AMENDMENT TO SENATE BILL 1585

2    AMENDMENT NO. ______. Amend Senate Bill 1585 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by adding
5Section 3-70 as follows:
 
6    (35 ILCS 200/3-70 new)
7    Sec. 3-70. Cessation of Township Assessor. If the office of
8Township Assessor in a coterminous township ceases as provided
9in Article 27 of the Township Code, then the coterminous
10municipality shall assume the duties of the Township Assessor
11under this Code.
 
12    Section 10. The Township Code is amended by adding Article
1327 as follows:

ARTICLE 27. DISCONTINUANCE OF TOWNSHIP ORGANIZATION WITHIN
2
COTERMINOUS MUNICIPALITY

4    (60 ILCS 1/27-5 new)
5    Sec. 27-5. Applicability. This Article shall apply only to
6a township within a coterminous, or substantially coterminous,
7municipality in which the city council exercises the powers and
8duties of the township board, or in which one or more municipal
9officials serve as an officer or trustee of the township.
 
10    (60 ILCS 1/27-10 new)
11    Sec. 27-10. Petition and referendum to discontinue and
12abolish a township organization within a coterminous
13municipality. Upon ordinance adopted by the city council of a
14township described under Section 27-5 of this Article, or upon
15petition of at least 10% of the registered voters of that
16township, the city council shall certify and cause to be
17submitted to the voters of the township, at the next election
18or consolidated election, a proposition to discontinue and
19abolish the township organization and to transfer all the
20rights, powers, duties, assets, property, liabilities,
21obligations, and responsibilities of the township organization
22to the coterminous municipality.
23    A signature on a petition shall not be valid or counted in
24considering the petition unless the form requirements are

1complied with and the date of each signature is less than 90
2days before the last day for filing the petition. The statement
3of the person who circulates the petition must include an
4attestation (i) indicating the dates on which that sheet was
5circulated, (ii) indicating the first and last date on which
6that sheet was circulated, or (iii) certifying that none of the
7signatures on the sheet was signed more than 90 days before the
8last day for filing the petition. The petition shall be treated
9and the proposition certified in the manner provided by the
10general election law. After the proposition has once been
11submitted to the electorate, the proposition shall not be
12resubmitted for 4 years.
13    The proposition shall be in substantially the following
14form:
15        Shall the township organization be continued in [Name
16    of Township] Township?
17    The votes shall be recorded as "Yes" or "No".

19    Sec. 27-15. Cessation of township organization. If a
20majority of the votes of the township cast are in favor of the
21proposition to discontinue and abolish the township
22organization, then the township organization in that township
23shall cease.
24    On the effective date of the discontinuance and abolishment
25of the township organization, all the rights, powers, duties,

1assets, property, liabilities, obligations, and
2responsibilities of the township shall by operation of law vest
3in and be assumed by the coterminous municipality.
 
4    (60 ILCS 1/27-20 new)
5    Sec. 27-20. Township officers.
6    Upon the effective date of discontinuance, the coterminous
7municipality shall exercise all duties and responsibilities of
8that township officer as provided in the Township Code, the
9Illinois Public Aid Code, Property Tax Code, and the Illinois
10Highway Code, as applicable. The coterminous municipality may
11enter into an intergovernmental agreement or contract with the
12county or the State to administer the duties and
13responsibilities of that township officer for services under
14its jurisdiction.
 
15    (60 ILCS 1/27-25 new)
16    Sec. 27-25. Business, records, and property of
17discontinued township organization. The records of a township
18organization discontinued under this Article shall be
19deposited in the coterminous municipality's city clerk's
20office. The coterminous municipality may close up all
21unfinished business of the township and sell and dispose of any
22of the property belonging to the township for benefit of the
23inhabitants of the municipality.

1    Section 15. The Public Health District Act is amended by
2adding Section 25 as follows:
 
3    (70 ILCS 905/25 new)
4    Sec. 25. Discontinuance of a coterminous township. If the
5office of Township Assessor in a coterminous township is
6discontinued as provided in Article 27 of the Township Code,
7then the coterminous municipality's Council members shall be
8the board of health for the public health district under this
9Act.
 
10    Section 20. The Illinois Public Aid Code is amended by
11adding Section 12-3.1 as follows:

13    Sec. 12-3.1. Discontinuance of a coterminous township.
14Upon discontinuance of a coterminous township under Article 27
15of the Township Code, the coterminous municipality shall
16provide funds for and administer the public aid program
17provided for under Article VI of this Code.
 
18    Section 25. The Illinois Highway Code is amended by adding
19Section 5-205.10 as follows:

21    Sec. 5-205.10. Discontinuance of a coterminous township.

1If township organization is discontinued as provided in Article
227 of the Township Code, then the coterminous municipality
3shall assume the duties of highway commissioner under this
4Code.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.".
