| 1 | | AN ACT concerning human trafficking.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the Human | 5 | | Trafficking Resource Center Notice Act. | 6 | | Section 5. Posted notice required. Each of the following | 7 | | businesses and other establishments shall, upon the | 8 | | availability of the model notice described in Section 15 of | 9 | | this Act, post a notice that complies with the requirements of | 10 | | this Act in a conspicuous place near the public entrance of the | 11 | | establishment or in another conspicuous location in clear view | 12 | | of the public and employees where similar notices are | 13 | | customarily posted: | 14 | | (1) On premise consumption retailer licensees under | 15 | | the Liquor Control Act of 1934 where the sale of alcoholic | 16 | | liquor is the principal
business carried on by the licensee | 17 | | at the premises and primary to the
sale of food. | 18 | | (2) Adult entertainment facilities, as defined in | 19 | | Section 5-1097.5 of the Counties Code. | 20 | | (3) Primary airports, as defined in Section 47102(16) | 21 | | of Title 49 of the United States Code. | 22 | | (4) Intercity passenger rail or light rail stations. | 23 | | (5) Bus stations. |

| 1 | | (6) Truck stops. For purposes of this Act, "truck stop" | 2 | | means a privately-owned and operated facility that | 3 | | provides food, fuel, shower or other sanitary facilities, | 4 | | and lawful overnight truck parking. | 5 | | (7) Emergency rooms within general acute care | 6 | | hospitals. | 7 | | (8) Urgent care centers. | 8 | | (9) Farm labor contractors. | 9 | | (10) Privately-operated job recruitment centers. | 10 | | (11) Roadside rest areas. | 11 | | Section 10. Form of posted notice. | 12 | | (a) The notice required under this Act shall be at least 8 | 13 | | 1/2 inches by 11 inches in size, written in a 16-point font, | 14 | | and shall state the following: | 15 | | "If you or someone you know is being forced to engage in any | 16 | | activity and cannot leave, whether it is commercial sex, | 17 | | housework, farm work, construction, factory, retail, or | 18 | | restaurant work, or any other activity, call the National Human | 19 | | Trafficking Resource Center at 1-888-373-7888 to access help | 20 | | and services. | 21 | | Victims of slavery and human trafficking are protected under | 22 | | United States and Illinois law.

| 1 | | * Toll-free. | 2 | | * Operated by nonprofit nongovernmental organizations. | 3 | | * Anonymous and confidential. | 4 | | * Accessible in more than 160 languages. | 5 | | * Able to provide help, referral to services, training, | 6 | | and general information.". | 7 | | (b) The notice shall be printed in English, Spanish, and in | 8 | | one other language that is the most widely spoken language in | 9 | | the county where the establishment is located and for which | 10 | | translation is mandated by the federal Voting Rights Act, as | 11 | | applicable. This subsection does not require a business or | 12 | | other establishment in a county where a language other than | 13 | | English or Spanish is the most widely spoken language to print | 14 | | the notice in more than one language in addition to English and | 15 | | Spanish. | 16 | | Section 15. Model notice. No later than 6 months after the | 17 | | effective date of this Act, the Department of Human Services | 18 | | shall develop a model notice that complies with the | 19 | | requirements of this Act and make the model notice available | 20 | | for download on the Department's Internet website. | 21 | | Section 20. Penalties. A business or establishment that | 22 | | fails to comply with the requirements of this Act is liable for | 23 | | a civil penalty of $500 for a first offense and $1,000 for each | 24 | | subsequent offense. | 1 | | General may bring an action to impose a civil penalty pursuant | 2 | | to this Section against a business or establishment if a local | 3 | | or State agency with authority to regulate that business or | 4 | | establishment has satisfied both of the following: | 5 | | (1) provided the business or establishment with | 6 | | reasonable notice of noncompliance that informs the | 7 | | business or establishment that it is subject to a civil | 8 | | penalty if it does not correct the violation within 30 days | 9 | | from the date the notice is sent to the business or | 10 | | establishment; and | 11 | | (2) verified that the violation was not corrected | 12 | | within the 30-day period described in paragraph (1).
