AMENDMENT TO SENATE BILL 2793

2    AMENDMENT NO. ______. Amend Senate Bill 2793 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
52-3.160 as follows:
 
6    (105 ILCS 5/2-3.160 new)
7    Sec. 2-3.160. Student discipline report; school discipline
8improvement plan.
9    (a) On or before October 31, 2015 and on or before October
1031 of each subsequent year, the State Board of Education,
11through the State Superintendent of Education, shall prepare a
12report on student discipline in all school districts in this
13State. This report must be posted on the Internet website of
14the State Board of Education. The report shall include both of
15the following:
16        (1) Data on the issuance of out-of-school suspensions,

1    expulsions, and removals to alternative settings,
2    disaggregated by race and ethnicity, gender, age, grade
3    level, limited English proficiency, incident type, and
4    discipline duration.
5        (2) Data on the use of arrests or criminal citations on
6    school grounds and during school hours, disaggregated by
7    race and ethnicity, gender, and age.
8    (b) The State Board of Education shall analyze the data
9under subsection (a) of this Section on an annual basis and
10determine the top quartile of school districts for each of the
11following metrics:
12        (1) Total number of instructional days on which
13    students were excluded because of out-of-school
14    suspensions or expulsions, divided by the total student
15    population.
16        (2) Racial disproportionality with respect to the use
17    of out-of-school suspensions, expulsions, and school-based
18    arrests and criminal citations.
19    The State Board of Education shall require each of the
20school districts identified in these quartiles to submit a
21school improvement plan identifying the strategies the school
22district will implement to reduce the use of harsh disciplinary
23practices or racial disproportionality or both if applicable.
24The calculation of the quartile described in subdivision (1) of
25this subsection (b) shall exclude all school districts that
26issued fewer than a total of 10 out-of-school suspensions and

1expulsions during the school year. The calculation of the
2quartile described in subdivision (2) of this subsection (b)
3shall exclude all school districts with an enrollment of fewer
4than 50 white students or fewer than 50 students of color.
5    The plan must be approved at a public school board meeting
6and posted on the school district's Internet website. Within
7one year after being identified, the school district shall
8submit to the State Board of Education and post on the
9district's Internet website a progress report describing the
10implementation of the plan and the results achieved.
 
11    Section 99. Effective date. This Act takes effect July 1,
122014.".
