

8    Section 45. The Historic Preservation Agency Act is amended
9by changing Sections 2, 4, 5, 5.1, 6, 11, 12, 13, 14, 15, 16,
1022, 30, 31, and 34 as follows:

12    Sec. 2. For the purposes of this Act:
13    (a) "Agency" means the Historic Preservation Agency;
14    (b) "Board" means the Board of Trustees of the Historic
15Preservation Agency;
16    (c) "Director" means the Director of the Historic Sites and
17Preservation Agency;
18    (d) (Blank) "Advisory Board" means the Advisory Board of
19the Lincoln Presidential Library and Museum;
20    (e) (Blank) "Lincoln Presidential Library" means the
21Abraham Lincoln Presidential Library and Museum;
22    (f) (Blank) "Library Director" means the Director of the
23Lincoln Presidential Library; and
24    (g) (Blank). "Historic Sites and Preservation Division"

1means that part of the Agency that is headed by the Director of
2Historic Sites and Preservation.

5    Sec. 4. The Board shall be responsible for setting and
6determining policy for the Agency. The Agency shall consist of:
7(1) an Abraham Lincoln Presidential Library and Museum and (2)
8a Historic Sites and Preservation Division. Except as otherwise
9provided in this Act, any reference in any other Act to the
10Historic Preservation Agency shall be deemed to be a reference
11to the Historic Sites and Preservation Division and any
12reference in any other Act to the Director of Historic
13Preservation shall be deemed to be a reference to the Director
14of the Historic Preservation Agency Sites and Preservation,
15unless the context clearly indicates otherwise.
16    The Board shall appoint a chief executive officer of the
17Agency who shall be known as the Director of the Historic Sites
18and Preservation Agency. The Director shall serve at the
19pleasure of the Board. The Director shall, subject to
20applicable provisions of law, execute the powers and discharge
21the duties vested in the Historic Sites and Preservation
22Division of the Agency by law and implement the policies set by
23the Board. The Director shall manage the Historic Sites and
24Preservation Division of the Agency. The Director, with the
25concurrence of the Board, shall appoint Division Chiefs, if

1needed, and the Deputy Director of the Historic Sites and
2Preservation Division of the Agency. Subject to concurrence by
3the Board, the Director shall appoint such other employees of
4the Historic Sites and Preservation Division of the Agency as
5he or she deems appropriate and shall fix the compensation of
6such Division Chiefs, if any, the Deputy Director, and other
7employees. The Board shall appoint the Illinois State
8Historian, who shall provide historical expertise, support,
9and service to all divisions of the Historic Preservation
10Agency and to all divisions of the Agency, if any. The State
11Historian is the State's authority on Abraham Lincoln and the
12history of Illinois.

7historically significant properties and interests of the
8State.

11    Sec. 14. The Historic Sites and Preservation Division of
12the Agency shall exercise all rights, powers and duties set
13forth in Sections 10-40 through 10-85 of the Property Tax Code.

17the Agency shall exercise all rights, powers and duties vested

20solely as it relates to access to historic sites and memorials
21designated pursuant to this Act.

1    Sec. 16. The Historic Sites and Preservation Division of
2the Agency shall have the following additional powers:
3    (a) To hire agents and employees necessary to carry out the
4duties and purposes of the Historic Sites and Preservation
5Division of the Agency.
6    (b) To take all measures necessary to erect, maintain,
7preserve, restore, and conserve all State Historic Sites and
8State Memorials, except when supervision and maintenance is
9otherwise provided by law. This authorization includes the
10power, with the consent of the Board, to enter into contracts,
11acquire and dispose of real and personal property, and enter
12into leases of real and personal property. The Agency has the
13power to acquire, for purposes authorized by law, any real
14property in fee simple subject to a life estate in the seller
15in not more than 3 acres of the real property acquired, subject
16to the restrictions that the life estate shall be used for
17residential purposes only and that it shall be
18non-transferable.
19    (c) To provide recreational facilities including camp
20sites, lodges and cabins, trails, picnic areas and related
21recreational facilities at all sites under the jurisdiction of
22the Agency.
23    (d) To lay out, construct and maintain all needful roads,
24parking areas, paths or trails, bridges, camp or lodge sites,
25picnic areas, lodges and cabins, and any other structures and
26improvements necessary and appropriate in any State historic

1site or easement thereto; and to provide water supplies, heat
2and light, and sanitary facilities for the public and living
3quarters for the custodians and keepers of State historic
4sites.
5    (e) To grant licenses and rights-of-way within the areas
6controlled by the Historic Sites and Preservation Division of
7the Agency for the construction, operation and maintenance
8upon, under or across the property, of facilities for water,
9sewage, telephone, telegraph, electric, gas, or other public
10service, subject to the terms and conditions as may be
11determined by the Agency.
12    (f) To authorize the officers, employees and agents of the
13Historic Sites and Preservation Division of the Agency, for the
14purposes of investigation and to exercise the rights, powers,
15and duties vested and that may be vested in it, to enter and
16cross all lands and waters in this State, doing no damage to
17private property.
18    (g) To transfer jurisdiction of or exchange any realty
19under the control of the Historic Sites and Preservation
20Division of the Agency to any other Department of the State
21Government, or to any agency of the Federal Government, or to
22acquire or accept Federal lands, when any transfer, exchange,
23acquisition or acceptance is advantageous to the State and is
24approved in writing by the Governor.
25    (h) To erect, supervise, and maintain all public monuments
26and memorials erected by the State, except when the supervision

1and maintenance of public monuments and memorials is otherwise
2provided by law.
3    (i) To accept, hold, maintain, and administer, as trustee,
4property given in trust for educational or historic purposes
5for the benefit of the People of the State of Illinois and to
6dispose, with the consent of the Board, of any property under
7the terms of the instrument creating the trust.
8    (j) To lease concessions on any property under the
9jurisdiction of the Agency for a period not exceeding 25 years
10and to lease a concession complex at Lincoln's New Salem State
11Historic Site for which a cash incentive has been authorized
12under Section 5.1 of the Historic Preservation Agency Act for a
13period not to exceed 40 years. All leases, for whatever period,
14shall be made subject to the written approval of the Governor.
15All concession leases extending for a period in excess of 10
16years, will contain provisions for the Agency to participate,
17on a percentage basis, in the revenues generated by any
18concession operation.
19    The Agency is authorized to allow for provisions for a
20reserve account and a leasehold account within Agency
21concession lease agreements for the purpose of setting aside
22revenues for the maintenance, rehabilitation, repair,
23improvement, and replacement of the concession facility,
24structure, and equipment of the Agency that are part of the
25leased premises.
26    The lessee shall be required to pay into the reserve

