AMENDMENT TO HOUSE BILL 3121

2    AMENDMENT NO. ______. Amend House Bill 3121 on page 3, by
3replacing lines 4 through 25 with the following:
4    "The furnishing of financial information to a municipality
5or county, upon request of the chief executive officer Chief
6Executive thereof, is an official purpose within the meaning of
7this Section, provided the municipality or county agrees in
8writing to the requirements of this Section. Information
9provided to municipalities or counties under this paragraph
10shall be limited to: (1) the business name; (2) the business
11address; (3) the standard classification number assigned to the
12business; (4) net revenue distributed to the requesting
13municipality or county that is directly related to the
14requesting municipality's or county's local share of the
15proceeds under the Use Tax Act, the Service Use Tax Act, the
16Service Occupation Tax Act, and the Retailers' Occupation Tax
17Act, and, if applicable, any locally imposed retailers'
18occupation tax or service occupation tax; and (5) (4) a listing

1of all businesses within the requesting municipality or county
2by account identification number and address. On and after July
31, 2015, the furnishing of financial information to
4municipalities or counties under this paragraph may be by
5electronic means.
6    Information so provided shall be subject to all
7confidentiality provisions of this Section. The written
8agreement shall provide for reciprocity, limitations on
9access, disclosure, and procedures for requesting information.
10Only the chief executive officer of the municipality or county
11may initiate the written agreement with the Department. The
12chief executive officer of the municipality or county shall
13provide the Department with a list of names and official titles
14of municipal or county personnel, as appropriate, designated by
15the chief executive officer as persons exclusively authorized
16to request return information, view return information, or
17receive related information on his or her behalf. This list
18shall be restricted to municipal or county personnel, as
19appropriate, who are directly involved in the financial
20operations of the municipality or county, and the financial
21information provided by the Department shall not be viewed by
22or shared with anyone who is not on the list. The written
23agreement may be canceled by either the Department or the chief
24executive officer of the municipality or county at any time and
25shall be canceled in the event of any unauthorized use or
26disclosure of State tax return information obtained pursuant to

1the written agreement, or in the event of a failure to abide by
2the procedures set forth in the agreement by the Department for
3safeguarding the confidentiality of such return information.".
