| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Department of Healthcare and Family Services | 5 | | Law of the
Civil Administrative Code of Illinois is amended by | 6 | | adding Section 2205-25 as follows: | 7 | | (20 ILCS 2205/2205-25 new) | 8 | | Sec. 2205-25. Barriers to paying child support; study. | 9 | | (a) Subject to appropriation, the Division of Child Support | 10 | | Services of the Department of Healthcare and Family Services | 11 | | shall conduct a study regarding the barriers individuals face | 12 | | to paying child support. The purpose of the study shall be to | 13 | | identify and minimize barriers to paying child support so as to | 14 | | decrease the total amount of unpaid child support in Illinois. | 15 | | The study shall focus on the following: | 16 | | (1) demographics of those who fail to pay child | 17 | | support, including: income, education level, age at first | 18 | | becoming a parent, ratio of monthly child support to | 19 | | monthly income, criminal history, child visits per month, | 20 | | number of children, substance abuse history, whether the | 21 | | individual is on probation or parole, and primary language | 22 | | spoken; | 23 | | (2) institutional barriers to paying child support, |

| 1 | | including how and when it is collected; | 2 | | (3) the impact, if any, that unpaid child support | 3 | | information has on an individual's ability to be | 4 | | considered, interviewed, and hired by an employer, | 5 | | including: (i) whether credit and background checks reveal | 6 | | unpaid child support obligations, including, but not | 7 | | limited to, amounts in arrears, civil judgments, and | 8 | | criminal convictions for failure to pay child support, and | 9 | | (ii) whether the information revealed in a credit or | 10 | | background check regarding unpaid child support prevents | 11 | | applicants from gaining employment. | 12 | | (b) The Department shall report the results of the study | 13 | | and any recommendations to the Governor and the General | 14 | | Assembly on or before May 1, 2017. | 15 | | (c) This Section is repealed on January 1, 2018.