1account a percentage of gross receipts, as set forth in the
2lease, to be set aside and expended in a manner acceptable to
3the Agency by the concession lessee for the purpose of ensuring
4that an appropriate amount of the lessee's moneys are provided
5by the lessee to satisfy the lessee's incurred responsibilities
6for the operation of the concession facility under the terms
7and conditions of the concession lease.
8    The lessee account shall allow for the amortization of
9certain authorized expenses that are incurred by the concession
10lessee but that are not an obligation of the lessee under the
11terms and conditions of the lease agreement. The Agency may
12allow a reduction of up to 50% of the monthly rent due for the
13purpose of enabling the recoupment of the lessee's authorized
14expenditures during the term of the lease.
15    (k) To sell surplus agricultural products grown on land
16owned by or under the jurisdiction of the Historic Sites and
17Preservation Division of the Agency, when the products cannot
18be used by the Agency.
19    (l) To enforce the laws of the State and the rules and
20regulations of the Agency in or on any lands owned, leased, or
21managed by the Historic Sites and Preservation Division of the
22Agency.
23    (m) To cooperate with private organizations and agencies of
24the State of Illinois by providing areas and the use of staff
25personnel where feasible for the sale of publications on the
26historic and cultural heritage of the State and craft items

1made by Illinois craftsmen. These sales shall not conflict with
2existing concession agreements. The Historic Sites and
3Preservation Division of the Agency is authorized to negotiate
4with the organizations and agencies for a portion of the monies
5received from sales to be returned to the Historic Sites and
6Preservation Division of the Agency's Historic Sites Fund for
7the furtherance of interpretive and restoration programs.
8    (n) To establish local bank or savings and loan association
9accounts, upon the written authorization of the Director, to
10temporarily hold income received at any of its properties. The
11local accounts established under this Section shall be in the
12name of the Historic Preservation Agency and shall be subject
13to regular audits. The balance in a local bank or savings and
14loan association account shall be forwarded to the Agency for
15deposit with the State Treasurer on Monday of each week if the
16amount to be deposited in a fund exceeds $500.
17    No bank or savings and loan association shall receive
18public funds as permitted by this Section, unless it has
19complied with the requirements established under Section 6 of
20the Public Funds Investment Act.
21    (o) To accept, with the consent of the Board, offers of
22gifts, gratuities, or grants from the federal government, its
23agencies, or offices, or from any person, firm, or corporation.
24    (p) To make reasonable rules and regulations as may be
25necessary to discharge the duties of the Agency.
26    (q) With appropriate cultural organizations, to further

1and advance the goals of the Agency.
2    (r) To make grants for the purposes of planning, survey,
3rehabilitation, restoration, reconstruction, landscaping, and
4acquisition of Illinois properties (i) designated individually
5in the National Register of Historic Places, (ii) designated as
6a landmark under a county or municipal landmark ordinance, or
7(iii) located within a National Register of Historic Places
8historic district or a locally designated historic district
9when the Director determines that the property is of historic
10significance whenever an appropriation is made therefor by the
11General Assembly or whenever gifts or grants are received for
12that purpose and to promulgate regulations as may be necessary
13or desirable to carry out the purposes of the grants.
14    Grantees may, as prescribed by rule, be required to provide
15matching funds for each grant. Grants made under this
16subsection shall be known as Illinois Heritage Grants.
17    Every owner of a historic property, or the owner's agent,
18is eligible to apply for a grant under this subsection.
19    (s) To establish and implement a pilot program for charging
20admission to State historic sites. Fees may be charged for
21special events, admissions, and parking or any combination;
22fees may be charged at all sites or selected sites. All fees
23shall be deposited into the Illinois Historic Sites Fund. The
24Historic Sites and Preservation Division of the Agency shall
25have the discretion to set and adjust reasonable fees at the
26various sites, taking into consideration various factors

1including but not limited to: cost of services furnished to
2each visitor, impact of fees on attendance and tourism and the
3costs expended collecting the fees. The Agency shall keep
4careful records of the income and expenses resulting from the
5imposition of fees, shall keep records as to the attendance at
6each historic site, and shall report to the Governor and
7General Assembly by January 31 after the close of each year.
8The report shall include information on costs, expenses,
9attendance, comments by visitors, and any other information the
10Agency may believe pertinent, including:
11        (1) Recommendations as to whether fees should be
12    continued at each State historic site.
13        (2) How the fees should be structured and imposed.
14        (3) Estimates of revenues and expenses associated with
15    each site.
16    (t) To provide for overnight tent and trailer campsites and
17to provide suitable housing facilities for student and juvenile
18overnight camping groups. The Historic Sites and Preservation
19Division of the Agency shall charge rates similar to those
20charged by the Department of Conservation for the same or
21similar facilities and services.
22    (u) To engage in marketing activities designed to promote
23the sites and programs administered by the Agency. In
24undertaking these activities, the Agency may take all necessary
25steps with respect to products and services, including but not
26limited to retail sales, wholesale sales, direct marketing,

1mail order sales, telephone sales, advertising and promotion,
2purchase of product and materials inventory, design, printing
3and manufacturing of new products, reproductions, and
4adaptations, copyright and trademark licensing and royalty
5agreements, and payment of applicable taxes. In addition, the
6Agency shall have the authority to sell advertising in its
7publications and printed materials. All income from marketing
8activities shall be deposited into the Illinois Historic Sites
9Fund.

12    Sec. 22. Amistad Commission.
13    (a) Purpose. The General Assembly finds and declares that
14all people should know of and remember the human carnage and
15dehumanizing atrocities committed during the period of the
16African slave trade and slavery in America and of the vestiges
17of slavery in this country; and it is in fact vital to educate
18our citizens on these events, the legacy of slavery, the sad
19history of racism in this country, and the principles of human
20rights and dignity in a civilized society.
21    It is the policy of the State of Illinois that the history
22of the African slave trade, slavery in America, the depth of
23their impact in our society, and the triumphs of
24African-Americans and their significant contributions to the
25development of this country is the proper concern of all

1people, particularly students enrolled in the schools of the
2State of Illinois.
3    It is therefore desirable to create a Commission that, as
4an organized body and on a continuous basis, will survey,
5design, encourage, and promote the implementation of education
6and awareness programs in Illinois that are concerned with the
7African slave trade, slavery in America, the vestiges of
8slavery in this country, and the contributions of
9African-Americans in building our country; to develop
10workshops, institutes, seminars, and other teacher training
11activities designed to educate teachers on this subject matter;
12and that will be responsible for the coordination of events on
13a regular basis, throughout the State, that provide appropriate
14memorialization of the events concerning the enslavement of
15Africans and their descendants in America and their struggle
16for freedom, liberty, and equality.
17    (b) Amistad Commission. The Amistad Commission is created
18within the Agency. The Commission is named to honor the group
19of enslaved Africans transported in 1839 on a vessel named the
20Amistad who overthrew their captors and created an
21international incident that was eventually argued before the
22Supreme Court and that shed a growing light on the evils of the
23slave trade and galvanized a growing abolitionist movement
24towards demanding the end of slavery in the United States.
25    (c) Membership. The Commission shall consist of 15 members,
26including 3 ex officio members: the State Superintendent of

