| 2 | | AMENDMENT NO. ______. Amend House Bill 810 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Rehabilitation of Persons with | 5 | | Disabilities Act is amended by changing Section 10 as follows:
| 6 | | (20 ILCS 2405/10) (from Ch. 23, par. 3441)
| 7 | | Sec. 10. Residential schools; visual and hearing | 8 | | disabilities.
| 9 | | (a) The Department of Human Services shall operate
| 10 | | residential schools for the education of children with visual | 11 | | and hearing
disabilities who are unable to take advantage of | 12 | | the regular educational
facilities provided in the community, | 13 | | and shall provide in connection
therewith such academic, | 14 | | vocational, and related services as may be
required. Children | 15 | | shall be eligible for admission to these schools only
after | 16 | | proper diagnosis and evaluation, in accordance with procedures

| 1 | | prescribed by the Department.
| 2 | | (a-5) The Superintendent of the Illinois School for the | 3 | | Deaf shall be the chief executive officer of, and shall be | 4 | | responsible for the day to day operations of, the School, and | 5 | | shall obtain educational and professional employees who are | 6 | | certified by the Illinois State Board of Education or licensed | 7 | | by the appropriate agency or entity to which licensing | 8 | | authority has been delegated, as well as all other employees of | 9 | | the School, subject to the provisions of the Personnel Code and | 10 | | any applicable collective bargaining agreement. The | 11 | | Superintendent shall be appointed by the Governor, by and with | 12 | | the advice and consent of the Senate. In the case of a vacancy | 13 | | in the office of Superintendent during the recess of the | 14 | | Senate, the Governor shall make a temporary appointment until | 15 | | the next meeting of the Senate, when the Governor shall | 16 | | nominate some person to fill the office, and any person so | 17 | | nominated who is confirmed by the Senate shall hold office | 18 | | during the remainder of the term and until his or her successor | 19 | | is appointed and qualified. The Superintendent shall hold | 20 | | office (i) for a term expiring on June 30 of 2015, and every 4 | 21 | | years thereafter and (ii) until the Superintendent's successor | 22 | | is appointed and qualified. The Superintendent shall devote his | 23 | | or her full time to the duties of the office, shall not serve | 24 | | in any other capacity during his or her term of office, and | 25 | | shall receive such compensation as the Governor shall | 26 | | determine. | 1 | | effective date of this amendatory Act of the 99th General | 2 | | Assembly, the The Superintendent shall have an administrative | 3 | | certificate with a superintendent endorsement as provided for | 4 | | under Section 21-7.1 of the School Code , and shall have degrees | 5 | | in both educational administration and deaf education, | 6 | | together with at least 15 years of experience in either deaf | 7 | | education, the administration of deaf education, or a | 8 | | combination of the 2. For any Superintendent whose term begins | 9 | | on or after the effective date of this amendatory Act of the | 10 | | 99th General Assembly, the Superintendent must (1) be | 11 | | proficient in sign language, (2) have a Professional Educator | 12 | | License with a superintendent endorsement as provided for under | 13 | | subdivision (D) of paragraph (2) of Section 21B-25 of the | 14 | | School Code or have comparable credentials from another state | 15 | | and must satisfy the requirements of subdivision (D) of | 16 | | paragraph (2) of Section 21B-25 of the School Code within an | 17 | | appropriate time as determined by the Department, and (3) have | 18 | | a master's degree or higher in educational administration or | 19 | | deaf education, together with at least 3 years of experience in | 20 | | either deaf education, the administration of deaf education, or | 21 | | a combination of the 2. In a situation in which an interim | 22 | | Superintendent is needed, the interim Superintendent must (A) | 23 | | be proficient in sign language, (B) have a master's degree or | 24 | | higher, and (C) have working knowledge of the federal | 25 | | Individuals with Disabilities Education Act, the federal | 26 | | Americans with Disabilities Act of 1990, and Section 504 of the |

| 1 | | federal Rehabilitation Act of 1973, together with | 2 | | administrative experience in serving the deaf and | 3 | | hard-of-hearing population. | 4 | | (a-10) The Superintendent of the Illinois School for the | 5 | | Visually Impaired shall be the chief executive officer of, and | 6 | | shall be responsible for the day to day operations of, the | 7 | | School, and shall obtain educational and professional | 8 | | employees who are certified by the Illinois State Board of | 9 | | Education or licensed by the appropriate agency or entity to | 10 | | which licensing authority has been delegated, as well as all | 11 | | other employees of the School, subject to the provisions of the | 12 | | Personnel Code and any applicable collective bargaining | 13 | | agreement. The Superintendent shall be appointed by the | 14 | | Governor, by and with the advice and consent of the Senate. The Superintendent shall have an | 3 | | administrative certificate with a superintendent endorsement | 4 | | as provided for under Section 21-7.1 of the School Code, and | 5 | | shall have degrees in both educational administration and blind | 6 | | or visually impaired education, together with at least 15 years | 7 | | of experience in either blind or visually impaired education, | 8 | | the administration of blind or visually impaired education, or | 9 | | a combination of the 2. | 10 | | (b) In administering the Illinois School for the Deaf, the | 11 | | Department
shall adopt an admission policy which permits day or | 12 | | residential
enrollment, when resources are sufficient, of | 13 | | children with hearing
disabilities who are able to take | 14 | | advantage of the regular educational
facilities provided in the | 15 | | community and thus unqualified for admission
under subsection | 16 | | (a). In doing so, the Department shall establish an
annual | 17 | | deadline by which shall be completed the enrollment of children
| 18 | | qualified under subsection (a) for admission to the Illinois | 19 | | School for the
Deaf. After the deadline, the Illinois School | 20 | | for the Deaf may enroll
other children with hearing | 21 | | disabilities at the request of their parents or
guardians if | 22 | | the Department determines there are sufficient resources to
| 23 | | meet their needs as well as the needs of children enrolled | 24 | | before the
deadline and children qualified under subsection (a) | 25 | | who may be enrolled
after the deadline on an emergency basis. | 26 | | The Department shall adopt any
rules and regulations necessary |

| 2 | | (c) In administering the Illinois School for the Visually | 3 | | Impaired, the
Department shall adopt an admission policy that | 4 | | permits day or residential
enrollment, when resources are | 5 | | sufficient, of children with visual
disabilities who are able | 6 | | to take advantage of the regular educational
facilities | 7 | | provided in the community and thus unqualified for admission
| 8 | | under subsection (a). In doing so, the Department shall | 9 | | establish an
annual deadline by which the enrollment of | 10 | | children qualified under subsection
(a) for admission to the | 11 | | Illinois School for the Visually Impaired shall be
completed. | 12 | | After the deadline, the Illinois School for the Visually | 13 | | Impaired
