AMENDMENT TO SENATE BILL 1042

2    AMENDMENT NO. ______. Amend Senate Bill 1042 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Recreational Use of Land and Water Areas
5Act is amended by changing Section 2 as follows:
 
6    (745 ILCS 65/2)  (from Ch. 70, par. 32)
7    Sec. 2. As used in this Act, unless the context otherwise
8requires:
9    (a) "Land" includes land, roads, water, watercourses,
10private ways and buildings, structures, and machinery or
11equipment when attached to the realty, but does not include a
12dwelling and the property immediately adjacent to and
13surrounding the dwelling that is used primarily for activities
14associated with the occupancy of the dwelling as a living space
15residential buildings or residential property.
16    (b) "Owner" includes the possessor of any interest in land,

1whether it be a tenant, lessee, occupant, the State of Illinois
2and its political subdivisions, or person in control of the
3premises.
4    (c) "Recreational or conservation purpose" means:
5    (1) entry by individuals or members of the public onto the
6land of another to conduct fishing, hunting, or recreational
7shooting or a combination thereof or any activity solely
8related to the aforesaid hunting or recreational shooting; or .
9    (2) entry by the general public onto the land of another
10for any activity undertaken for conservation, resource
11management, exercise, education, relaxation, or pleasure.
12    (d) "Charge" means an admission fee for permission to go
13upon the land, but does not include: the sharing of game, fish
14or other products of recreational use; or benefits to or
15arising from the recreational use; or contributions in kind,
16services or cash made for the purpose of properly conserving
17the land.
18    (e) "Person" includes any person, regardless of age,
19maturity, or experience, who enters upon or uses land for
20recreational purposes.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