1Education or his or her designee, the Director of Commerce and
2Economic Opportunity or his or her designee, and the Director
3of the Historic Sites and Preservation Agency or his or her
4designee; and 12 public members. Public members shall be
5appointed as follows:
6        (i) 2 members appointed by the President of the Senate
7    and one member appointed by the Minority Leader of the
8    Senate;
9        (ii) 2 members appointed by the Speaker of the House of
10    Representatives and one member appointed by the Minority
11    Leader of the House of Representatives; and
12        (iii) 6 members, no more than 4 of whom shall be of the
13    same political party, appointed by the Governor.
14    The public members shall be residents of this State, chosen
15with due regard to broad geographic representation and ethnic
16diversity, who have served actively in organizations that
17educate the public on the history of the African slave trade,
18the contributions of African-Americans to our society, and
19civil rights issues.
20    Each public member of the Commission shall serve for a term
21of 3 years, except that of the initial members so appointed:
22one member appointed by the President of the Senate, one member
23appointed by the Speaker of the House of Representatives, and 2
24members appointed by the Governor shall serve for terms of one
25year; the member appointed by the Minority Leader of the
26Senate, one member appointed by the Speaker of the House of

1Representatives, and 2 members appointed by the Governor shall
2serve for terms of 2 years; and one member appointed by the
3President of the Senate, the member appointed by the Minority
4Leader of the House of Representatives, and 2 members appointed
5by the Governor shall serve for terms of 3 years. Public
6members shall be eligible for reappointment. They shall serve
7until their successors are appointed and qualified, and the
8term of the successor of any incumbent shall be calculated from
9the expiration of the term of that incumbent. A vacancy
10occurring other than by expiration of term shall be filled in
11the same manner as the original appointment, but for the
12unexpired term only.
13    (d) Election of chairperson; meetings. At its first meeting
14and annually thereafter, the Commission shall elect from among
15its members a chairperson and other officers it considers
16necessary or appropriate. After its first meeting, the
17Commission shall meet at least quarterly, or more frequently at
18the call of the chairperson or if requested by 9 or more
19members.
20    (e) Quorum. A majority of the members of the Commission
21constitute a quorum for the transaction of business at a
22meeting of the Commission. A majority of the members present
23and serving is required for official action of the Commission.
24    (f) Public meeting. All business that the Commission is
25authorized to perform shall be conducted at a public meeting of
26the Commission, held in compliance with the Open Meetings Act.

1    (g) Freedom of Information. A writing prepared, owned,
2used, in the possession of, or retained by the Commission in
3the performance of an official function is subject to the
4Freedom of Information Act.
5    (h) Compensation. The members of the Commission shall serve
6without compensation, but shall be entitled to reimbursement
7for all necessary expenses incurred in the performance of their
8official duties as members of the Commission from funds
9appropriated for that purpose. Reimbursement for travel,
10meals, and lodging shall be in accordance with the rules of the
11Governor's Travel Control Board.
12    (i) Duties. The Commission shall have the following
13responsibilities and duties:
14        (1) To provide, based upon the collective interest of
15    the members and the knowledge and experience of the
16    members, assistance and advice to schools within the State
17    with respect to the implementation of education, awareness
18    programs, textbooks, and educational materials concerned
19    with the African slave trade, slavery in America, the
20    vestiges of slavery in this country, and the contributions
21    of African-Americans to our society.
22        (2) To survey and catalog the extent and breadth of
23    education concerning the African slave trade, slavery in
24    America, the vestiges of slavery in this country, and the
25    contributions of African-Americans to our society
26    presently being incorporated into the curricula and

1    textbooks and taught in the school systems of the State; to
2    inventory those African slave trade, American slavery, or
3    relevant African-American history memorials, exhibits, and
4    resources that should be incorporated into courses of study
5    at educational institutions, schools, and various other
6    locations throughout the State; and to assist the State
7    Board of Education and other State and educational agencies
8    in the development and implementation of African slave
9    trade, American slavery, and African-American history
10    education programs.
11        (3) To act as a liaison with textbook publishers,
12    schools, public, private, and nonprofit resource
13    organizations, and members of the United States Senate and
14    House of Representatives and the Illinois Senate and House
15    of Representatives in order to facilitate the inclusion of
16    the history of African slavery and of African-Americans in
17    this country in the curricula of public and nonpublic
18    schools.
19        (4) To compile a roster of individual volunteers who
20    are willing to share their knowledge and experience in
21    classrooms, seminars, and workshops with students and
22    teachers on the subject of the African slave trade,
23    American slavery, the impact of slavery on our society
24    today, and the contributions of African-Americans to our
25    country.
26        (5) To coordinate events memorializing the African

1    slave trade, American slavery, and the history of
2    African-Americans in this country that reflect the
3    contributions of African-Americans in overcoming the
4    burdens of slavery and its vestiges, and to seek volunteers
5    who are willing and able to participate in commemorative
6    events that will enhance student awareness of the
7    significance of the African slave trade, American slavery,
8    its historical impact, and the struggle for freedom.
9        (6) To prepare reports for the Governor and the General
10    Assembly regarding its findings and recommendations on
11    facilitating the inclusion of the African slave trade,
12    American slavery studies, African-American history, and
13    special programs in the educational system of the State.
14        (7) To develop, in consultation with the State Board of
15    Education, curriculum guidelines that will be made
16    available to every school board for the teaching of
17    information on the African slave trade, slavery in America,
18    the vestiges of slavery in this country, and the
19    contributions of African-Americans to our country.
20        (8) To solicit, receive, and accept appropriations,
21    gifts, and donations for Commission operations and
22    programs authorized under this Section.
23    (j) Commission requests for assistance. The Commission is
24authorized to call upon any department, office, division, or
25agency of the State, or of any county, municipality, or school
26district of the State, to supply such data, program reports,

1and other information, appropriate school personnel, and
2assistance as it deems necessary to discharge its
3responsibilities under this Act. These departments, offices,
4divisions, and agencies shall, to the extent possible and not
5inconsistent with any other law of this State, cooperate with
6the Commission and shall furnish it with such information,
7appropriate school personnel, and assistance as may be
8necessary or helpful to accomplish the purposes of this Act.
9    (k) State Board of Education assistance. The State Board of
10Education shall:
11        (1) Assist the Amistad Commission in marketing and
12    distributing to educators, administrators, and school
13    districts in the State educational information and other
14    materials on the African slave trade, slavery in America,
15    the vestiges of slavery in this country, and the
16    contributions of African-Americans to our society.
17        (2) Conduct at least one teacher workshop annually on
18    the African slave trade, slavery in America, the vestiges
19    of slavery in this country, and the contributions of
20    African-Americans to our society.
21        (3) Assist the Amistad Commission in monitoring the
22    inclusion of slavery materials and curricula in the State's
23    educational system.
24        (4) Consult with the Amistad Commission to determine
25    ways it may survey, catalog, and extend slave trade and
26    American slavery education presently being taught in the

1    State's educational system.
2    The State Board of Education may, subject to the
3availability of appropriations, hire additional staff and
4consultants to carry out the duties and responsibilities
5provided within this subsection (k).
6    (l) Report. The Commission shall report its activities and
7findings, as required under subsection (i), to the Governor and
8General Assembly on or before June 30, 2006, and biannually
9thereafter.

12    Sec. 30. Board Library; Board; Foundation. There is
13established within the Historic Preservation Agency the
14Abraham Lincoln Presidential Library and Museum. There shall be
15a Board an Advisory Board of the Abraham Lincoln Presidential
16Library and Museum to advise the Lincoln Presidential Library
17and the Library Director on programs related to the Lincoln
18Presidential Library and to exercise the powers and duties
19given to it under the Abraham Lincoln Presidential Library and
20Museum Act. The Lincoln Presidential Library and the Abraham
21Lincoln Presidential Library Foundation shall mutually
22co-operate to maximize resources available to the Lincoln
23Presidential Library and to support, sustain, and provide
24educational programs and collections at the Lincoln
25Presidential Library.

