6 | | on page 24, line 22, by replacing " 3 " with " 2 "; and |
7 | | on page 28, immediately below line 21, by inserting the |

11 | | Sec. 95. Background checks. |
12 | | (a) The Department of Agriculture through the Department of |
13 | | State Police shall conduct a fingerprint-based criminal |
14 | | background check of the prospective cultivation center agents. |

1 | | Each
prospective cultivation center agent shall submit his
or |
2 | | her fingerprints to the Department of State Police in the
form |
3 | | and manner prescribed by the Department of State Police.
These |
4 | | fingerprints shall be checked against the fingerprint
records |
5 | | filed in the Department of State Police and Federal
Bureau of |
6 | | Investigation criminal history records databases. The |
7 | | Department of
State Police shall furnish, pursuant to positive
|
8 | | identification, all Illinois conviction information to the |
9 | | Department of Agriculture. The Department of State Police shall |
10 | | be reimbursed for the cost of the background check by the |
11 | | Department of Agriculture. In order to carry out this |
12 | | provision, each person applying as a cultivation center agent |
13 | | shall submit a full set of fingerprints to the Department of |
14 | | Agriculture for the purpose of obtaining a State and federal |
15 | | criminal records check. The Department of Agriculture may |
16 | | exchange this data with the Department of State Police and the |
17 | | Federal Bureau of Investigation without disclosing that the |
18 | | records check is related to this Act. The Department of |
19 | | Agriculture shall destroy each set of fingerprints after the |
20 | | criminal records check is complete.

21 | | (b) When applying for the initial permit, the background |
22 | | checks for the principal officer, board members, and registered |
23 | | agents shall be completed prior to submitting the application |
24 | | to the Department of Agriculture.
