| 2 | | AMENDMENT NO. ______. Amend House Bill 263 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Park District Aquarium and Museum Act is | 5 | | amended by changing Section 1 and by adding Section 3 as | 6 | | follows:
| 7 | | (70 ILCS 1290/1) (from Ch. 105, par. 326)
| 8 | | Sec. 1. Erect, operate, and maintain aquariums and museums. | 9 | | The corporate authorities of cities and park districts having | 10 | | the
control or supervision of any public park or parks, are | 11 | | hereby authorized
to purchase, erect and maintain within any | 12 | | public park or parks under the
control or supervision of such | 13 | | corporate authorities, edifices to be used
as aquariums or as | 14 | | museums of art, industry, science or natural or other
history, | 15 | | or to permit the directors or trustees of any corporation or
| 16 | | society organized for the construction or maintenance and |

| 1 | | operation of an
aquarium or museum as hereinabove described to | 2 | | erect, enlarge, ornament,
build, rebuild, rehabilitate, | 3 | | improve, maintain and operate its aquarium or
museum or museums | 4 | | within any public park now or hereafter under the control
or | 5 | | supervision of any city or park district, and to contract with | 6 | | any such
directors or trustees of any such aquarium, museum or | 7 | | museums relative to
the erection, enlargement, ornamentation, | 8 | | building, rebuilding,
rehabilitation, improvement, maintenance | 9 | | and operation thereof. Any city or
park district may charge, or | 10 | | permit such an aquarium or museum to charge,
an admission fee. | 11 | | Any such aquarium or museum,
however, shall be open without | 12 | | charge, when
accompanied by a teacher, to the children in | 13 | | actual attendance upon grades
kindergarten through twelve in | 14 | | any of the schools in this State at all
times. For a period of 3 | 15 | | years beginning on the effective date of this amendatory Act of | 16 | | the 99th General Assembly, any Any such aquarium or museum, | 17 | | however, must be open to persons who reside in this State | 18 | | without
charge
for a period equivalent to : (i) for persons | 19 | | under 22 years of age, 52 days, at least 6 of which must be | 20 | | during the
period from June through August, each year ; and (ii) | 21 | | for persons 22 years of age and older, 26 days, at least 6 of | 22 | | which must be during the period from June through August, each | 23 | | year .
Notwithstanding said provisions, charges may be made at | 24 | | any
time for
special services and for admission to special | 25 | | facilities within any
aquarium or museum for the education, | 26 | | entertainment or convenience of
visitors. The proceeds of such |

| 1 | | admission fees and charges for special
services and special | 2 | | facilities shall be devoted exclusively to the
purposes for | 3 | | which the tax authorized by Section 2 hereof may be used. If
| 4 | | any owner or owners of any lands or lots abutting or fronting | 5 | | on any such
public park, or adjacent thereto, have any private | 6 | | right, easement,
interest or property in such public park | 7 | | appurtenant to their lands or lots
or otherwise, which would be | 8 | | interfered with by the erection and
maintenance of any aquarium | 9 | | or museum as hereinbefore provided, or any
right to have such | 10 | | public park remain open or vacant and free from
buildings, the | 11 | | corporate authorities of the city or park district having
| 12 | | control of such park, may condemn the same in the manner | 13 | | prescribed for the
exercise
of the right of eminent domain | 14 | | under the Eminent Domain Act.

| 16 | | (70 ILCS 1290/3 new) | 17 | | Sec. 3. Illinois Arts Commission. The Illinois Arts | 18 | | Commission is hereby created to work with the Illinois Arts | 19 | | Council to create a sustainability plan that emphasizes the | 20 | | diversity of patrons and works towards finding resources to | 21 | | sustain funding for museums, the arts, community art | 22 | | initiatives, and art programs in schools. The Commission shall | 23 | | consist of the following members to be appointed by the | 24 | | Illinois Arts Council and the Chairperson of the House Museums, | 25 | | Arts & Cultural Enhancement Committee within 90 days of the |

| 1 | | effective date of this amendatory Act: | 2 | | (1) Four members of the General Assembly from the | 3 | | majority caucus. | 4 | | (2) Four members of the General Assembly from the | 5 | | minority caucus. | 6 | | (3) Three members of the public who are engaged in | 7 | | community arts programs. | 8 | | One member shall be designated by the appointing | 9 | | authorities as the chairperson of the Commission. Members of | 10 | | the Commission shall serve without compensation. The Illinois | 11 | | Arts Council shall provide staff or other resources necessary | 12 | | to support the Commission. Beginning on July 1, 2016, and by | 13 | | the beginning of every other fiscal year thereafter, the | 14 | | Commission shall submit a report to the General Assembly | 15 | | detailing its findings and recommendations.
| 16 | | Section 99. Effective date. This Act takes effect upon | 17 | | becoming law.".