3    Sec. 31. Board Advisory Board. The Advisory Board of the
4Abraham Lincoln Presidential Library and Museum shall consist
5of 11 members to be appointed by the Governor, with the advice
6and consent of the Senate. Each of these members shall have
7recognized knowledge and ability in matters relating to
8history, research, cultural institutions, archives, libraries,
9business, or education. The terms of office of these members
10shall be 6 years, except that the terms of office of the
11initial members shall commence from the effective date of this
12Article and run as follows, as designated by the Governor: one
13for a term expiring December 31, 2003, 2 for terms expiring
14December 31, 2004, 2 for terms expiring December 31, 2005, 2
15for terms expiring December 31, 2006, 2 for terms expiring
16December 31, 2007, and 2 for terms expiring December 31, 2008.
17The Governor shall appoint one of the members as Chair to serve
18at the pleasure of the Governor.

21    Sec. 34. Internal Auditor. There is created the Office of
22the Internal Auditor of the Historic Preservation Agency. The
23Internal Auditor shall be appointed by the Board, shall serve
24at the pleasure of the Board, and shall report to the Board.

1The Internal Auditor shall audit and maintain the financial
2books, records, papers, and transactions of the Lincoln
3Presidential Library and the Historic Sites and Preservation
4Division of the Historic Preservation Agency. The Internal
5Auditor shall prepare an annual report for each fiscal year of
6the operations of the Historic Preservation Agency, which shall
7be submitted to the Board, the General Assembly, and the
8Governor. Nothing in this Section shall abridge the authority
9of the Illinois Auditor General to independently audit the
10Illinois Historic Preservation Agency or any of the libraries,
11divisions, or offices contained within the Agency.

13    Section 50. The Illinois Historic Preservation Act is
14amended by changing Section 3 as follows:

16    Sec. 3. There is recognized and established hereunder the
17Illinois Historic Sites Advisory Council, previously
18established pursuant to Federal regulations, hereafter called
19the Council. The Council shall consist of 15 members. Of these,
20there shall be at least 3 historians, at least 3 architectural
21historians, or architects with a preservation background, and
22at least 3 archeologists. The remaining 6 members shall be
23drawn from supporting fields and have a preservation interest.
24Supporting fields shall include but not be limited to

1historical geography, law, urban planning, local government
2officials, and members of other preservation commissions. All
3shall be appointed by the Director of Historic Sites and
4Preservation, with the consent of the Board.
5    The Council Chairperson shall be appointed by the Director
6of the Historic Preservation Agency Sites and Preservation from
7the Council membership and shall serve at the Director's
8pleasure.
9    The Executive Director of the Abraham Lincoln Presidential
10Library and Museum and the Director of the Illinois State
11Museum shall serve on the Council in advisory capacity as
12non-voting members.
13    Terms of membership shall be 3 years and shall be staggered
14by the Director to assure continuity of representation.
15    The Council shall meet at least 3 times each year.
16Additional meetings may be held at the call of the chairperson
17or at the call of the Director.
18    Members shall serve without compensation, but shall be
19reimbursed for actual expenses incurred in the performance of
20their duties.

1    Sec. 5.1. The State Historian shall establish and supervise
2a program within the Abraham Lincoln Presidential Library
3designed to preserve as historical records selected past
4editions of newspapers of this State. Such editions shall be
5microphotographed. The negatives of such microphotographs
6shall be stored in a place provided by the Abraham Lincoln
7Presidential Library.
8    The State Historian shall determine on the basis of
9historical value the various newspaper edition files which
10shall be microphotographed and shall arrange a schedule for
11such microphotographing. The State Historian shall supervise
12the making of arrangements for acquiring access to past edition
13files with the editors or publishers of the various newspapers.
14    The method of microphotography to be employed in this
15program shall conform to the standards established pursuant to
16Section 17 of "The State Records Act", approved July 6, 1957.
17    Upon payment to the Abraham Lincoln Presidential Library of
18the required fee, any person or organization shall be supplied
19with any prints requested to be made from the negatives of the
20microphotographs. The fee required shall be determined by the
21State Historian and shall be equal in amount to the cost
22incurred by the Lincoln Presidential Library in supplying the
23requested prints.

1    Section 70. The Illinois Municipal Code is amended by
2changing Section 11-48-1 as follows:
 
3    (65 ILCS 5/11-48-1)  (from Ch. 24, par. 11-48-1)
4    Sec. 11-48-1. The city council or board of trustees of
5every city, incorporated town or village may, by order or
6resolution authorize and direct to be transferred to the
7Abraham Lincoln Presidential Library and Museum, the State
8Archives or to the State University Library at Urbana,
9Illinois, or to any historical society duly incorporated and
10located within their respective counties, such official
11papers, drawings, maps, writings and records of every
12description as may be deemed of historic interest or value, and
13as may be in the custody of any officer of such county, city,
14incorporated town or village. Accurate copies of the same when
15so transferred shall be substituted for the original when in
16the judgment of such city council or board of trustees the same
17may be deemed necessary.

22    Sec. 6-15. No alcoholic liquors shall be sold or delivered

1in any building belonging to or under the control of the State
2or any political subdivision thereof except as provided in this
3Act. The corporate authorities of any city, village,
4incorporated town, township, or county may provide by
5ordinance, however, that alcoholic liquor may be sold or
6delivered in any specifically designated building belonging to
7or under the control of the municipality, township, or county,
8or in any building located on land under the control of the
9municipality, township, or county; provided that such township
10or county complies with all applicable local ordinances in any
11incorporated area of the township or county. Alcoholic liquor
12may be delivered to and sold under the authority of a special
13use permit on any property owned by a conservation district
14organized under the Conservation District Act, provided that
15(i) the alcoholic liquor is sold only at an event authorized by
16the governing board of the conservation district, (ii) the
17issuance of the special use permit is authorized by the local
18liquor control commissioner of the territory in which the
19property is located, and (iii) the special use permit
20authorizes the sale of alcoholic liquor for one day or less.
21Alcoholic liquors may be delivered to and sold at any airport
22belonging to or under the control of a municipality of more
23than 25,000 inhabitants, or in any building or on any golf
24course owned by a park district organized under the Park
25District Code, subject to the approval of the governing board
26of the district, or in any building or on any golf course owned

1by a forest preserve district organized under the Downstate
2Forest Preserve District Act, subject to the approval of the
3governing board of the district, or on the grounds within 500
4feet of any building owned by a forest preserve district

