SYNOPSIS AS INTRODUCED:

Amends the Grade A Pasteurized Milk and Milk Products Act. Permits the sale and distribution of any milk or milk product for human use or consumption only if such milk or milk product has been produced and processed in accordance with rules adopted by the Department of Public Health. Requires the Department to adopt rules for the production and processing of unpasteurized milk or milk product. Provides that a seller or distributor is not liable for any injury caused to another person by that person's consumption of unpasteurized milk or milk product if that product has been produced and processed in accordance with the Department's rules.

A BILL FOR

AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Grade A Pasteurized Milk and Milk Products Act is amended by changing Section 8 as follows:

Sec. 8. A After the effective date of this Act, no person may shall sell or distribute or , offer to sell or distribute any milk or milk product for human use or consumption only if unless such milk or milk product has been pasteurized and has been produced and processed in accordance with rules adopted and regulations promulgated by the Department.

The Department shall adopt rules for the production and processing of unpasteurized milk or milk product under this Section.

A seller or distributor of unpasteurized milk or milk product is not liable for any injury caused to another person from that person's consumption of unpasteurized milk or milk product if that product has been produced and processed in accordance with the Department's rules.

The term "sell or distribute for use or consumption" means to sell or distribute to a person for human use or consumption and not for processing or resale in any form.

The pasteurization requirement of this Section shall not be applicable to milk produced in accordance with Department rules and regulations if sold or distributed on the premises of the dairy farm.
