SYNOPSIS AS INTRODUCED:

820 ILCS 115/3.5 new

Amends the Illinois Wage Payment and Collection Act. Provides that employees must be given notice of the shifts to be worked 2 weeks in advance of the scheduled shift. Establishes requirements for minimum pay for working shifts outside of scheduled shifts.

A BILL FOR

AN ACT concerning employment.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Wage Payment and Collection Act is amended by adding Section 3.5 as follows:

(820 ILCS 115/3.5 new)

Sec. 3.5. Worker's schedule; pay requirements.

(a) An employer shall provide an employee with notice of the employee's shift schedule 2 weeks before the employee is scheduled to work.

(b) An employer shall pay employees in accordance with the following requirements:

(1) An employee who works a shift outside of the employee's scheduled work shift shall be paid the greater of 4 hours pay or the pay for the entire shift worked.

(2) An employee who presents for work for a regularly scheduled shift shall be paid the greater of the amount of pay equal to the pay for one-half of the duration of the scheduled shift or the amount of pay for the entire shift worked.