6during times when food is dispensed for consumption within 500
7feet of the building from which the food is dispensed, subject
8to the approval of the governing board of the district, or in a
9building owned by a Local Mass Transit District organized under
10the Local Mass Transit District Act, subject to the approval of
11the governing Board of the District, or in Bicentennial Park,
12or on the premises of the City of Mendota Lake Park located
13adjacent to Route 51 in Mendota, Illinois, or on the premises
14of Camden Park in Milan, Illinois, or in the community center
15owned by the City of Loves Park that is located at 1000 River
16Park Drive in Loves Park, Illinois, or, in connection with the
17operation of an established food serving facility during times
18when food is dispensed for consumption on the premises, and at
19the following aquarium and museums located in public parks: Art
20Institute of Chicago, Chicago Academy of Sciences, Chicago
21Historical Society, Field Museum of Natural History, Museum of
22Science and Industry, DuSable Museum of African American
23History, John G. Shedd Aquarium and Adler Planetarium, or at
24Lakeview Museum of Arts and Sciences in Peoria, or in
25connection with the operation of the facilities of the Chicago
26Zoological Society or the Chicago Horticultural Society on land

1owned by the Forest Preserve District of Cook County, or on any
2land used for a golf course or for recreational purposes owned
3by the Forest Preserve District of Cook County, subject to the
4control of the Forest Preserve District Board of Commissioners
5and applicable local law, provided that dram shop liability
6insurance is provided at maximum coverage limits so as to hold
7the District harmless from all financial loss, damage, and
8harm, or in any building located on land owned by the Chicago
9Park District if approved by the Park District Commissioners,
10or on any land used for a golf course or for recreational
11purposes and owned by the Illinois International Port District
12if approved by the District's governing board, or at any
13airport, golf course, faculty center, or facility in which
14conference and convention type activities take place belonging
15to or under control of any State university or public community
16college district, provided that with respect to a facility for
17conference and convention type activities alcoholic liquors
18shall be limited to the use of the convention or conference
19participants or participants in cultural, political or
20educational activities held in such facilities, and provided
21further that the faculty or staff of the State university or a
22public community college district, or members of an
23organization of students, alumni, faculty or staff of the State
24university or a public community college district are active
25participants in the conference or convention, or in Memorial
26Stadium on the campus of the University of Illinois at

1Urbana-Champaign during games in which the Chicago Bears
2professional football team is playing in that stadium during
3the renovation of Soldier Field, not more than one and a half
4hours before the start of the game and not after the end of the
5third quarter of the game, or in the Pavilion Facility on the
6campus of the University of Illinois at Chicago during games in
7which the Chicago Storm professional soccer team is playing in
8that facility, not more than one and a half hours before the
9start of the game and not after the end of the third quarter of
10the game, or in the Pavilion Facility on the campus of the
11University of Illinois at Chicago during games in which the
12WNBA professional women's basketball team is playing in that
13facility, not more than one and a half hours before the start
14of the game and not after the 10-minute mark of the second half
15of the game, or by a catering establishment which has rented
16facilities from a board of trustees of a public community
17college district, or in a restaurant that is operated by a
18commercial tenant in the North Campus Parking Deck building
19that (1) is located at 1201 West University Avenue, Urbana,
20Illinois and (2) is owned by the Board of Trustees of the
21University of Illinois, or, if approved by the District board,
22on land owned by the Metropolitan Sanitary District of Greater
23Chicago and leased to others for a term of at least 20 years.
24Nothing in this Section precludes the sale or delivery of
25alcoholic liquor in the form of original packaged goods in
26premises located at 500 S. Racine in Chicago belonging to the

1University of Illinois and used primarily as a grocery store by
2a commercial tenant during the term of a lease that predates
3the University's acquisition of the premises; but the
4University shall have no power or authority to renew, transfer,
5or extend the lease with terms allowing the sale of alcoholic
6liquor; and the sale of alcoholic liquor shall be subject to
7all local laws and regulations. After the acquisition by
8Winnebago County of the property located at 404 Elm Street in
9Rockford, a commercial tenant who sold alcoholic liquor at
10retail on a portion of the property under a valid license at
11the time of the acquisition may continue to do so for so long
12as the tenant and the County may agree under existing or future
13leases, subject to all local laws and regulations regarding the
14sale of alcoholic liquor. Alcoholic liquors may be delivered to
15and sold at Memorial Hall, located at 211 North Main Street,
16Rockford, under conditions approved by Winnebago County and
17subject to all local laws and regulations regarding the sale of
18alcoholic liquor. Each facility shall provide dram shop
19liability in maximum insurance coverage limits so as to save
20harmless the State, municipality, State university, airport,
21golf course, faculty center, facility in which conference and
22convention type activities take place, park district, Forest
23Preserve District, public community college district,
24aquarium, museum, or sanitary district from all financial loss,
25damage or harm. Alcoholic liquors may be sold at retail in
26buildings of golf courses owned by municipalities or Illinois

1State University in connection with the operation of an
2established food serving facility during times when food is
3dispensed for consumption upon the premises. Alcoholic liquors
4may be delivered to and sold at retail in any building owned by
5a fire protection district organized under the Fire Protection
6District Act, provided that such delivery and sale is approved
7by the board of trustees of the district, and provided further
8that such delivery and sale is limited to fundraising events
9and to a maximum of 6 events per year. However, the limitation
10to fundraising events and to a maximum of 6 events per year
11does not apply to the delivery, sale, or manufacture of
12alcoholic liquors at the building located at 59 Main Street in
13Oswego, Illinois, owned by the Oswego Fire Protection District
14if the alcoholic liquor is sold or dispensed as approved by the
15Oswego Fire Protection District and the property is no longer
16being utilized for fire protection purposes.
17    Alcoholic liquors may be served or sold in buildings under
18the control of the Board of Trustees of the University of
19Illinois for events that the Board may determine are public
20events and not related student activities. The Board of
21Trustees shall issue a written policy within 6 months of the
22effective date of this amendatory Act of the 95th General
23Assembly concerning the types of events that would be eligible
24for an exemption. Thereafter, the Board of Trustees may issue
25revised, updated, new, or amended policies as it deems
26necessary and appropriate. In preparing its written policy, the

1Board of Trustees shall, among other factors it considers
2relevant and important, give consideration to the following:
3(i) whether the event is a student activity or student related
4activity; (ii) whether the physical setting of the event is
5conducive to control of liquor sales and distribution; (iii)
6the ability of the event operator to ensure that the sale or
7serving of alcoholic liquors and the demeanor of the
8participants are in accordance with State law and University
9policies; (iv) regarding the anticipated attendees at the
10event, the relative proportion of individuals under the age of
1121 to individuals age 21 or older; (v) the ability of the venue
12operator to prevent the sale or distribution of alcoholic
13liquors to individuals under the age of 21; (vi) whether the
14event prohibits participants from removing alcoholic beverages
15from the venue; and (vii) whether the event prohibits
16participants from providing their own alcoholic liquors to the
17venue. In addition, any policy submitted by the Board of
18Trustees to the Illinois Liquor Control Commission must require
19that any event at which alcoholic liquors are served or sold in
20buildings under the control of the Board of Trustees shall
21require the prior written approval of the Office of the
22Chancellor for the University campus where the event is
23located. The Board of Trustees shall submit its policy, and any
24subsequently revised, updated, new, or amended policies, to the
25Illinois Liquor Control Commission, and any University event,
26or location for an event, exempted under such policies shall

