| 2 | | AMENDMENT NO. ______. Amend Senate Bill 1572 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The School Code is amended by adding Sections | 5 | | 2-3.157, 34-18.48, and 34-18.49 as follows: | 6 | | (105 ILCS 5/2-3.157 new) | 7 | | Sec. 2-3.157. City of Chicago School District 299 reports. | 8 | | (a) The State Board of Education shall prepare a report on | 9 | | the practices and trends in the operations of City of Chicago | 10 | | School District 299 with respect to the impact of charter | 11 | | school enrollment on the operation of the school district. The | 12 | | State Board of Education shall gather data regarding student | 13 | | enrollment and placement policies, disciplinary procedures, | 14 | | programs for special education, English Language Learners | 15 | | (ELL), and any other relevant student needs for each public | 16 | | school in the district, including charter schools. The report |

| 1 | | shall specifically identify any polices that give schools | 2 | | latitude to discourage attendance of students or that would | 3 | | create barriers for any students to attend. In addition, the | 4 | | State Board of Education shall gather data on mobility, | 5 | | attendance rates, graduation rates, and incoming and outgoing | 6 | | transfers at each grade level for each public school in the | 7 | | district, including charter schools. The report shall identify | 8 | | the extent to which transfers from charter schools to other | 9 | | schools occur before or after any deadlines related to funding. | 10 | | The report shall identify the extent to which charter schools | 11 | | accept transfers into the school at each grade level, as | 12 | | compared to transfers out. The report shall compare charter | 13 | | school enrollment by race, disability, income, and ELL status | 14 | | to other charter and traditional public schools in the | 15 | | district. The report shall compare the instructional programs, | 16 | | methods, and instructional materials of each public school in | 17 | | the district, including charter schools. | 18 | | The district shall comply with all requests for information | 19 | | made by the State Board of Education necessary for the State | 20 | | Board of Education to prepare this report. | 21 | | The State Board of Education shall file copies of this | 22 | | report as provided in Section 3.1 of the General Assembly | 23 | | Organization Act. | 24 | | (b) The State Board of Education shall prepare a report on | 25 | | the impact of school actions, such as school closures and | 26 | | school turnarounds, on the practices and trends in the |

| 1 | | operation of City of Chicago School District 299. The report | 2 | | shall include all of the following: | 3 | | (1) A community analysis that includes current and | 4 | | projected demographics, land usage, transportation plans, | 5 | | residential housing and commercial development, private | 6 | | school plans for water and sewage expansion or | 7 | | redevelopment, and institutions of higher education. | 8 | | (2) A description of the district's guiding | 9 | | educational principles and standards. | 10 | | (3) A description of the types of instructional | 11 | | programs or services delivered at each school. | 12 | | (4) The enrollment capacity of each school and its rate | 13 | | of utilization. | 14 | | (5) A report on the assessment of individual building | 15 | | and site conditions. | 16 | | (6) A data table with historical and projected | 17 | | enrollment data by school and by grade. | 18 | | (7) An analysis of facility needs and requirements of | 19 | | the district. | 20 | | (8) Identification of potential sources of funding for | 21 | | the implementation of the district's Educational Facility | 22 | | Master Plan. | 23 | | The report shall also include identification of all | 24 | | external firms and agencies contracted to aid the district in | 25 | | performing school actions and transitions. The firms and | 26 | | agencies shall disclose financial interests, fees paid by the |

| 1 | | district, and any and all relationships it holds with any | 2 | | member of the school board or city council. | 3 | | The district shall comply with all requests for information | 4 | | made by the State Board of Education necessary for the State | 5 | | Board of Education to prepare this report. | 6 | | The State Board of Education shall file copies of this | 7 | | report as provided in Section 3.1 of the General Assembly | 8 | | Organization Act. | 9 | | (c) The State Board of Education shall prepare a report on | 10 | | the impact of standardized testing on the operations and | 11 | | practices of City of Chicago School District 299. The report | 12 | | shall include the amount of time educators prepare for tests, | 13 | | administer tests, and analyze results. The report shall also | 14 | | include the amount of money spent on procuring standardized | 15 | | tests. The report shall include the number of tests given to | 16 | | students and the frequency of tests at each grade level and at | 17 | | each school in the district. The report shall include financial | 18 | | disclosures by the company or firm that owns the tests and | 19 | | preparation materials that include any prior relationships | 20 | | with the district or agents of the district. The report shall | 21 | | compare the frequency of tests given to students in schools | 22 | | that have charters approved by the district and other district | 23 | | schools. | 24 | | The report shall be completed and made available to the | 25 | | public each year on or before July 31. If the district does not | 26 | | make available all information requested by the State Board of |

| 1 | | Education necessary for the State Board of Education to prepare | 2 | | this report, the State Board of Education, in an administrative | 3 | | proceeding, shall impose a civil penalty on the district equal | 4 | | to $2,900 for every day the information is unavailable after | 5 | | the July 31 report date. The Attorney General may bring an | 6 | | action in circuit court to enforce the collection of any | 7 | | monetary penalty imposed. | 8 | | (d) The State Board of Education may adopt any rules | 9 | | necessary to carry out its responsibilities under this Section. | 10 | | (105 ILCS 5/34-18.48 new) | 11 | | Sec. 34-18.48. School property; sale of unusable property; | 12 | | real estate transaction standards. | 13 | | (a) When school properties are deemed unusable by the | 14 | | district and are slated for sale, the district must sell the | 15 | | properties at market rate. | 16 | | (b) The State Board of Education shall create standards for | 17 | | district real estate transactions and shall approve all real | 18 | | estate arrangements. | 19 | | (105 ILCS 5/34-18.49 new) | 20 | | Sec. 34-18.49. Statement of revenues and in-kind services. | 21 | | The district shall create a statement of revenues and in-kind | 22 | | services it receives. The statement shall also include the | 23 | | value of any in-kind services, payments to third parties, or | 24 | | other supports from the district to its charter schools. Any |
