| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2381 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. Short title. This Act may be cited as the Grant | 5 | | Information Collection Act. | 6 | | Section 5. Definitions. For the purposes of this Act, | 7 | | unless the context otherwise requires: | 8 | | "Grant funds" means any public funds dispensed by a grantor | 9 | | agency to any person or entity for obligation, expenditure, or | 10 | | use by that person or entity for a specific purpose or purposes | 11 | | and any funds disbursed by the State Comptroller pursuant to an | 12 | | appropriation made by the General Assembly to a named entity or | 13 | | person. Funds disbursed in accordance with a fee for service | 14 | | purchase of care contract are not grant funds for purposes of | 15 | | this Act. | 16 | | Neither the method by which funds are dispensed whether by |

| 1 | | contract, agreement, grant subsidy, letter of credit, or any | 2 | | other method nor the purpose for which the funds are used can | 3 | | change the character of funds which otherwise would be | 4 | | considered grant funds as defined in this Section. | 5 | | "Grantee" means the person or entity which may use grant | 6 | | funds. | 7 | | "Grantor agency" means a State agency that dispenses grant | 8 | | funds. | 9 | | "State agency" means State-supported universities and | 10 | | colleges and any department, office, commission, board, or | 11 | | authority within the Executive Department, other than the | 12 | | Office of the Lieutenant Governor, the Office of the Attorney | 13 | | General, the Office of the Secretary of State, the Office of | 14 | | the Comptroller, or the Office of the Treasurer. | 15 | | Section 10. Grant information collection. The Chief | 16 | | Information Officer of the State, as designated by the | 17 | | Governor, shall coordinate with each State agency to develop, | 18 | | with any existing or newly available resources and technology, | 19 | | appropriate systems to accurately report data containing | 20 | | financial information. These systems shall include a module | 21 | | that is specific to the management and administration of grant | 22 | | funds. | 23 | | Each grantor agency that is authorized to award grant funds | 24 | | to an entity other than the State of Illinois shall coordinate | 25 | | with the Chief Information Officer of the State to provide for |

| 1 | | the publication, at data.illinois.gov or any other publicly | 2 | | accessible website designated by the Chief Information | 3 | | Officer, of data sets containing information regarding awards | 4 | | of grant funds that the grantor agency has made during the | 5 | | previous fiscal year. Data sets shall be published on at least | 6 | | a quarterly basis and shall include, at a minimum, the | 7 | | following: | 8 | | (1) the name of the grantor agency; | 9 | | (2) the name and postal zip code of the grantee; | 10 | | (3) a short description of the purpose of the award of | 11 | | grant funds; | 12 | | (4) the amount of each award of grant funds; | 13 | | (5) the date of each award of grant funds; and | 14 | | (6) the duration of each award of grant funds. | 15 | | In addition, each grantor agency shall make best efforts, | 16 | | with available resources and technology, to make available in | 17 | | the data sets any other data that is relevant to its award of | 18 | | grant funds. | 19 | | Data not subject to the requirements of this Section | 20 | | include data to which a State agency may deny access pursuant | 21 | | to any provision of a federal, state, or local law, rule, or | 22 | | regulation.".