1apply for a license under the applicable Sections of this Act.
2    Alcoholic liquors may be served or sold in buildings under
3the control of the Board of Trustees of Northern Illinois
4University for events that the Board may determine are public
5events and not student-related activities. The Board of
6Trustees shall issue a written policy within 6 months after
7June 28, 2011 (the effective date of Public Act 97-45)
8concerning the types of events that would be eligible for an
9exemption. Thereafter, the Board of Trustees may issue revised,
10updated, new, or amended policies as it deems necessary and
11appropriate. In preparing its written policy, the Board of
12Trustees shall, in addition to other factors it considers
13relevant and important, give consideration to the following:
14(i) whether the event is a student activity or student-related
15activity; (ii) whether the physical setting of the event is
16conducive to control of liquor sales and distribution; (iii)
17the ability of the event operator to ensure that the sale or
18serving of alcoholic liquors and the demeanor of the
19participants are in accordance with State law and University
20policies; (iv) the anticipated attendees at the event and the
21relative proportion of individuals under the age of 21 to
22individuals age 21 or older; (v) the ability of the venue
23operator to prevent the sale or distribution of alcoholic
24liquors to individuals under the age of 21; (vi) whether the
25event prohibits participants from removing alcoholic beverages
26from the venue; and (vii) whether the event prohibits

1participants from providing their own alcoholic liquors to the
2venue.
3    Alcoholic liquors may be served or sold in buildings under
4the control of the Board of Trustees of Chicago State
5University for events that the Board may determine are public
6events and not student-related activities. The Board of
7Trustees shall issue a written policy within 6 months after
8August 2, 2013 (the effective date of Public Act 98-132)
9concerning the types of events that would be eligible for an
10exemption. Thereafter, the Board of Trustees may issue revised,
11updated, new, or amended policies as it deems necessary and
12appropriate. In preparing its written policy, the Board of
13Trustees shall, in addition to other factors it considers
14relevant and important, give consideration to the following:
15(i) whether the event is a student activity or student-related
16activity; (ii) whether the physical setting of the event is
17conducive to control of liquor sales and distribution; (iii)
18the ability of the event operator to ensure that the sale or
19serving of alcoholic liquors and the demeanor of the
20participants are in accordance with State law and University
21policies; (iv) the anticipated attendees at the event and the
22relative proportion of individuals under the age of 21 to
23individuals age 21 or older; (v) the ability of the venue
24operator to prevent the sale or distribution of alcoholic
25liquors to individuals under the age of 21; (vi) whether the
26event prohibits participants from removing alcoholic beverages

1from the venue; and (vii) whether the event prohibits
2participants from providing their own alcoholic liquors to the
3venue.
4    Alcoholic liquors may be served or sold in buildings under
5the control of the Board of Trustees of Illinois State
6University for events that the Board may determine are public
7events and not student-related activities. The Board of
8Trustees shall issue a written policy within 6 months after the
9effective date of this amendatory Act of the 97th General
10Assembly concerning the types of events that would be eligible
11for an exemption. Thereafter, the Board of Trustees may issue
12revised, updated, new, or amended policies as it deems
13necessary and appropriate. In preparing its written policy, the
14Board of Trustees shall, in addition to other factors it
15considers relevant and important, give consideration to the
16following: (i) whether the event is a student activity or
17student-related activity; (ii) whether the physical setting of
18the event is conducive to control of liquor sales and
19distribution; (iii) the ability of the event operator to ensure
20that the sale or serving of alcoholic liquors and the demeanor
21of the participants are in accordance with State law and
22University policies; (iv) the anticipated attendees at the
23event and the relative proportion of individuals under the age
24of 21 to individuals age 21 or older; (v) the ability of the
25venue operator to prevent the sale or distribution of alcoholic
26liquors to individuals under the age of 21; (vi) whether the

1event prohibits participants from removing alcoholic beverages
2from the venue; and (vii) whether the event prohibits
3participants from providing their own alcoholic liquors to the
4venue.
5    Alcoholic liquor may be delivered to and sold at retail in
6the Dorchester Senior Business Center owned by the Village of
7Dolton if the alcoholic liquor is sold or dispensed only in
8connection with organized functions for which the planned
9attendance is 20 or more persons, and if the person or facility
10selling or dispensing the alcoholic liquor has provided dram
11shop liability insurance in maximum limits so as to hold
12harmless the Village of Dolton and the State from all financial
13loss, damage and harm.
14    Alcoholic liquors may be delivered to and sold at retail in
15any building used as an Illinois State Armory provided:
16        (i) the Adjutant General's written consent to the
17    issuance of a license to sell alcoholic liquor in such
18    building is filed with the Commission;
19        (ii) the alcoholic liquor is sold or dispensed only in
20    connection with organized functions held on special
21    occasions;
22        (iii) the organized function is one for which the
23    planned attendance is 25 or more persons; and
24        (iv) the facility selling or dispensing the alcoholic
25    liquors has provided dram shop liability insurance in
26    maximum limits so as to save harmless the facility and the

1    State from all financial loss, damage or harm.
2    Alcoholic liquors may be delivered to and sold at retail in
3the Chicago Civic Center, provided that:
4        (i) the written consent of the Public Building
5    Commission which administers the Chicago Civic Center is
6    filed with the Commission;
7        (ii) the alcoholic liquor is sold or dispensed only in
8    connection with organized functions held on special
9    occasions;
10        (iii) the organized function is one for which the
11    planned attendance is 25 or more persons;
12        (iv) the facility selling or dispensing the alcoholic
13    liquors has provided dram shop liability insurance in
14    maximum limits so as to hold harmless the Civic Center, the
15    City of Chicago and the State from all financial loss,
16    damage or harm; and
17        (v) all applicable local ordinances are complied with.
18    Alcoholic liquors may be delivered or sold in any building
19belonging to or under the control of any city, village or
20incorporated town where more than 75% of the physical
21properties of the building is used for commercial or
22recreational purposes, and the building is located upon a pier
23extending into or over the waters of a navigable lake or stream
24or on the shore of a navigable lake or stream. In accordance
25with a license issued under this Act, alcoholic liquor may be
26sold, served, or delivered in buildings and facilities under

1the control of the Department of Natural Resources during
2events or activities lasting no more than 7 continuous days
3upon the written approval of the Director of Natural Resources
4acting as the controlling government authority. The Director of
5Natural Resources may specify conditions on that approval,
6including but not limited to requirements for insurance and
7hours of operation. Notwithstanding any other provision of this
8Act, alcoholic liquor sold by a United States Army Corps of
9Engineers or Department of Natural Resources concessionaire
10who was operating on June 1, 1991 for on-premises consumption
11only is not subject to the provisions of Articles IV and IX.
12Beer and wine may be sold on the premises of the Joliet Park
13District Stadium owned by the Joliet Park District when written
14consent to the issuance of a license to sell beer and wine in
15such premises is filed with the local liquor commissioner by
16the Joliet Park District. Beer and wine may be sold in
17buildings on the grounds of State veterans' homes when written
18consent to the issuance of a license to sell beer and wine in
19such buildings is filed with the Commission by the Department
20of Veterans' Affairs, and the facility shall provide dram shop
21liability in maximum insurance coverage limits so as to save
22the facility harmless from all financial loss, damage or harm.
23Such liquors may be delivered to and sold at any property owned
24or held under lease by a Metropolitan Pier and Exposition
25Authority or Metropolitan Exposition and Auditorium Authority.
26    Beer and wine may be sold and dispensed at professional

1sporting events and at professional concerts and other
2entertainment events conducted on premises owned by the Forest
3Preserve District of Kane County, subject to the control of the
4District Commissioners and applicable local law, provided that
5dram shop liability insurance is provided at maximum coverage
6limits so as to hold the District harmless from all financial
7loss, damage and harm.
8    Nothing in this Section shall preclude the sale or delivery
9of beer and wine at a State or county fair or the sale or
10delivery of beer or wine at a city fair in any otherwise lawful
11manner.
12    Alcoholic liquors may be sold at retail in buildings in
13State parks under the control of the Department of Natural
14Resources, provided:
15        a. the State park has overnight lodging facilities with
16    some restaurant facilities or, not having overnight
17    lodging facilities, has restaurant facilities which serve
18    complete luncheon and dinner or supper meals,
19        b. (blank), and
20        c. the alcoholic liquors are sold by the State park
21    lodge or restaurant concessionaire only during the hours
22    from 11 o'clock a.m. until 12 o'clock midnight.
23    Notwithstanding any other provision of this Act, alcoholic
24    liquor sold by the State park or restaurant concessionaire
25    is not subject to the provisions of Articles IV and IX.
26    Alcoholic liquors may be sold at retail in buildings on

1properties under the control of the Historic Sites and
2Preservation Division of the Historic Preservation Agency or
3the Abraham Lincoln Presidential Library and Museum provided:
4        a. the property has overnight lodging facilities with
5    some restaurant facilities or, not having overnight
6    lodging facilities, has restaurant facilities which serve
7    complete luncheon and dinner or supper meals,
8        b. consent to the issuance of a license to sell
9    alcoholic liquors in the buildings has been filed with the
10    commission by the Historic Sites and Preservation Division
11    of the Historic Preservation Agency or the Abraham Lincoln
12    Presidential Library and Museum, and
13        c. the alcoholic liquors are sold by the lodge or
14    restaurant concessionaire only during the hours from 11
15    o'clock a.m. until 12 o'clock midnight.
16    The sale of alcoholic liquors pursuant to this Section does
17not authorize the establishment and operation of facilities
18commonly called taverns, saloons, bars, cocktail lounges, and
19the like except as a part of lodge and restaurant facilities in
20State parks or golf courses owned by Forest Preserve Districts
21with a population of less than 3,000,000 or municipalities or
22park districts.
23    Alcoholic liquors may be sold at retail in the Springfield
24Administration Building of the Department of Transportation
25and the Illinois State Armory in Springfield; provided, that
26the controlling government authority may consent to such sales

1only if
2        a. the request is from a not-for-profit organization;
3        b. such sales would not impede normal operations of the
4    departments involved;
5        c. the not-for-profit organization provides dram shop
6    liability in maximum insurance coverage limits and agrees
7    to defend, save harmless and indemnify the State of
8    Illinois from all financial loss, damage or harm;
9        d. no such sale shall be made during normal working
10    hours of the State of Illinois; and
11        e. the consent is in writing.
12    Alcoholic liquors may be sold at retail in buildings in
13recreational areas of river conservancy districts under the
14control of, or leased from, the river conservancy districts.
15Such sales are subject to reasonable local regulations as
16provided in Article IV; however, no such regulations may
17prohibit or substantially impair the sale of alcoholic liquors
18on Sundays or Holidays.
19    Alcoholic liquors may be provided in long term care
20facilities owned or operated by a county under Division 5-21 or
215-22 of the Counties Code, when approved by the facility
22operator and not in conflict with the regulations of the
23Illinois Department of Public Health, to residents of the
24facility who have had their consumption of the alcoholic
25liquors provided approved in writing by a physician licensed to
26practice medicine in all its branches.

1    Alcoholic liquors may be delivered to and dispensed in
2State housing assigned to employees of the Department of
3Corrections. No person shall furnish or allow to be furnished
4any alcoholic liquors to any prisoner confined in any jail,
5reformatory, prison or house of correction except upon a
6physician's prescription for medicinal purposes.
7    Alcoholic liquors may be sold at retail or dispensed at the
8Willard Ice Building in Springfield, at the State Library in
9Springfield, and at Illinois State Museum facilities by (1) an
10agency of the State, whether legislative, judicial or
11executive, provided that such agency first obtains written
12permission to sell or dispense alcoholic liquors from the
13controlling government authority, or by (2) a not-for-profit
14organization, provided that such organization:
15        a. Obtains written consent from the controlling
16    government authority;
17        b. Sells or dispenses the alcoholic liquors in a manner
18    that does not impair normal operations of State offices
19    located in the building;
20        c. Sells or dispenses alcoholic liquors only in
21    connection with an official activity in the building;
22        d. Provides, or its catering service provides, dram
23    shop liability insurance in maximum coverage limits and in
24    which the carrier agrees to defend, save harmless and
25    indemnify the State of Illinois from all financial loss,
26    damage or harm arising out of the selling or dispensing of

1    alcoholic liquors.
2    Nothing in this Act shall prevent a not-for-profit
3organization or agency of the State from employing the services
4of a catering establishment for the selling or dispensing of
5alcoholic liquors at authorized functions.
6    The controlling government authority for the Willard Ice
7Building in Springfield shall be the Director of the Department
8of Revenue. The controlling government authority for Illinois
9State Museum facilities shall be the Director of the Illinois
10State Museum. The controlling government authority for the
11State Library in Springfield shall be the Secretary of State.
12    Alcoholic liquors may be delivered to and sold at retail or
13dispensed at any facility, property or building under the
14jurisdiction of the Historic Sites and Preservation Division of
15the Historic Preservation Agency or the Abraham Lincoln
16Presidential Library and Museum where the delivery, sale or
17dispensing is by (1) an agency of the State, whether
18legislative, judicial or executive, provided that such agency
19first obtains written permission to sell or dispense alcoholic
20liquors from a controlling government authority, or by (2) an
21individual or organization provided that such individual or
22organization:
23        a. Obtains written consent from the controlling
24    government authority;
25        b. Sells or dispenses the alcoholic liquors in a manner
26    that does not impair normal workings of State offices or

1    operations located at the facility, property or building;
2        c. Sells or dispenses alcoholic liquors only in
3    connection with an official activity of the individual or
4    organization in the facility, property or building;
5        d. Provides, or its catering service provides, dram
6    shop liability insurance in maximum coverage limits and in
7    which the carrier agrees to defend, save harmless and
8    indemnify the State of Illinois from all financial loss,
9    damage or harm arising out of the selling or dispensing of
10    alcoholic liquors.
11    The controlling government authority for the Historic
12Sites and Preservation Division of the Historic Preservation
13Agency shall be the Director of the Historic Sites and
14Preservation Agency, and the controlling government authority
15for the Abraham Lincoln Presidential Library and Museum shall
16be the Executive Director of the Abraham Lincoln Presidential
17Library and Museum.
18    Alcoholic liquors may be delivered to and sold at retail or
19dispensed for consumption at the Michael Bilandic Building at
20160 North LaSalle Street, Chicago IL 60601, after the normal
21business hours of any day care or child care facility located
22in the building, by (1) a commercial tenant or subtenant
23conducting business on the premises under a lease made pursuant
24to Section 405-315 of the Department of Central Management
25Services Law (20 ILCS 405/405-315), provided that such tenant
26or subtenant who accepts delivery of, sells, or dispenses

1alcoholic liquors shall procure and maintain dram shop
2liability insurance in maximum coverage limits and in which the
3carrier agrees to defend, indemnify, and save harmless the
4State of Illinois from all financial loss, damage, or harm
5arising out of the delivery, sale, or dispensing of alcoholic
6liquors, or by (2) an agency of the State, whether legislative,
7judicial, or executive, provided that such agency first obtains
8written permission to accept delivery of and sell or dispense
9alcoholic liquors from the Director of Central Management
10Services, or by (3) a not-for-profit organization, provided
11that such organization:
12        a. obtains written consent from the Department of
13    Central Management Services;
14        b. accepts delivery of and sells or dispenses the
15    alcoholic liquors in a manner that does not impair normal
16    operations of State offices located in the building;
17        c. accepts delivery of and sells or dispenses alcoholic
18    liquors only in connection with an official activity in the
19    building; and
20        d. provides, or its catering service provides, dram
21    shop liability insurance in maximum coverage limits and in
22    which the carrier agrees to defend, save harmless, and
23    indemnify the State of Illinois from all financial loss,
24    damage, or harm arising out of the selling or dispensing of
25    alcoholic liquors.
26    Nothing in this Act shall prevent a not-for-profit

1organization or agency of the State from employing the services
2of a catering establishment for the selling or dispensing of
3alcoholic liquors at functions authorized by the Director of
4Central Management Services.
5    Alcoholic liquors may be sold at retail or dispensed at the
6James R. Thompson Center in Chicago, subject to the provisions
7of Section 7.4 of the State Property Control Act, and 222 South
8College Street in Springfield, Illinois by (1) a commercial
9tenant or subtenant conducting business on the premises under a
10lease or sublease made pursuant to Section 405-315 of the
11Department of Central Management Services Law (20 ILCS
12405/405-315), provided that such tenant or subtenant who sells
13or dispenses alcoholic liquors shall procure and maintain dram
14shop liability insurance in maximum coverage limits and in
15which the carrier agrees to defend, indemnify and save harmless
16the State of Illinois from all financial loss, damage or harm
17arising out of the sale or dispensing of alcoholic liquors, or
18by (2) an agency of the State, whether legislative, judicial or
19executive, provided that such agency first obtains written
20permission to sell or dispense alcoholic liquors from the

12of a catering establishment for the selling or dispensing of
13alcoholic liquors at functions authorized by the Director of
14Central Management Services.
15    Alcoholic liquors may be sold or delivered at any facility
16owned by the Illinois Sports Facilities Authority provided that
17dram shop liability insurance has been made available in a
18form, with such coverage and in such amounts as the Authority
19reasonably determines is necessary.
20    Alcoholic liquors may be sold at retail or dispensed at the
21Rockford State Office Building by (1) an agency of the State,
22whether legislative, judicial or executive, provided that such
23agency first obtains written permission to sell or dispense
24alcoholic liquors from the Department of Central Management
25Services, or by (2) a not-for-profit organization, provided

3        b. Sells or dispenses the alcoholic liquors in a manner

9    shop liability insurance in maximum coverage limits and in

12    damage or harm arising out of the selling or dispensing of
13    alcoholic liquors.
14    Nothing in this Act shall prevent a not-for-profit
15organization or agency of the State from employing the services
16of a catering establishment for the selling or dispensing of
17alcoholic liquors at functions authorized by the Department of
18Central Management Services.
19    Alcoholic liquors may be sold or delivered in a building
20that is owned by McLean County, situated on land owned by the
21county in the City of Bloomington, and used by the McLean
22County Historical Society if the sale or delivery is approved
23by an ordinance adopted by the county board, and the
24municipality in which the building is located may not prohibit
25that sale or delivery, notwithstanding any other provision of
26this Section. The regulation of the sale and delivery of

1alcoholic liquor in a building that is owned by McLean County,
2situated on land owned by the county, and used by the McLean
3County Historical Society as provided in this paragraph is an
4exclusive power and function of the State and is a denial and
5limitation under Article VII, Section 6, subsection (h) of the
6Illinois Constitution of the power of a home rule municipality
7to regulate that sale and delivery.
8    Alcoholic liquors may be sold or delivered in any building
9situated on land held in trust for any school district
10organized under Article 34 of the School Code, if the building
11is not used for school purposes and if the sale or delivery is
12approved by the board of education.
13    Alcoholic liquors may be delivered to and sold at retail in
14any building owned by the Six Mile Regional Library District,
15provided that the delivery and sale is approved by the board of
16trustees of the Six Mile Regional Library District and the
17delivery and sale is limited to a maximum of 6 library district
18events per year. The Six Mile Regional Library District shall
19provide dram shop liability in maximum insurance coverage
20limits so as to save harmless the library district from all
21financial loss, damage, or harm.
22    Alcoholic liquors may be sold or delivered in buildings
23owned by the Community Building Complex Committee of Boone
24County, Illinois if the person or facility selling or
25dispensing the alcoholic liquor has provided dram shop
26liability insurance with coverage and in amounts that the

1Committee reasonably determines are necessary.
2    Alcoholic liquors may be sold or delivered in the building
3located at 1200 Centerville Avenue in Belleville, Illinois and
4occupied by either the Belleville Area Special Education
5District or the Belleville Area Special Services Cooperative.
6    Alcoholic liquors may be delivered to and sold at the Louis
7Joliet Renaissance Center, City Center Campus, located at 214
8N. Ottawa Street, Joliet, and the Food Services/Culinary Arts
9Department facilities, Main Campus, located at 1215 Houbolt
10Road, Joliet, owned by or under the control of Joliet Junior
11College, Illinois Community College District No. 525.
12    Alcoholic liquors may be delivered to and sold at Triton
13College, Illinois Community College District No. 504.
14    Alcoholic liquors may be delivered to and sold at the
15College of DuPage, Illinois Community College District No. 502.
16    Alcoholic liquors may be delivered to and sold at the
17building located at 446 East Hickory Avenue in Apple River,
18Illinois, owned by the Apple River Fire Protection District,
19and occupied by the Apple River Community Association if the
20alcoholic liquor is sold or dispensed only in connection with
21organized functions approved by the Apple River Community
22Association for which the planned attendance is 20 or more
23persons and if the person or facility selling or dispensing the
24alcoholic liquor has provided dram shop liability insurance in
25maximum limits so as to hold harmless the Apple River Fire
26Protection District, the Village of Apple River, and the Apple

2and harm.
3    Alcoholic liquors may be delivered to and sold at the Sikia
4Restaurant, Kennedy King College Campus, located at 740 West
563rd Street, Chicago, and at the Food Services in the Great
6Hall/Washburne Culinary Institute Department facility, Kennedy
7King College Campus, located at 740 West 63rd Street, Chicago,
8owned by or under the control of City Colleges of Chicago,
9Illinois Community College District No. 508.
